Abstract:The right of peaceful assembly has been recognised as a critical component of democracy. In Africa it played a significant role in the liberation of states from colonial oppression, and continues to be used to express dissent. The actual exercise of this right, however, faces significant challenges. Too often, police officers use excessive or indiscriminate force during assemblies, leading to violations not only of the right of peaceful assembly but also, in some cases, of the right to life. Alive to the reality of the threat to life and limb posed by the unlawful use of force by the police during assemblies, over the past decades the African human rights system has developed standards for the use of force during assemblies. This article analyses the legal and jurisprudential developments around the protection of the right to life during assemblies and enquires as to whether they are consistent with international standards and whether they are adequate. It finds that despite progressive legal development on the protection of the right to life in law enforcement, in general, there is limited jurisprudence on the specific protection of the right to life in the context of the policing of assemblies. Consequently, the standards expressed in various instruments and resolutions are yet to be adequately interpreted and reinforced.

Abstract:This paper is the third from the "Salon Series on the Creation of Legislation on the Right of Association and Social Organizations". This was a series of salons jointly hosted by Tsinghua University's NGO Research Center, the Philanthropy and NGO Support Center, and the editorial office of the China Nonprofit Review. Discussion about the creation of legislation on the right of association began in China during the 1980s, at which time a bill was drawn up, but for various reasons, both political and social, the bill was never passed. This paper discusses the fundamental nature of the right of association and the feasibility and necessity of establishing legislation on this right in the China of today. It ponders the different ways in which the right of association may be enshrined in law, looking at the scattering of legal provisions throughout numerous pieces of legislation (in a multi-legislative model) in contrast with the method of spelling out of the right of association in one or more centralized laws (in a centralized legislative model). The paper also explores the relationship between the formulation of a basic law for social organizations and legislating on the right of association. It was unanimous amongst the experts speaking at the salon upon which this paper is based that establishing a law on the right of association would be an important hallmark of China's process in developing stronger rule of law, and that it is a sine qua non for achieving constitutionalism and advancing the implementation of the Constitution.
Protecting the human right to freedom of expression in international law

Abstract:Since its inclusion in Article 19 of the Universal Declaration of Human Rights, the right to freedom of opinion and expression has been protected in all of the relevant international human rights treaties. In international law, freedom to express opinions and ideas is considered essential at both an individual level, insofar as it contributes to the full development of a person, and being a foundation stone of democratic society. Free speech is a necessary precondition to the enjoyment of other rights, such as the right to vote, free assembly and freedom of association, and is essential to ensure press freedom. However, there is a clear and worrying global trend, including in western democracies, of governments limiting vibrant discussion and debate within civil society and among civil society, political leaders and government. Two examples illustrate this trend. First, anti-protest laws in Australia and the United States threaten the ability of people to stand together and express views on issues they care deeply about. Secondly, metadata retention laws jeopardise press freedom by undermining the confidentiality of journalists' sources and dissuading people from speaking freely on matters of public importance.

Abstract:The right of access to information is based on both Article 19 of the Universal Declaration of Human Rights (UDHR) and the International Covenant on Civil and Political Rights (ICCPR), which guarantee everyone the right and freedom “to seek, receive and impart information and ideas” by any means of their choice. Article 24 of the Constitution of the Democratic Republic of Congo (DRC) guarantees the right to information in the following terms: “everyone has the right to information”. The effective manifestation of this right to information remains closely linked to the exercise of freedom of expression and opinion on any subject of public interest and its inevitable corollary, freedom of information. The effectiveness of the right to information also depends on citizens' participation in the nation's public life. A population well-informed by its government can fight against fake news and the spread of false rumors while promoting the fight against corruption and good governance. Accessing public information is one of the most important conditions for assessing the democratic management and openness of society to citizen participation. As an inalienable right, access to information is the foundation of a free, democratic and transparent society. The research was based on the legal approach and the comparative method. The former allowed the subject to be approached by grasping the quintessence of the various existing legal standards. The latter helped to compare the various internal and extra-internal legal instruments based on comparative law, particularly French law. This analysis also used the documentary technique and the free interview in the form of a chat with ordinary citizens or any other personality (civil society groups, journalists, entrepreneurs, national and local elected representatives, other professional, political and trade union groups, and civil servants).

