Abstract:The African Commission on Human and Peoples’ Rights is leading an initiative to draft a disability protocol. This is particularly important for persons with mental disability as the draft protocol makes specific provisions guaranteeing their right to personal liberty, a right currently unavailable to them under article 6 of the African Charter on Human and Peoples’ Rights as interpreted by the African Commission in Purohit & Moore v The Gambia. This article analyses the changes introduced by the draft protocol and examines to what extent they provide realistic prospects for the enjoyment of that right by persons with mental disability.

Abstract:Children require specific protection due to their heightened vulnerability to human rights violations, which can be attributed to several factors such as economic adversity, racial tensions, and armed conflicts. The current situation in South Africa is characterised by a pressing and significant prevalence of severe poverty. The enduring effects of apartheid have contributed to a broad range of socioeconomic challenges inside our deeply divided country. Children are particularly impacted by these issues and experience immediate suffering as a result. In the Republic of South Africa, a significant proportion of the youth population experiences the distressing circumstance of living in poverty. It has been reported that a significant proportion, ranging from 60 to 75 percent, of the youth population in South Africa is experiencing impoverished living conditions. The prevalence of HIV infection and the consequential mortality rates due to AIDS among caretakers have a detrimental effect on the well-being of children. The United Nations Convention on the Rights of the Child (UNCRC) encompasses social, economic, and cultural rights under its provisions. Following the ratification of the UNCRC in June 1995, South Africa is legally obligated to implement the articles pertaining to the rights of children. The formulation and structuring of socio-economic rights and corresponding duties towards children under the South African Constitution were significantly influenced by the UNCRC. The interests of children in South Africa are effectively safeguarded through the provisions enshrined in the Constitution and the duties outlined in the UNCRC. Abstract:Abstract A clean, healthy and sustainable environment is both a human right itself and necessary for the full enjoyment of a broad range of children’s rights. Conversely, environmental degradation, including the consequences of the climate crisis, adversely affects the enjoyment of these rights, in particular for children in disadvantaged situations or children living in regions that are highly exposed to climate change. The exercise by children of their rights to freedom of expression, peaceful assembly and association, to information and education, to participate and be heard and to effective remedies can result in more rights-compliant, and therefore more ambitious and effective, environmental policies. In this way, children’s rights and environmental protection form a virtuous circle. The present general comment is focused on children’s rights and the environment, with a particular emphasis on climate change. Its aims are to: (a) emphasize the urgent need to address the adverse effects of environmental degradation, with a special focus on climate change, on the enjoyment of children’s rights; (b) promote a holistic understanding of children’s rights as they apply to environmental protection; and (c) clarify the obligations of States party to the UN Convention on the Rights of the Child (the Convention) and provide authoritative guidance on legislative, administrative and other appropriate measures to address environmental harm, with a special focus on climate change.
Monitoring the commitment and child-friendliness of governments: A new approach from Africa

Abstract:OBJECTIVE: The Convention on the Rights of the Child (CRC) is generally viewed from an ethical perspective, specifically for its influence and impact on our ethos and the place of children in society. A recent ground-breaking report prepared by The African Child Policy Forum (ACPF) shows conceptually and empirically how the CRC can be used as a tool for planning national action and for monitoring government performance and compliance. This paper reports on the methodology followed, the philosophical and legal foundations, the results of the application and the policy lessons.METHOD: This work is based on a methodology, the Child-Friendliness Index (CFI), developed by ACPF to analyse and monitor the performance of all 52 African governments. The index is inspired by the CRC's three core principles-Protection, Provision and Participation-and based on over forty policy and child-outcome indicators.RESULTS: The methodology was applied to organise data, assess performance and score and rank all 52 African governments at a point in time and over time. On this basis, the study identifies which governments are child-friendly and which ones are not and why, and what it is that poorly performing governments can do to comply with their international obligations.CONCLUSIONS: Two important conclusions emerge from this exercise. The first is the beauty and power of simplicity. Much analysis of government obligations is hampered by the tedious task of having to scan voluminous information and bulky reports. But this CRC-inspired and CRC-based methodology provides a simple but powerful, transparent and objective framework for policy analysis and comparison. Secondly, the African experience confirms that three things matter on the policy front: politics that put children at the centre of public policy; Laws that protect them; and Budgets that provide for their basic needs and full development.PRACTICAL IMPLICATIONS: ACPF's work provides an approach that governments, advocacy groups and treaty bodies can use to monitor government compliance, to identify areas for progress and to formulate effective pro-children policies. The approach is important and relevant for other regions of the world as it is for Africa.

Abstract:The study aims to identify obstacles - obstacles faced in fulfilling a child's basic human rights (human rights) in education article 31. The protection of human rights became an element of legal sovereignty. A legal requirement is good if it produces a good application. The theory supporting this study is the concept of legal sovereignty, where the theory of justice lies in the two principal principles used in creating justice. Same freedom, as long as it benefits all parties, the principle of inequality used to profit the weakest. The research method used is a correlation description analysis with data collection techniques in-depth interviews, observation, and documentation. Studies show that human rights in children have a correlation value of 0.145. Basically, human rights enforcement efforts in basic have a significantly low correlation with Article 31 Education guarantee freedom in self-development in accordance with a nine-year government program.

