The Analysis on Way of the Criminal Regulations to the Drunken Driving

Abstract:The debate,which is the accusation should be choose,has flooded in the criminal practice on facing the traffic accident by drunken driving.However,they all have been ignored that the reasons to punish the intoxication in the criminal law is too superficial to dealing with the different circumstances.According to the actio libera in causa theories and the person's criminal liability,which contains the non-criminal liability and the limited liability,we could distinguish the subjective idea of actors transparently.On the consideration of legislation amended,the criminal regulations would become more efficient by stipulating the driving in intoxication,exceeding the speed limit,no qualifications to driving and so on as the situations of aggravation of penalty.