Abstract:Advances in technology have made it possible for the least talented person to become an Internet sensation. This has created challenges related to personality or image rights, data protection, privacy, and the right to be forgotten. The position in the United States of America is dealt with first. Individuals can rely on either federal law or state law. Section 43(a) of the Lanham Act prohibits conduct that causes confusion or false representations or deception. The right to publicity is very prominent. The author Prosser divided the right to privacy by reference to four categories of tort: the intrusion of physical solitude; public disclosure of private facts; representations in a false light; and the appropriation of a person's name and appearance. Richards and Solove believe that the right to publicity is often combined with an individual's appearance or name. The difference between appropriation and the right to publicity is that the former is traditionally focused on the damage to a person's right to privacy, while the latter focuses on the person's right to make money from their image. In South Africa, Cornelius is of the opinion that the approach here is more advanced than in other countries as the right to dignity is protected by the right to identity. Exclusions from liability in America would include newsworthy information and parody. In South Africa, the exclusions are press privilege and parody. The legal position of social media service providers in the United States is such that a high degree of immunity is provided to networks by the Communications Decency Act. Section 230 of the Act was aimed at promoting the free exchange of information and ideas over the Internet and at the control of offensive material. The right to be forgotten occurs in both systems.

Abstract:Constitutions and other legal frameworks are expected to ensure the protection of the fundamental and collective rights of citizens. In this respect, the regulation of political parties is a global phenomenon, which symbolises multi-party democracy, the rule of law and good governance. This article examines the phenomenon of the constitutional and legal regulation of political parties in the Central African Republic (hereafter CAR) and Senegal, two francophone countries with different trajectories and experiences of multi-party democracy. It identifies possible challenges and shortcomings of the regulation of political parties in the two countries, especially in relation to the actual implementation of the existing national frameworks. The article attempts to suggest possible frameworks for an effective implementation of the constitutional and legal rights of political parties, including the constitutionalisation of the enforcement mechanisms, which would undeniably protect the position of political parties in constitutional democracies. In conclusion, the article highlights the role of an independent judiciary in the promotion and protection of the constitutional and legal status of all political parties in the CAR and Senegal.

Abstract:The Freedom of Information Act is a statute of great constitutional significance. The Act heralded a right to publicly held information which government had attempted to keep private. FOIA laws have their origins in the pre-digital age and any discussion of information rights must take on board the contemporary reality of the global digitization of communications via social media networks and the enhanced capabilities of state intelligence agencies to conduct surveillance over electronic communications. The General Data Protection Regulation seeks to give greater security to personal data. However, private information is harvested by private tech companies which they have obtained often ‘voluntarily’ and used by intermediaries to influence public events, public power and elections—as illustrated by recent scandals involving the practice of ‘data farming’ by social media networks and the sale of personal data to political campaign consultants seeking to pinpoint electors and thereby affect the outcomes of national elections and referenda. Government surveillance is age-old, but the emergence of digital power has enabled public authority to invade our private lives far more intrusively and effectively. The most recent example is the Investigatory Powers Act 2016. All this poses substantial challenges for the public regulation of information access in a growing confusion of public and private in the constitution. Courts, meanwhile, have to balance demands for privacy protection, open justice and secrecy.

Abstract:This article takes as its starting point the fact that we live in democratic and progressive societies, and all need to participate in social structures. Whether we like it or not, we are all part of a political and social organization, just as we are part of multiple social communities. As Alexis de Tocqueville observed, as individuals in a given society, our associative efforts should be our strongest means for action and self-fulfilment (See Alexis de Tocqueville, Democracy in America (1835). ). Social structures need to solve collective action problems, to facilitate collective action and safeguard the participants’ rights. Collective labour is a social structure, and one that needs to solve collective action problems. Based on Kelsen’s analytical framework, this article argues that freedom for the individual in the collective labour context is a form of political liberty: the employee is granted the right to vote and to define his or her collective representative will. The majority requirement and the need to pay union dues represent an inevitable compromise between the need to act collectively and the need to ensure individual freedom. It is argued that the demand to ensure total freedom for those taking part in collective bargaining is basically a call for its destruction.

Abstract:AbstractDisabled people in Ghana continue to experience various forms of discrimination and social exclusion. These occur despite the fact that there are several anti-discriminatory laws that are meant to protect the rights of disabled people and facilitate their participation in mainstream social, political and economic activities. As it is, the laws have not completely eroded the discrimination and in some instances appear to even institutionalise the discrimination that disabled people experience. It is important that the state pays more attention to amending aspects of these laws and putting them into practice.

Abstract:The African Commission on Human and Peoples’ Rights is leading an initiative to draft a disability protocol. This is particularly important for persons with mental disability as the draft protocol makes specific provisions guaranteeing their right to personal liberty, a right currently unavailable to them under article 6 of the African Charter on Human and Peoples’ Rights as interpreted by the African Commission in Purohit & Moore v The Gambia. This article analyses the changes introduced by the draft protocol and examines to what extent they provide realistic prospects for the enjoyment of that right by persons with mental disability.
