Abstract:Mainly thanks to the United Nations Convention on the Rights of the Child, its philosophy, ideas and principles, the Czech legal order was changed in early ́90 and later on, in connection with the Civil Code in 2012. The child is no longer conceived as a passive object of his or her parents ́ activities, their parental responsibility, but as an active subject with legally guaranteed rights. However, not only ‘law in books’ is relevant. There is still ‘bad practice’ connected with anonymous or hidden child delivery, abandoning new born children in ‘baby-boxes’ and older children in institutional care, although the state has attempted remedies. Besides, the number of divorces has increased in the Czech Republic over the last couple of decades, while in the last few years there are more marriages, and the divorce rate is no longer so alarming. However, the statistics reveal that minor children have not been an ‘obstacle’ to a ‘radical termination’ of the matrimonial bond. The article aims at finding an answer to the question whether abandoning an unregistered child or applying for hidden identity by his or her mother makes the ‘way’ of the child to a substitute family by adoption easier. Further, an attention is paid to surrogate motherhood. These topics are linked to the right of the child to know his or her origin. As the harmony between biological, social and legal parentage and the model of ‘continuing’ parenting are values, the well-balanced rights and duties of both the child parents and the best interest of the child are stressed. The final words are focused on alternative measures and interdisciplinary collaboration, besides public law instruments.

Abstract:Within the scope of this article, the socio-legal nature of the institution of guardianship of children deprived of parental care is revealed through the prism of the study of economic, socio-political and other factors that negatively affect the increase in the number of orphans and children deprived of parental care, who are among the most vulnerable and defenseless categories of the civilian population. The position is argued according to which, in recent years, Ukraine has been faced with many socio- political, economic and other factors that negatively affect its ability to ensure proper social protection of its population, especially children. Attention is drawn to the fact that along with the usual, traditional factors of recent decades (antisocial behavior of parents, their alcoholism and drug addiction, problems with employment, economic instability, labor migration of parents, low level of moral and spiritual life, especially of the younger generation, which is manifested in the increase the number of divorces, the birth of children out of wedlock as a result of the devaluation of the institutions of marriage and family, etc.), without a doubt, military actions played a role in the significant deterioration of the social situation of children. The article also reveals the positions of scientists regarding the possibilities of overcoming such negative factors, in particular by providing adequate social and psychological needs of children deprived of parental care. A conclusion is drawn, on the one hand, regarding the need to develop a reliable mechanism of psychological assistance for such children, which requires the state to take a comprehensive, multisystem approach to providing it to them, especially to those children who received psychological trauma from the war in order to overcome its consequences, and on the other hand, for under no circumstances should the state delay the process of forming such a mechanism.

Abstract:Using general scientific methods such as cognition and reflection of legal philosophy, the article is devoted to the study of peculiarities of legal protection of orphans and children deprived of parental care in Ukraine. In this connection, the definition of orphanhood is formulated, as well as the socio-legal protection of children, the main stages of the socio-legal protection of children are defined, the general principles of ensuring the family rights of children in the system of their protection are established. It was also emphasized that the social and legal protection of orphans and children left without parental care should take into account the state approach and take place in the conditions of a new adoptive, foster and adoptive family. It is concluded that, the optimization of state activities in this area lies in the formation of an effective system, the basis of which is the mechanism of socially coordinated interaction of regional authorities and society as a whole.

Abstract:the article presents an analysis of international experience in solving the housing problems of orphans and children left without parental care. These practices create certain opportunities for their adaptation in the conditions of the Russian Federation, taking into account the existing restrictions and socioeconomic risks. Among the promising opportunities for adapting international experience, the following can be distinguished: support of educational trajectories of orphans, ensuring their effective entry into the labor market, development of the institution of mentoring in the form of both state support and public charitable initiatives, development of the practice of social renting of housing from the municipal fund without the right to transfer it into the ownership of another person, expanding the representation of non-profit organizations in the field of social support for orphans and children left without parental care.

