Abstract:The article considers different approaches to the problem of freedom of conscience. As a result of the formed approaches, it can be established that the essence of research attitudes regarding freedom of conscience was mainly expressed in the model of the relationship "religious organization-person-state". Its leading idea can be considered a combination of two discursive directions of understanding freedom of conscience, which are directly related to each other – legal and axiological. Through the prism of various approaches correlated with modern scientific discourses, new contextual realities are proposed, within which freedom of conscience changes semantic nuances, being realized in the space of religious security, in its which is a free practice of faith by every person within the limits of the freedom of functioning of religious organizations is possible. It is emphasized that the essential features of freedom of conscience are influenced, firstly, by personal factors (worldview, religious traditions, etc.); secondly, confessional and inter-confessional communicative practices (both within the same denomination and at the inter-confessional level); thirdly, institutional "slices" (interactions in the processes of institutionalization), fourthly, state powers (observance of laws, consideration of international experience, prevention of abuse of religion, etc.). Their conceptualization is based on the existential-legal dominant, which largely determines their scientific discourse's content and main structural and semantic aspects. The affirmation and actualization of this discourse took place based on the synthesis of the domestic religious and legal tradition and pan-European humanistic and legal visions. Such a synthesis makes it possible to understand freedom of conscience not only as a worldview value, but also as a strategy for implementing religious security, thanks to which resistance to external and internal threats is possible.

Abstract:This article is dedicated to the constitutional restrictions on human rights and freedoms within the genesis and development of liberal democracy. The article argues that European countries implement the provisions of the ECHR in various ways regarding the application of restrictions of rights and freedoms in their own national legal systems in order to support: 1) the state and public security or economic well-being of the country; 2) the prevention of riots or crimes; 3) health or morals or for the purpose of protecting the rights and freedoms of others; 4) the protection of national security or territorial integrity; 5) protecting the reputation of others; 6) the prevention of disclosure of confidential information; 7) maintaining the authority and impartiality of judicial authorities. The research defines a common feature of all constitutional restrictions of human rights and freedoms within the European countries’ application, taking into account the objective circumstances necessary in a democratic society. The authors underline that under no circumstances should the restrictions distort the essence of human rights and freedoms that fall under such derogations. The article underlines that the restrictions on human rights and freedoms are a necessary component of the legal system of any state and modern society. Such restrictions should be of a legal nature and should be imposed only in accordance with the general interest – national security, law and order, the protection of moral norms, and the protection of the rights and freedoms of other persons when the right of another person in a legitimate balance prevails. The emergence of challenges to human rights does not negate their effectiveness, and they continue to operate, which testifies to their effectiveness and guarantees the inviolability of the rule of law principle when resolving specific cases on human rights restrictions.

Abstract:This article begins with some reflections on the definition of religious minorities, their needs and rights and how this relates to the discussion about the need for minority specific rights in addition to general fundamental rights as rights for all human beings irrespective of particular identity features. Secondly, an overall account of the ambiguous relationship between religious minorities and fundamental rights is presented. The third and most extensive section zooms in on the EU and religious minorities, starting with an account of the EU’s general approach towards minorities and then turning to the protection of fundamental rights of religious minorities in/through the EU legal order. First, the EU’s engagement with minority specific rights and the extent to which these norms have been attentive to religious themes will be discussed. Second, the CJEU’s case law concerning freedom of religion and the prohibition of dis-crimination as general human rights is analysed. The conclusion then turns to the overall perspective and discusses whether the EU’s protection of religious minorities’ fundamental rights can be considered ‘half-hearted’ and, if so, to what extent. This in turn allows us to return to the overall focus of the Special Issue, namely the relationship between the freedom of religion for all and special rights for religious minorities.
Making Room for Religion in the Workplace in a Diverse Society: A Comparative Perspective

Abstract:In March 2017, almost seventeen years after the adoption of Directive 2000/78/EC establishing the general framework for equal treatment in employment and occupation, the Court of Justice of the European Union delivered its two first and long-awaited judgments concerning the manifestation of beliefs in the workplace in the cases Achbita (Case C-157/15) and Bougnaoui (Case C-188/15). Both cases concern Muslim women employees in private companies who had been dismissed for wearing a headscarf at work. The purpose of this chapter is to explore from a comparative perspective how protection against discrimination on the grounds of religion and freedom of religion is granted in the workplace, and how protection is expanded or restricted in light of concepts such as ‘neutrality’ or ‘undue hardship’. The focus of the chapter is the private workplace, but references (where relevant) are made to rules governing the public sector. After a short introduction on the international legal framework, the chapter examines how freedom of religion and protection against discrimination are regulated in Europe under the European Convention on Human Rights and in EU law. The second part sheds light on the USA and Canada’s safeguards against religious discrimination in labour relations, analysing the scope of protection and its limits. The contribution concludes with a comparison of the systems examined in order to establish whether and to what extent similar tensions can be identified and whether a convergence of solutions is suitable and possible in the future.

