Abstract:Children require specific protection due to their heightened vulnerability to human rights violations, which can be attributed to several factors such as economic adversity, racial tensions, and armed conflicts. The current situation in South Africa is characterised by a pressing and significant prevalence of severe poverty. The enduring effects of apartheid have contributed to a broad range of socioeconomic challenges inside our deeply divided country. Children are particularly impacted by these issues and experience immediate suffering as a result. In the Republic of South Africa, a significant proportion of the youth population experiences the distressing circumstance of living in poverty. It has been reported that a significant proportion, ranging from 60 to 75 percent, of the youth population in South Africa is experiencing impoverished living conditions. The prevalence of HIV infection and the consequential mortality rates due to AIDS among caretakers have a detrimental effect on the well-being of children. The United Nations Convention on the Rights of the Child (UNCRC) encompasses social, economic, and cultural rights under its provisions. Following the ratification of the UNCRC in June 1995, South Africa is legally obligated to implement the articles pertaining to the rights of children. The formulation and structuring of socio-economic rights and corresponding duties towards children under the South African Constitution were significantly influenced by the UNCRC. The interests of children in South Africa are effectively safeguarded through the provisions enshrined in the Constitution and the duties outlined in the UNCRC. Abstract:The plight of refugees is currently one of the concerning global human rights issues. The refugee population is largely comprised of women and children who become displaced during armed conflicts; this is because the majority of persons killed or who become victims of forced disappearance are men. Forcibly displaced children face direct physical threats, as well as a variety of health-related problems. Although forcibly displaced children generally include those who are not refugees, this contribution is only concerned with refugee children. Refugee children are vulnerable to different types of abuse and exploitation, and often become the target of discrimination, sexual exploitation and social marginalisation in the refugee transit camps and countries of exile. Although the Convention on the Rights of Child, 1989 was adopted to protect children’s rights worldwide, the true impact of these provisions remains uncertain. This contribution examines the extent to which the adherence to the Convention on the Rights of the Child is promoted in Africa. This study compares the situation in South Africa, Tanzania and Zambia to pinpoint the legal and practical challenges that face refugee children in those countries. The contribution concludes with recommended solutions for effectively protecting and promoting refugee children’s rights in Africa.

Abstract:The Constitution of Kenya, 2010 provides for a comprehensive Bill of Rights that seeks to ensure the protection of rights with an emphasis on 'marginalised' and 'vulnerable' persons. A dedicated clause and other specific provisions in the Bill of Rights detail the rights for children. Since 2010 the Kenyan judiciary has adopted a progressive stance by interpreting these provisions in ways that affirm children's autonomy and agency while recognising the reality of children's vulnerability and their need for protection. The expansive provisions of the Constitution have also enabled Kenyan courts to more readily embrace systematic remedial measures, such as judicial recommendations for the reform of the applicable legal framework and implementation of new policies to give effect to rights.
Monitoring the commitment and child-friendliness of governments: A new approach from Africa

Abstract:OBJECTIVE: The Convention on the Rights of the Child (CRC) is generally viewed from an ethical perspective, specifically for its influence and impact on our ethos and the place of children in society. A recent ground-breaking report prepared by The African Child Policy Forum (ACPF) shows conceptually and empirically how the CRC can be used as a tool for planning national action and for monitoring government performance and compliance. This paper reports on the methodology followed, the philosophical and legal foundations, the results of the application and the policy lessons.METHOD: This work is based on a methodology, the Child-Friendliness Index (CFI), developed by ACPF to analyse and monitor the performance of all 52 African governments. The index is inspired by the CRC's three core principles-Protection, Provision and Participation-and based on over forty policy and child-outcome indicators.RESULTS: The methodology was applied to organise data, assess performance and score and rank all 52 African governments at a point in time and over time. On this basis, the study identifies which governments are child-friendly and which ones are not and why, and what it is that poorly performing governments can do to comply with their international obligations.CONCLUSIONS: Two important conclusions emerge from this exercise. The first is the beauty and power of simplicity. Much analysis of government obligations is hampered by the tedious task of having to scan voluminous information and bulky reports. But this CRC-inspired and CRC-based methodology provides a simple but powerful, transparent and objective framework for policy analysis and comparison. Secondly, the African experience confirms that three things matter on the policy front: politics that put children at the centre of public policy; Laws that protect them; and Budgets that provide for their basic needs and full development.PRACTICAL IMPLICATIONS: ACPF's work provides an approach that governments, advocacy groups and treaty bodies can use to monitor government compliance, to identify areas for progress and to formulate effective pro-children policies. The approach is important and relevant for other regions of the world as it is for Africa.