Abstract:The purpose of the study was to establish psychological challenges facing orphaned children and caregivers residing in six institutionalized institutions located at Ubungo District in Dar es Salaam. The study involved 67 participants who were selected through purposive sampling technique. They included twelve caregivers, six Directors, one Social Welfare Officer and 48 children. The study applied the descriptive research design. Data were collected using in-depth interviews and non- participant observation. Data were sorted and coded based on themes and presented according to the research questions through the thematic approach. Results indicated that orphan children were faced with stigma, discrimination, bullying, physical punishment, anxiety, poor attachment and isolation. To some extent, the challenges were caused by grief and lack of counseling knowledge and skills from the caregivers. Additionally, care givers had limited freedom to punish/discipline children with misbehaviors. Therefore, the study recommends counseling training for caregivers in order to minimize children psychological complexities and misbehaviors as well as furnishing of life skills training for orphans

Abstract:Background: Children have a right to participate in decisions about their lives. They also have the right to family and cultural connection, including when they are removed due to child protection concerns. However, the literature highlights barriers children in out-of-home care experience connecting to family-of-origin and culture. Moreover, this literature is predominantly from the perspective of practitioners and carers, with children's perspectives notably absent. Objective: This qualitative study addresses this gap by exploring Aboriginal and/or Torres Strait Islander and non-Indigenous Australian children's perspectives and experiences of family and cultural connection while in out-of-home care. It seeks to uphold children's right to express their views on matters that impact their lives. Participants and setting: The participants were 62 children aged 4-15 years (x̄=9 years), who were in out-of-home care in Queensland (Australia). Forty-two of the children were non-Indigenous and 20 identified as Aboriginal and/or Torres Strait Islander children. Methods: Lundy's (2007) model of participation guided the data collection approach. Art-based graphic-elicitation interviews were conducted. Verbatim transcripts were analysed thematically. Results: Children had differing levels of understanding as to why they could not reside with their family. Most children referred to a family-of-origin member not living with them as important in their lives, but it was not always their parent/s. Siblings were mentioned frequently. Barriers to connections with family included distance and cost of travel, parents not attending visits and being uncontactable, incarcerated or deceased. Whilst most children desired increased connection with family, a few wished for reduction or cessation. Aboriginal and/or Torres Strait Islander children showed varying levels of connection to culture with both siblings and carers playing key roles in enabling greater connection. Conclusions: Graphic-elicitation interviews provided an important opportunity for children to voice their experiences of and preferences regarding family and cultural connection. The inclusion of children's voices is needed to inform responsive policies and practices that safely support their rights to family and culture when in out-of-home care.

Abstract:This article provides an understanding of the relevance and importance of the principles of human rights and the UN Convention on the Rights of the Child. The article pays special attention to the importance of observing children's rights and encouraging advocacy activities of public and children's organizations regarding the protection of children's rights. In the presented study, the author analyzes the articles of the Convention and considers them as social rights (the right to life and development, health care and access to medical care, the right to education, family life, family reunification, the right to assistance in the maximum possible social integration for disabled children, as well as the right to support parents so that they can protect the rights of their children), economic rights (the right to decent living conditions, to social security, to protection from economic exploitation), cultural rights (the right to respect for language, culture and religion, for the abolition of traditional practices that may harm the well-being of the child), protective rights (the right to protect the interests of the child, protection from physical and sexual violence and exploitation, protection from participation in military conflicts, protection from abuse rights and humiliation), civil and political rights (the right to be heard and taken seriously, the right to freedom from discrimination in the exercise of rights, the right to freedom of religion and belief, the right to privacy, to information, to respect for physical and personal integrity and freedom from all forms of violence, torture or other cruel, inhuman, degrading treatment, the right to respect for the order of detention and criminal judiciary). It is emphasized that the mentioned international legal act plays an important fundamental role in the development of social consciousness and the practice of protecting children's rights and freedoms. It provides the legal basis for the necessary protection of persons under the age of 18.

Abstract:The aim of the work is to critically examine the encounters of an Indian child with the Jugendamt (‘Youth Office’) in Germany. The article examines the tension between protection and alienation of the child from its family and culture, questioning whether migrant, non-German children in such systems have rights, and if so what could they be? Through interviews with the family and document analysis, the study aims to establish whether the progression of the case from the position of the child has been in accordance with various United Nations human rights treaties such as the Convention on the Rights of the Child. By examining the case from a cultural, social justice and children’s rights perspective, this article concludes that unless steps are taken to dismantle the power and privilege dynamics of such institutions, children of ethnic communities will continue to be at risk of being separated from their families, in addition to being at risk of losing a variety of their rights, including the right to their cultural and religious identity.