Abstract:This article explores the place of religion within Australian primary and secondary education. It is divided into three parts. The first examines religion within the Australian legal and constitutional structure. The second considers the accommodation of religion in government (public or state) and nongovernment (private) schools, using the State of South Australia as a representative example. The overarching question addressed in the third part is twofold: (1) Does religion find a place in Australia's schools, both government and nongovernment? (2) To the extent that it does, are there current legal threats to that place—in other words, to the freedom of religious faith in schools? The final section offers some brief concluding observations about the place of religion in Australian life generally, suggesting that there may still be some judicial support for the place of religion in the public sphere, which may auger well for its future in Australian education.

Abstract:Inspired by a recent article in this journal, the author will further elaborate on the tension between the freedom of education and the freedom of religion, with particular focus on state support for faith-based schools and the organization of religious education in public schools. She will have a closer look at the American and Belgian policies concerning these items and clarify why both nations have similar problems with regard to faith-based schooling and religious education, although the causes for these difficulties are dissimilar: Both in Belgium and the United States, the de facto freedom of religion and education are not maximally guaranteed for all students, but for very different reasons. Similarly, the implementation of nonconfessional religious education seems very difficult in both countries, but also for different reasons. Based on these findings, the author gives some recommendations to guarantee both the freedom of religion and of education in the best way in both nations.

Abstract:The classical liberal concern for freedom of religion today intersects with concerns of equality and respect for minorities, of what might be loosely termed ‘multiculturalism’. When these minorities were primarily understood in terms of ethno-racial identities, multiculturalism and freedom of religion were seen at that time as quite separate policy and legal fields. As ethno-religious identities have become central to multiculturalism (and to rejections of multiculturalism), specifically in Western Europe in relation to its growing Muslim settlements, not only have the two fields intersected, new approaches to religion and equality have emerged. We consider the relationship between freedom of religion and ethno-religious equality, or alternatively, religion as faith or conscience and religion as group identity. We argue that the normative challenges raised by multicultural equality and integration cannot be met by individualist understandings of religion and freedom, by the idea of state neutrality, nor by laicist understandings of citizenship and equality. Hence, a re-thinking of the place of religion in public life and of religion as a public good and a re-configuring of political secularism in the context of religious diversity is necessary. We explore a number of pro-diversity approaches that suggest what a respectful and inclusive egalitarian governance of religious diversity might look like, and consider what might be usefully learnt from other countries, as Europe struggles with a deeper diversity than it has known for a long time. The moderate secularism that has historically evolved in Western Europe is potentially accommodative of religious diversity, just as it came to be of Christian churches, but it has to be ‘multiculturalised’.

Abstract:Space and Culture, Ahead of Print. Over long periods, interdisciplinary debates in urban studies on the relationships between religion and urban space were influenced by mainstream versions of modernization theory. These were based on the binary of urban modernity and nonurban (religious) tradition. However, historical urban research has shown that cities were also more often sites of religious innovation. Inspired by Jennifer Robinson's understanding of cities as "ordinary" sites of sociality, with this special issue we contribute to this vibrant debate on religion and urbanism. The articles in it examine the role of places of worship as spatial and urban projects and address the following questions: How do religious actors become spatial entrepreneurs whose spatial projects shape cities? Which religiously motivated social and material forms emerge in cities? What are the practices and regimes that contribute to the spatialization of religion? How does the nature of places of worship alter and adapt to rapidly changing urban environments? And what are the consequences of religious buildings and other material forms for the social reality of cities? We argue that in contrast to former periods, when religious buildings were considered and constructed as authoritative buildings, these buildings are now much more fluid. Broad social transformations profoundly changed the roles played by and the social meanings attributed to them. Religious buildings and informal religious sites are not mere static architectural structures but bring with them a wide variety of spatial, economic, political, affective, and spiritual investments which make their construction, presence, and transformation a slippery object for urban planning logics and experts.

Abstract:The Dutch approach to calibrating freedom of religion or belief and gender equality is characterized by its outspokenness as far as external affairs are concerned and, historically, the absence of a similar degree of fortitude when it comes to its internal affairs. Recently, the two perspectives—internal affairs and external relations—have become more or less aligned. This process was significantly steered by judicial interventions and interventions by human rights monitoring bodies, which judicial recourse was mobilized in turn by civil society. The non-proactive attitude on the part of the state must be understood—yet not necessarily justified—on account of its unique political constellation in which pillars, polders and principles are driving, if conflicting, forces.

