Abstract:The criminal reconciliation plays a more and more important role in criminal justice field. Reforms involving criminal reconciliation are actively carried out in some places. However,it is hard to make some breakthrough in these reforms because of the shortage of basic philosophy research. Zhejiang "Fengqiao Experience" and U.S. VOR Model present both differences and common models in east and west of the world. Taking a serious look at both the similarities and differences between the two models,we need treat legal realism,restorative justice and communicative action theory objectively. Criminal justice should not become "passive" harmony and harmony justice should not be unrealistic "sky rose".

Abstract:In the practice of voluntary surrender system in China, especially in cases of residual voluntary surrender, voluntary surrender system will be apparently invalid if the suspect brought to justice mistakenly thinks his or her behavior constitutes a crime due to wrong legal understanding and then confesses it, while such a crime is only an infringement act of legal interest in accordance with objective elements of the crime. It can also be concluded that such special cases are not applicable to confession and even merit system. Based on the different perspectives of utilitarianism, labeling theory, and legal economics, the negative impact of the above-mentioned defects can be seen. And not only that, it also reflects that it is reasonable to correct the application scope of voluntary surrender system.

Abstract:The escape regulated in the law on road traffic safety is different from the one in traffic accident.And not all the acts unfulfilled obligations would be considered as hit and run traffic accidents.Surrender is the right of the defendant.The definition of surrender should be in accordance with the provisions of the criminal law,but not obligative regulations of other laws.It should be considered as surrender if protecting scene of the accident after traffic accident.Surrender is the optional lenient plot of penalty,but nor necessary.It is not confused of the consideration of surrender and the sentence of surrender.

Abstract:The initial verdict of XU Ting case is a judgment of strict legalism.The reason that it evolves into a public event is the joint attacks of some lawyers,scholars and the public.The retrial verdict applies the special mitigation system which is stipulated in clause 63 of Criminal Law of China and reduces the initial sentence of life imprisonment to five years imprisonment,with the same facts and same crime which is affirmed in the initial verdict.Although the retrial verdict meets the expectations of the public,it has damaged judicial authority immeasurably.Besides,it shows the terrible consequence of untied discretion power.In fact,the crux of the case does not lie in judiciary,but in legislation.Therefore,the special mitigation system can not provide us a feasible scheme for solving the cases alike.Only by establishing regular constitutional review can we completely solve the problem of judicial injustice which derives form legislation injustice.

Abstract:The legislation providing that an entity may commit a crime and should be subject punishment bears a tinge of "rigidness but not severity." However,for a long time,while misunderstanding the structure of "entity crime," people have been seeking to determine liabilities born by the entity or the representatives thereof within the framework of one criminal act.Consequently,there appear many contradictions and conflicts both in legislative theories and judicial practice.Thus,it is urgent to reconsider the structure pattern of the crime committed by an entity.In deed,it contains two crimes:one perpetrated by the representatives of an entity which is physical while the other committed by the entity which is fictitious.The two crimes are closely linked but they are two criminal acts separate from each other and cannot be held an accomplice.As such,the entity and the representatives thereof are parallel and independent subjects of crime whose liabilities should be attributed to their respective acts.

Abstract:A unique feature of traditional Chinese law was the provision by statute that an offender who voluntarily surrendered and confessed before discovery and who made full restitution was entitled to remsision of punishment. Offenders who physically harmed their victims or offended against die state itself by commiting treason or escaping across borders were not entitled to remission, but could receive a reduction of punishment. Under the Republic this provision, known as tzu-shou , was continued in name but materially changed in substance under the influence of Western law as introduced through Japan. In general, the rewards for voluntary surrender and confession were reduced to mere reduction of punishment, but the scope was broadened to include crimes such as homicide, for which restitution was impossible. When the Chinese Communists first began developing a legal system in the 1930's, they too adopted tzu-shou . However, under them it became primarily an instrument of political control and social and ideological reform. It has remained an important aspect of Communist law even to the present though its application has ceased to have any strict legal significance.

Abstract:The surrendering rules in criminal laws in most East Asian countries nowadays are rooted in Chinese ancient times. However,these rules are very different from their origin after the process of modernization.In Chinese ancient Code such as the Qing Code,thieves surrendering themselves could be treated more tolerant than in most countries in modern times,unless in some extreme occasion recorded in the code. In case of surrendering themselves,the punishment put on them would be reduced accordingly. Beside thieves themselves,their relatives or other people they appealed to could surrender in place of them. They could surrender to the government as well as to the victims. These rules appeared to be out of formal logic,but actually,they matched the rational and ethical feeling in Chinese people's heart.

