Abstract:The section 114 in criminal law prescribes the specific potential damage offense.When the dangerous driving behavior generates specific public danger as that of arson and explosion,and the perpetrator has the intention of imposing danger,section 114 should be applied,even without any casualties result nor any actual harm.Section 115,Paragraph 1 contains the consequential offense and aggregated consequential offense,which apply to dangerous driving perpetrator who has the intention of the casualties of actual harm,or who has the intention of the specific public danger,but only cause the real casualties of actual harm due to his negligence.There are definitely a clear distinction between the measurements of both penalties.The action violating the traffic regulation only generates public danger,but it is not equal to that of arson and explosion;When the action generates specific public danger as that of arson and explosion,but the perpetrator causes the specific public danger due to the negligence,the crime of intentionally endangering public security in a dangerous way cannot be applied.When casualties occur as a result of the actual harm,and the perpetrator causes it through negligence,the crime of traffic offense should be applied.At present,it is necessary to change the situation of giving a light sentence to traffic offense.