Abstract:The complex and quite rich discourse centered on the three “Abrahamic” religions does not suggest the only way in which one can approach the issue of religious “liberty” or understand the relation among religion and the state. China offers an important and distinctive path that is in its own way more difficult to square with the Western focused discourse that has now become a global standard. Thus is it necessary, before exploring the technical legal details about the interaction of religion and the state in China. It is perhaps not too much of an exaggeration to say that “religion” signifies the character of the entire Western Civilization-- from the Council of Nicaea to the Crusades, and unto the 17th century Enlightenment and the rise of capitalism, Judeo-Christian religions have always played dominant role in the evolution (and devolution) of what is known as the “West”. China provides a substantially different “story” and that difference is foundational to China’s approach to the legitimacy of the boundaries for religious regulation. This essay offers a brief glimpse at a complex problem, and suggests the basis for the quite substantial difficulties of communicating between systems.

Abstract:We conduct research on a current problem that is relevant to legal science and practice – ensuring individual freedom in the context of increased interest in religion and the formation of a legal state in Russia. The latter term is considered in connection with such a legal phenomenon as the secular state. We denote the personal rights and freedoms of man and citizen in the religious sphere. We analyze and criticize the current state of freedom of conscience, the right to religious security, and the right of people studying in state and municipal educational institutions and organizations to receive knowledge about religion. It is shown that one of the exercise limits of conscience freedom is its moral criterion. The existing negative decline trends in the level of morality, culture, including legal culture, adversely affect the construction of Russian statehood. It is suggested that in such conditions the inclusion of a course on the foundations of the spiritual and moral culture of the peoples of the Russian Federation in the educational programs of schools and universities is justified. We focus on the requirements for voluntariness and alternative study of the named course. We propose to give them an equal character in terms of legal technology. The connection of freedom of conscience with the right to religious security is shown. In this context, the issue of establishing criminal liability for insulting the religious feelings of believing citizens is analyzed. We point out that with all the doubtful language used by the legislator to set for the disposition of the corresponding article of the Criminal Code of the Russian Federation, the enormous social significance of the amendments cannot be denied.
How to Strengthen Protection of (Religious) Minorities and Cultural Diversity under EU Law: Some Lessons from Human Rights Protection System

Abstract:The paper is split into two parts. The first part starts with the analysis of Views adopted by the UN Human Rights Committee on Yaker and Hebbadi v. France cases concerning the French Act prohibiting the concealment of the face in public. These Views are then compared with the judgment S.A.S. v. France delivered by the European Court of Human Rights on a similar case. This comparison shows that the principle of non-discrimination and, in this vein, intersectional discrimination play a critical role in assuring the effective protection of Muslim women wearing religious clothing. Analysis of S.A.S. is completed by highlighting the most relevant weaknesses of religious minority protection in the case-law of the European Court of Human Rights. Some references are also made to freedom of religious clothing in the workplace, underling the critical role that can be played in this regard by the duty of reasonable accommodation. The second part identifies the most significant shortcomings characterizing the protection of religious minorities under European Union law. In conclusion, this paper tries to highlight which lessons can be learnt from the human rights system—examined in the first part—in order to strengthen minority protection in the EU.
Freedom of thought in Europe: do advances in ‘brain-reading’ technology call for revision?

Abstract:Abstract Since advances in brain-reading technology are changing traditional epistemic boundaries of the mind, yielding information from the brain that enables to draw inferences about particular mental states of individuals, the sustainability of the present framework of European human rights has been called into question. More specifically, it has been argued that in order to provide adequate human rights protection from non-consensual brain-reading, the right to freedom of thought should be revised, making it ‘fit for the future’ again. From the perspective of criminal justice, the present paper examines whether such a revision is necessary within the European legal context. It argues that under its current understanding, the right to freedom of thought would probably not cover the employment of most brain-reading applications in criminal justice. By contrast, the right to freedom of (non-)expression will provide legal protection in this regard and, at the same time, will also allow for certain exceptions. Hence, instead of revising the absolute right to freedom of thought, a legal approach tailored to non-consensual brain-reading could be developed under the already existing right not to convey information, ideas, and opinions as guaranteed under the freedom of (non-)expression. This might need to re-interpret the right to freedom of expression, rather than the right to freedom of thought.

Protecting the human right to freedom of expression in international law

Abstract:Since its inclusion in Article 19 of the Universal Declaration of Human Rights, the right to freedom of opinion and expression has been protected in all of the relevant international human rights treaties. In international law, freedom to express opinions and ideas is considered essential at both an individual level, insofar as it contributes to the full development of a person, and being a foundation stone of democratic society. Free speech is a necessary precondition to the enjoyment of other rights, such as the right to vote, free assembly and freedom of association, and is essential to ensure press freedom. However, there is a clear and worrying global trend, including in western democracies, of governments limiting vibrant discussion and debate within civil society and among civil society, political leaders and government. Two examples illustrate this trend. First, anti-protest laws in Australia and the United States threaten the ability of people to stand together and express views on issues they care deeply about. Secondly, metadata retention laws jeopardise press freedom by undermining the confidentiality of journalists' sources and dissuading people from speaking freely on matters of public importance.