Abstract:The research on criminal responsibility in China has been slowed down in recent years,and we cannot transcend the level we have reached. In author's opinion, the most important reason of such situation is that theories on criminal responsibility only put their eyes on penalty, so that theories on criminal responsibility and theories on penalty are almost the same. If so, it is not necessary for theories on criminal responsibility to exist, theories on penalty will take their place.However, the emergence of VOM (victim-offender mediation) has shown another possible understanding of criminal responsibility, and will broaden our horizons about it. This paper discusses the new concept of criminal responsibility in VOM's view, including the premise, subjects, objects, varied measures, and aims of criminal responsibility. In detail, in view of VOM, the premise of criminal responsibility is that the offenders have relatively free will.The primary subject to assume responsibility is the offender, but at the same time, the community is also responsible for the event. They are responsible to the victim and the community, not to the state. The measures to realize criminal responsibility include compensation, apology and community labor. The aim of these measures is to restore all parties. VOM itself will be an important criminal sanction different from penalty. Accordingly, the methods for the offenders to undertake their criminal responsibility will be penalty, security measures, and VOM, not only penalty and security measures which we usually thought them to be.This paper analyses in detail the relationship among these three methods, especially their differences. At last, this paper discusses the aims of criminal responsibility. As far as we know, punishment and prevention are the two goals of criminal responsibility. VOM shows us a promising future that restoration grows to be one of the goals of criminal responsibility. The paper analyses in detail the relationship among these three goals.

Abstract:Although it is widely recognized by modern society that the acceptance of the victim is one of the reasons to remove criminality,Chinese criminal law does not prescribe it.Its theoretical foundation is that the criminal law takes the protection of individuals' interests as its principal task,so the interests abandoned voluntarily by the victim are beyond its area of protection.The application of the acceptance of the victim is to all the crimes encroaching on personal interests except on life.To establish the acceptance of the victim,we must take account of the victim's genuine will.It will be void if the victim makes the decision of abandoning legal interests by mistake.Only when the victim has already made acceptance in very necessity,we could construct his/her real consent of it.Moreover,the application of construction should be restricted strictly.

Abstract:In recent years,the study of Negligently Causing Serious Accident Crime become the focus of attention for the frequent occurrence of various serious accidents arising from negligence.Through the comparative study on the offence form of Negligently Causing Serious Accident Crime in foreign Criminal Laws and the doctrine dispute in Chinese Criminal Law theory field,this article advances that the offence form of Negligently Causing Serious Accident Crime in Chinese Criminal Law is can but negligence,not indirect intention and complex offense.The root of the dispute about offence form consists of the offence faintness,namely offence crossover due to the defect of the theory of indirect intention and negligence with undue assumption.Finally,the article classifies the type of negligence of this crime according to the understanding standard and relationship type of harmful consequences.

Abstract:The notion of violating norms in criminal jurisprudence has important significan ce of overcoming the shortcomings of the doctrine of harming legal interest, imp roving the public’s recognition of criminal law and evaluating crimes correctly . Firstly, the article analyses the meaning and content of norms, the value of t he norms of social ethics and the philosophical foundation of the notion of viol ating norms. On this basis, the author points out that, owing to our life being shaped by norms directly or indirectly, we should explain the nature of crimes a ccording to the notion of violating norms Thus, we will define the crimes, whi ch are acts of harming legal interest in a sense, as violating ethical norms of the commnwealth of the society. Abstract:In the criminal procedure law revised in 2012,the exclusionary rule of illegally obtained evidence has been established in China,but the rule of voluntary confession is still neglected.It is common practice in many countries that voluntariness is the necessary condition of the admissibility of confession.Even so,it is seldom discussed in the academic research in China.There are several reasons why the voluntariness of confession is treated coldly.The tendency to rely on confession too much has not been changed yet,and there are fewer persons who are conscious of the detriments of coercion,lure,deceit and other wrongful means to obtain evidences which result in wrongful convictions.Still,the idea of due process of law as the basis of the rule of voluntary confession has not been recognized yet.And at last,the lack of precise research makes a superficial knowledge of the rule of voluntary confession. This paper analyses the illegal acts of obtaining oral evidence one by one and marks out the dividing line for legal and illegal act.It also makes a proposal to establish and carry out the rule of voluntary confession in the criminal procedure of China,otherwise the root for falsely or wrongly charged or sentenced cases cannot be eradicated,and the substantial advance of judicial practice cannot be achieved.To confirm the legal value of the rule of voluntary confession is not only benefit to reveal the facts of cases,but also necessary to help the criminal justice to get rid of the characteristic of inquisition in the end.The three standards of the voluntariness including the due process standard,the conscience standard and the innocent person standard are also discussed in this paper.
