Abstract:This paper addresses critical questions surrounding the security of government-issued identity documents and their potential misuse, with an emphasis on understanding the perspectives of ordinary citizens across Europe and the United States of America. Drawing upon research on technology acceptance and diffusion, the research focuses on understanding the factors that influence users' adoption of novel identity management solutions. Our methodology includes a comprehensive, census-representative survey spanning citizens from France, Germany, Italy, Spain, the United Kingdom, and the USA. The paper's findings underscore a robust confidence in government-issued identity documents, contrasted by a lower trust in private sector services, including social media platforms and email accounts. The adoption of artificial intelligence for identity verification remains contested, with a significant percentage of respondents undecided, indicating a need for explicit explanation and transparency about its implementation and related risks. Public sentiment leans towards acceptance of government data collection for identification purposes; however, the sharing of this data with private entities elicits more apprehension.

Abstract:Normative aspects in the preservation of cultural heritage imply a complex understanding and approach, insofar as this is a systemic process in which different cultural institutions acting with relevant competence and the normative framework have a role. It consists of international legal acts, such as the UNESCO Conventions, EU law - the regulations and directives and the internal law that is in accordance with them. The report covers a review of case studies related to the preservation of tangible cultural heritage: cases of dissonant cultural heritage; the case with the restitution of cultural values; cases of deregistration of tangible cultural values from the register and the philosophy of the law; legal issues in dealing with cultural property; problems of ownership of movable cultural property; the relationship of copyright and related rights to cultural heritage.

Abstract:The article considers the right for privacy and secrecy as an opportunity to have a life sphere hidden from the government, society and other individuals. The study is based on a holistic approach including logical, hermeneutical and comparative methods. The historical process of the origin of publicness triggered the development of legal guarantees, personal freedom, and political involvement. This was accompanied by the occurrence of the sphere of privacy where an actor is protected from state and public interventions. Whereas the public sphere is associated with openness, transparency, total accessibility, the private sphere is connoted with darkness, opacity, and closedness. The need for privacy and secrecy is determined by the human vulnerability. One of the critical components of privacy is the right of an individual for control his personal information. To protect one’s own private sphere, one puts on a social mask when speaking in public. In an intimate relationship, unlike in a public one, he voluntarily waives protection by allowing those closest to him access to personal information. The restricted private sphere is sometimes a source of apprehension and a desire to penetrate other people’s secrets, both from the totalitarian state, which seeks to suppress and unify the individual, and from curious members of society. For the purpose of retaining the social world, a person in the course of socialisation learns to respect other’s privacy, behaving discreetly and tactfully. The right for privacy and secrecy is related with freedom, dignity, and the autonomy of personality.

Abstract:Most developed countries have started the implementation of biometric electronic identification cards, especially passports. The European Union and the United States of America struggle to introduce and standardize these electronic documents. Due to the personal nature of the biometric elements used for the generation of these cards, privacy issues were raised on both sides of the Atlantic Ocean, leading to civilian protests and concerns. The lack of transparency from the public authorities responsible with the implementation of such identification systems, and the poor technological approaches chosen by these authorities, are the main reasons for the negative popularity of the new identification methods. The following article shows an approach that provides all the benefits of modern technological advances in the fields of biometrics and cryptography, without sacrificing the privacy of those that will be the beneficiaries of the new system.

Abstract:Abstract This article explores the challenges of the extraterritorial application of the right to be forgotten and, more broadly, of EU data protection law in light of the recent case law of the ECJ. The paper explains that there are good arguments for the EU to apply its high data protection standards outside its borders, but that such an extraterritorial application faces challenges, as it may clash with duties of international comity, legal diversity, or contrasting rulings delivered by courts in other jurisdictions. As the article points out from a comparative perspective, the protection of privacy in the digital age increasingly exposes a tension between efforts by legal systems to impose their high standards of data protection outside their borders – a dynamic which could be regarded as ‘imperialist’ – and claims by other legal systems to assert their own power over data – a dynamic which one could name ‘sovereigntist’. As the article suggests, navigating between the Scylla of imperialism and the Charybdis of sovereigntism will not be an easy task. In this context, greater convergence in the data protection framework of liberal democratic systems worldwide appears as the preferable path to secure privacy in the digital age.