Abstract:Abstract A clean, healthy and sustainable environment is both a human right itself and necessary for the full enjoyment of a broad range of children’s rights. Conversely, environmental degradation, including the consequences of the climate crisis, adversely affects the enjoyment of these rights, in particular for children in disadvantaged situations or children living in regions that are highly exposed to climate change. The exercise by children of their rights to freedom of expression, peaceful assembly and association, to information and education, to participate and be heard and to effective remedies can result in more rights-compliant, and therefore more ambitious and effective, environmental policies. In this way, children’s rights and environmental protection form a virtuous circle. The present general comment is focused on children’s rights and the environment, with a particular emphasis on climate change. Its aims are to: (a) emphasize the urgent need to address the adverse effects of environmental degradation, with a special focus on climate change, on the enjoyment of children’s rights; (b) promote a holistic understanding of children’s rights as they apply to environmental protection; and (c) clarify the obligations of States party to the UN Convention on the Rights of the Child (the Convention) and provide authoritative guidance on legislative, administrative and other appropriate measures to address environmental harm, with a special focus on climate change.
Neglecting the Neglected: Encumbrances to Children’s Successful Transitioning From Orphanages to Adoptive Homes in Nigeria

Abstract:The majority of children living within institutional care have a history of neglect. Past studies have identified developmental challenges with children in institutional care, for which reasons, orphanages must be transitional. However, placement of some children living in the orphan homes remains difficult. Through an in-depth interview with orphanage managers, social workers, prospective and successful adopters, and foster mothers, the study situates the diverse encumbrances to child placement in observed irregularities within three stages (entry, within the home, and at the exit point) of children’s contact with the orphan homes. The study found that unresolved regulation on the duration for custody of children in orphan homes impedes the placement of children who are merely kept for care and protection. Lack of response to the basic care needs of children within orphan homes poorly influence their chances for adoption, and sometimes disrupt placement processes. Also the legal preference for domestic adoption discourages and sabotages efforts toward inter-country placement of children who are not locally desired. These result into prolonged stay of children in orphan homes, and as such, children outgrow either adoption or fosterage. Child protection policy direction must, therefore, be value-laden, and informed by the unique system/society realities. This study, specifically, makes a case for more political interest in children living in orphan homes.

Abstract:Non-parents’ right to child custody is one of the many problems accompanying the current changed family view or family model. Korean Civil Law already has a history of trying to adapt to the new concept of family by breaking away from the traditional concept of family through legislation allowing (limited) grandparents’ right to visitation. This can be said to be part of the re-establishment of parental rights in terms of children’s welfare. The issue of custody of non-parents covered in this paper could also take the first step in its discussion in the same context. Such an examination inevitably involves adjusting the concept of parental rights, and it also involves a review of the relationship between parental rights and guardianship of minors as a supplement to parental authority. The custody of non-parents must first find its basis in guardianship of minors. However, it is worth noting that the supplementary nature of guardianship of minors to parental authority simultaneously implies an exclusive relationship between them. This is a limitation derived from the fact that guardianship of minors was originally designed as a supplement to parental authority, and in certain situations, it could come into an obstacle to realizing the maximization of children’s welfare. To solve this problem, there may be no need to re-establish the supplementary relationship between parental rights and guardianship of minors, but we need to consider an alternative of guardianship of minor. This article reviews the U.S. de facto parents system as the alternative. The de facto parent system, like the minor guardianship system, supplements the parental authority function, but its main focus is to contribute to the children’s welfare by maintaining and continuing the meaningful relationship already formed between the child and a non-parent. This does not simply assume an exclusive conflict with parental authority. This can be confirmed in the fact that joint custody or secondary custody is granted to the de facto parents in certain cases, which ultimately intended for the coexistence and cooperation of parents and de facto parents in raising children. This will be beneficial in achieving maximization of children’s welfare.
