Abstract:Abstract This article provides a philosophical analysis of a putative right of the child to have their expressed views considered in matters that affect them. Article 12 of the United Nations Convention on the Rights of the Child 1989 is an influential and interesting statement of that right. The article shows that the child’s ‘right to a voice’ is complex. Its complexity lies in the problem of contrasting an adult’s normative power of choice with a child’s weighted views, in the various senses in which we might consider the child’s views, and in the questions of how to weight those views and how their weighting makes a practical difference in coming to a decision. In so doing we criticise other accounts that simply regard a child’s views as having consultative value. We also make better sense of how we might weight a child’s views. The philosophical issues addressed in the article carry implications for how we might understand Article 12 that are not satisfactorily identified and addressed in the voluminous literature on Article 12 within childhood studies. These issues also have implications for how we might understand the distinction between adults and children in respect of powers of personal choice. We conclude by emphasising the importance and value of the right that Article 12 seeks to formally identify.

Abstract:Laws and policies in different jurisdictions provide a range of mechanisms that allow children involved in child protection processes and care proceedings to express their views when decisions that affect them are being made. Whether these mechanisms facilitate children’s involvement and whether they result in children’s views being heard and “given due weight in accordance with the age and maturity of the child”, as required by article 12 of the UN Convention on the Rights of the Child, is the focus of this article. The law, policy and practice in New South Wales, Australia, are used to provide a contextual illustration of the wider theoretical and practical issues, drawing on international comparisons and research. It is clear there is still some way to go to satisfy the requirements of article 12 in Australia and other jurisdictions. These mechanisms often do not provide the information children need to understand the process, nor do they consistently encourage meaningful participation through trusted advocates who can accurately convey children’s views to those making the decisions. It is generally unclear how children’s views are heard, interpreted, and weighted in decision-making processes. The research findings from a number of countries, however, are clear and consistent that children often feel ‘unheard’ and that they have had few opportunities to say what is important to them. A number of conclusions and practice suggestions are outlined for how the law could better accommodate children’s views.

Abstract:<span>Laws have a major influence on the daily lives of young people. However, their role in legislative processes has been less studied. This research focuses on youth participation in the legislative processes and bullying narratives in the bills and statements related to the Finnish General Upper Secondary Schools Act. According to a qualitative content analysis of two bills and the consultation processes of 2016 and 2018, young people were consulted and participated more broadly in 2018, but the threshold to participate in legislative processes is high. The results show that young people's views on bullying at school were not incorporated into the bills. The empirical results show a correlation to the theoretical framework, which illustrated how through their narratives various actors participate or try to participate in policymaking as agenda setters and framers, but the gatekeepers' views function mainly as a basis in the legislative processes.</span>

Abstract:Youth voices and perspectives are a critical component of contributing to positive social change. But there is a clear ‘youth participatory deficit’. Therefore, article aims to identify the expression of citizenship of young people and factors promoting it. Qualitative methods (analysis of scientific literature, group discussion, content analysis) were employed in the research. Group discussion participants – 48 young people living, studying or working in Klaipeda’s city. Literature review revealed variety of citizenship expression forms such as loyalty, patriotism, social responsibility, accomplishing of responsibilities and duties. Group discussion participants statements about their expression of citizenship mostly concerned with belonging to the nation or country and traditional volunteering. Scientists indicate different factors promoting citizenship engagement like education, identifying motivation and interest and so on. Group discussion participants statements analysis reveals some specific factors which would encourage bigger participation of youth in different activities: more and very specific information on different events and possibilities to participate in citizenship activities, suitable time, free of charge participation, activities and information about them must be very interesting or shocking.

Abstract:Children, i.e. people between 0 and 18 years old, have human rights. This is undisputed and the Convention of the Rights of the Child is a sufficient indication of this fact. What remains problematic is what they can do with their rights when they get in trouble or when legal proceedings are started that deal with their rights and interests. The Council of Europe has nominated justice for children as one of its key priorities and subsequently drafted guidelines on child friendly justice. These guidelines put forward the notion of justice proceedings, in the broadest sense, being adapted to cater for the needs of children and young people. As rights holders, they too should be able to turn to the justice system to have their rights protected and to have that done so in a child friendly way, taking into consideration their level of understanding, their specific vulnerabilities, their position and their best interest(s).These guidelines serve as a tool, aiding the daily work of judges, lawyers, police officers, social workers and other relevant professions. Their true impact will only be felt once they have been made widely available to all concerned professionals as well as to children and young people themselves. This way, the justice system can become more accessible and can better uphold children’s rights.

Abstract:This research briefly analyses Swedish and Estonian laws, journalistic codes of ethics, and newsroom guidelines that set the foundation for minors (not) being interviewed as news sources. Textual analysis of such documents shows that regardless of minors' right to free expression, minors are mostly addressed only in victims' roles, prioritizing protection over representation. Focus on guardian consent of under 18s is justified as protection, which also helps protect the newsroom from adverse reactions. We argue that the regulative basis of journalism reinforces the exclusion of minors from news coverage and prevents them from participating in public discussions. Therefore, the documents need updating from contemporary childhood sociology perspectives according to which minors are considered a resourceful group and distinguished into several age groups and roles, thus can be empowered to be included in news media. Prior State of Knowledge : Children are underrepresented in news media, which reduces their freedom of expression and agency to be part of public discussions. This decreases their interest in news media and isolates them from civic participation. Novel Contributions : Empirical research lacks the studies on the reasons why newsrooms exclude minors from news coverages. The current study focuses on regulations that affect journalistic practice on grass-root level and indicates the need for paradigmatic changes in regulatory documents. Practical Implications : Our findings have implications primarily for media scholars and journalists, but also parents. We encourage a discussion and change in the principles how minors should be engaged in news coverages.

Abstract:In light of the 30th anniversary of the UN Convention on the Rights of the Child in 2019, the twelfth edition of the European Yearbook on Human Rights is dedicated to the rights of the child. In their contributions, renowned scholars, emerging voices and practitioners provide a cross-section of the progress and gaps with regard to the protection of children. Topics include children deprived of their liberty, compulsory adoption and children's rights to participate in public debates on climate change, to name but a few. Besides the thematic focus on the rights of the child, this edition includes valuable insights from the European Court of Human Rights and the OSCE on the current challenges for the protection of human rights in Europe. Contributions focusing on the human rights implications of artificial intelligence, state sovereignty and gender identities raise awareness of the complexities of human rights protection and stimulate debate and further research in the field. Abstract:One of the most frequently cited principles in the 1989 United Nations Convention on the Rights of the Child is Article 12. This article provides a critical analysis of the challenges that child protection social work faces when implementing Article 12 in social work decision-making whilst simultaneously keeping children safe. The article begins with an outline of the general reasons for involving children in decisions that affect them but argues that despite being beneficial, implementing Article 12 has proved to be problematic due to theoretical, practical and ethical challenges within social work which will be examined. The article continues by arguing that it is possible to overcome these obstacles using Lundy’s model of conceptualising Article 12 as a real-world tool that offers practical solutions to help social work/workers overcome rather than avoid the identified challenges. It is intended that these suggestions will help empower social work/workers to discharge their legal obligation to enable children to be heard in decisions that affect them. The article concludes by arguing for a more empowering approach to children’s involvement in social work decision-making with some reflections on the future of Article 12 within the social work paradigm.