Abstract:In this study we investigate the implementation and challenges of accessing archives in the digital age. Through an online survey and expert interviews, data were collected from archival institutions, professional users, and civil society organizations in all Council of Europe member states. The findings reveal that digitization has had a positive impact on document accessibility, providing convenience, reducing workload, and improving user access. However, only a small portion of archival holdings have been digitized, highlighting the need for further efforts in this area. Data protection and copyright present significant obstacles, with the European General Data Protection Regulation leading to access restrictions and legal uncertainties. Preservation, interoperability, and organization of records pose challenges in the digital realm, and while artificial intelligence shows promise in automating metadata creation and identifying sensitive materials, concerns about algorithmic biases and the need for additional checks are highlighted. To enhance accessibility, user-friendly interfaces, cooperation among memory preserving institution, and outreach to new user groups are crucial, which can ensure the effective preservation and accessibility of digital collections in the digital age. We provide insights for policy-making and archival institutions in navigating the evolving landscape of accessibility.

It argues for a more ecological perspective, one that takes account of the unpredictable quality of information flows as well as the costs of attempting to manage them. Also explored are some of the difficult, unanswered questions about whether all intangible cultural heritage is equally worthy of protection. Abstract:The article traces the European Union (EU)'s General Data Protection Regulation (GDPR) and implication in the Europe. In the era of global digitalisation, the right to respect private life, communication and the home has become a matter of protection. Protecting the right to privacy is a responsibility of a state which includes privacy of personal information, e.g. birth, messages, phone call and number and emails. Likewise, this study explains EU concern's about its citizens' privacy and the recent inclusion of the GDPR for the protection of natural persons. The article aims to explore individual fundamental rights and implications in the digital age, as well as cooperation data rules between companies and public bodies. At the same time, questions arise about the rightful implication of GDPR and the right to privacy of the public through protection, especially from tech companies. For validating the argument, various qualitative research methods were applied. The COVID-19 pandemic has raised a serious question over privacy rights protection by the government, which supports our findings that EU GDPR has a long road to go and have challenges. Its credibility of lawful data activities is also a matter of concern and a reliable promise by the member states and the EU.

Abstract:The General Data Protection Regulation (GDPR) has become a touchstone model for modern privacy law, in part because it empowers consumers with unprecedented control over the use of their personal information. However, this same power may be susceptible to abuse by malicious attackers. In this paper, we consider how legal ambiguity surrounding the "Right of Access" process may be abused by social engineers. This hypothesis is tested through an adversarial case study of more than 150 businesses. We find that many organizations fail to employ adequate safeguards against Right of Access abuse and thus risk exposing sensitive information to unauthorized third parties. This information varied in sensitivity from simple public records to Social Security Numbers and account passwords. These findings suggest a critical need to improve the implementation of the subject access request process. To this end, we propose possible remediations which may be appropriate for further consideration by government, industry and individuals.

Abstract:In business and government organizations, information systems often handle sensitive data about individuals and other organizations, using various kinds of identifiers. The growing cooperation of organizations results in the need to share and exchange such data. This collection and sharing, however, is affected by privacy concerns, and organizational and technical issues have to be solved and taken into account. This paper describes the results of an exploratory study in the government sector, focusing on the way public organizations manage identity-related data and the sharing of such data, either with other public agencies or with private organizations. Despite significant progress in harmonizing the legal and administrative provisions and technical standards in the European Union, there are still considerable cross-country differences regarding this subject. These differences—together with the growing mobility of goods, persons, and related data within the European Union—cause particular challenges for information systems in digital government in this region. After discussing and defining the key notions and methodology of the study, we present the status quo in 18 out of 25 EU member states and compare it to the results of a prior study by the same network done in 2001. Finally, we draw conclusions about identity management in cross-border contexts.

The Essence of the Fundamental Rights to Privacy and Data Protection: Finding the Way Through the Maze of the CJEU’s Constitutional Reasoning

Abstract:Abstract In the constitutional shaping of the concept of essence of fundamental rights, the case law of the Court of Justice of the EU (“CJEU” or “the Court”) in the field of privacy and data protection plays a crucial role. The Court’s interpretation of this notion had a considerable impact not only jon perception of the essence in other fields of law, but also on the constitutional doctrine more generally. This Article focuses on specificities of the notion of essence of fundamental rights to privacy and the protection of personal data from Articles 7 and 8 of the Charter of Fundamental Rights of the EU. After a general analysis, situating this notion into the framework of multi-level protection of fundamental rights in Europe, the Article addresses further interpretative challenges relating to the essence in the Court’s case law. At the core of the analysis are the Schrems and Digital Rights Ireland cases, where the CJEU developed, for the first time, the modalities of the breach of essence of fundamental rights to privacy and data protection and laid down constitutional foundations for interpretation of this notion. Further jurisprudence, including the Tele2 Sverige and Opinion 1/15 cases, is analyzed as an example of fine-tuning of the CJEU’s approach towards the normative understanding of this concept. Against this backdrop, the Article elaborates on the importance of insights in the fields of privacy and data protection for the general constitutional understanding of the concept of essence and proposes a generalized method for determination of infringement of essence in fundamental rights jurisprudence.
