Study on Statutory Penalty Allocation for Negligently Causing Serious Accident Crime

Abstract:In recent years,the study of Negligently Causing Serious Accident Crime becomes the focus because of the frequent occurrence of various serious accidents arising from negligence.This article specially studies the statutory penalty allocation for Negligently Causing Serious Accident Crime,especially the measurement and type of statutory penalty and the penalty allocation for Negligently Causing Potential Serious Accident Offense. The legal defect of the statutory penalty allocation for Negligently Causing Serious Accident Crime in our country behaves that the penalty measurement is too light and the penalty type is too simple.So the range of statutory penalty should be adjusted and added by fine penalty and qualification penalty.And the Negligently Causing Potential Serious Accident Offense should be established,the penalty allocation of which should be lighter than the actual damage offense,and the fine penalty and qualification penalty should be preferred for that.