Abstract:Author summary Why was this study done? Sub-Saharan Africa (SSA) had the largest number of children (29.4 million) with low cognitive and/or social-emotional development worldwide in 2010. Housing might be linked to early childhood development (ECD) by affecting a child's health and a parent's ability to provide adequate care but is neglected in public health, especially in low- and middle-income countries (LMIC). What did the researchers do and find? We tested the hypothesis that improved housing is associated with on-track development in 2 ECD domains (cognitive and social-emotional). We analyzed data from 88,271 children aged 36 to 59 months in 20 SSA countries collected from nationally representative surveys conducted between 2010 and 2019. Improved housing was associated with 15% higher odds of being developmentally on track in the cognitive domain. Overall, improved housing was associated with on-track social-emotional development in girls but not boys. What do these findings mean? Housing improvement in SSA may be associated not only with benefits for children's physical health but also with broader aspects of healthy child development. Future work to establish a causal link between housing and ECD and to assess its underlying mechanisms is crucial for the designing of cost-effective ECD interventions in SSA. Background The influence of the safety and security of environments on early childhood development (ECD) has been under-explored. Although housing might be linked to ECD by affecting a child's health and a parent's ability to provide adequate care, only a few studies have examined this factor. We hypothesized that housing environment is associated with ECD in sub-Saharan Africa (SSA). Methods and findings From 92,433 children aged 36 to 59 months who participated in Multiple Indicator Cluster Survey (MICS) in 20 SSA countries, 88,271 were tested for cognitive and social-emotional development using the Early Childhood Development Index (ECDI) questionnaire and were thus included in this cross-sectional analysis. Children's mean age was 47.2 months, and 49.8% were girls. Children were considered developmentally on track in a certain domain if they failed no more than 1 ECDI item in that domain. In each country, we used conditional logistic regression models to estimate the association between improved housing (housing with finished building materials, improved drinking water, improved sanitation facilities, and sufficient living area) and children's cognitive and social-emotional development, accounting for contextual effects and socioeconomic factors. Estimates from each country were pooled using random-effects meta-analyses. Subgroup analyses were conducted by the child's gender, maternal education, and household wealth quintiles. On-track cognitive development was associated with improved housing (odds ratio [OR] = 1.15, 95% CI 1.06 to 1.24, p < 0.001), improved drinking water (OR = 1.07, 95% CI 1.00 to 1.14, p = 0.046), improved sanitation facilities (OR = 1.15, 95% CI 1.03 to 1.28, p = 0.014), and sufficient living area (OR = 1.06, 95% CI 1.01 to 1.10, p = 0.018). On-track social-emotional development was associated with improved housing only in girls (OR = 1.14, 95% CI 1.04 to 1.25, p = 0.006). The main limitations of this study included the cross-sectional nature of the datasets and the use of the ECDI, which lacks sensitivity to measure ECD outcomes. Conclusions In this study, we observed that improved housing was associated with on-track cognitive development and with on-track social-emotional development in girls. These findings suggest that housing improvement in SSA may be associated not only with benefits for children's physical health but also with broader aspects of healthy child development.

Achieving social justice for children: How can children's rights thinking make a difference?

Abstract:This article draws on themes from the author's book, Children’s Rights: Toward Social Justice, that emerge from surveying children’s rights issues in different childhood contexts; the family, education, child protection, and health services. The author has selected five examples of application of children’s rights to a policy area and identified the implications for policy and practice. There are four core rights that cut across all children’s rights issues that are mentioned before discussing specific areas. First, children, regardless of race, sex, language, religion, disability, or class, are entitled to rights. In other words, all children should enjoy their rights and should not be discriminated against. Second, “the best interests of the child” should be “a primary consideration” in actions or decisions concerning children. Third, children have the right to survival and development. And fourth, children have the right to be consulted and have their views heard in matters that affect them.

Abstract:Abstract This article provides a philosophical analysis of a putative right of the child to have their expressed views considered in matters that affect them. Article 12 of the United Nations Convention on the Rights of the Child 1989 is an influential and interesting statement of that right. The article shows that the child’s ‘right to a voice’ is complex. Its complexity lies in the problem of contrasting an adult’s normative power of choice with a child’s weighted views, in the various senses in which we might consider the child’s views, and in the questions of how to weight those views and how their weighting makes a practical difference in coming to a decision. In so doing we criticise other accounts that simply regard a child’s views as having consultative value. We also make better sense of how we might weight a child’s views. The philosophical issues addressed in the article carry implications for how we might understand Article 12 that are not satisfactorily identified and addressed in the voluminous literature on Article 12 within childhood studies. These issues also have implications for how we might understand the distinction between adults and children in respect of powers of personal choice. We conclude by emphasising the importance and value of the right that Article 12 seeks to formally identify.