Abstract:Decades of research have highlighted the challenges facing child protection services in a developmental approach. The aim of the article is to explore whether the developmental social welfare approach contributes to an improvement of child protection services. A descriptive case study design was applied in the Eastern Cape province, South Africa. The findings revealed limited knowledge among social work practitioners about the implementation of the developmental social welfare approach. The findings also revealed an overwhelmed child protection system that lacks coordinated and integrated services. It is recommended that child protection services be divided into prevention, early intervention and statutory services. Abstract:Abstract This chapter locates children’s rights in the context of global social governance. Social policy literature has hitherto neglected the centrality of child protection and children’s rights to many key areas of social governance such as education and healthcare. The chapter traces the history of children’s rights as a distinct sphere in international law from the first recognition of the special status of children, to the adoption of the UN Convention on the Rights of the Child (UNCRC), to the growth of the contemporary complex International Organization (IO) landscape. Children’s rights enjoy growing visibility and relevance and continue to be a cross-cutting issue in international organizations of all kinds, making them a central dimension of global social governance. Nonetheless, the chapter highlights that the growth of the children’s rights agenda has not been without conflict. International norms and measures surrounding children’s rights continue to be challenged and questioned by scholars and practitioners alike. Furthermore, the analysis of children’s rights provides opportunities to reconsider traditional approaches to global social policy.

Abstract:The United Nations Convention on the Rights of the Child stipulates the need for children and young people to have a say in matters that affect them. Despite being a signatory to this international legislation, Ghanaian children's input in child protection decisions are rarely considered. As a measure to improve child participation in decision making, the possible outcomes for involving children in child protection meetings were explored. Twenty-five parents who have been in contact with a Department of Social Welfare in Ghana took part in the study. This study adapted elements of the constructivist grounded theory approach using an in-depth interview method. The interviews were audio recorded, analysed thematically and managed with NVivo software. Analysis of the interview data revealed positive outcomes of cultural integration and alteration, and children becoming responsible parents in the future. On the other hand, the study revealed escalating maltreatment and obstructing children's education as possible negative outcomes for children when involved in child protection meetings. The findings suggest that child participation in case meetings can present an opportunity to break the cultural barriers of silencing children in decision making. Also, to further protect the child, after-case follow-ups and community sensitisation programmes have to be undertaken by practitioners to mitigate the possibilities of maltreatment from parents following children's involvement in the child protection process.

Abstract:Kinship care and child fostering are a common practice in certain parts of Africa. This narrative review seeks to explore and thematically code the contextual circumstances in which children leave their natal homes and are fostered across Africa and the corresponding outcomes for these children. It draws on case studies from Cameroon, the Democratic Republic of the Congo, Ethiopia, Kenya, and Namibia and other countries across the region to illustrate the diversity and cultural importance of kinship care and child fostering. These countries were selected based on their inclusion in the Thrive by Five International Program, a child rearing program promoting social, emotional, and cognitive development of children from birth to age five. The importance of kinship care and child fostering is also reinforced by outcomes from codesign workshops conducted for the Thrive by Five International Program in which parents, caregivers, and subject matter experts discussed their perspectives on child rearing practices and the challenges faced by caregivers in their home countries. The paper highlights the need to support kinship and foster caregivers in Africa with culturally adapted and place‐based child rearing programs to help ensure fostered children reach their full developmental potential.

Abstract:Abstract The objective of this research was to conduct a systematic review of systematic reviews related to Article 12 of the UN Convention on the Rights of the Child (UNCRC) as it relates to children and young people involved with child welfare agencies. This systematic review sought to comply with the guidance from the JBI Manual for Evidence Synthesis on umbrella reviews. Fourteen databases were searched using predefined terms. Six hundred seventy-four original hits were retrieved for title and abstract searching after independent searching by the authors. Of those, fourteen were included for full independent reads and all fourteen were selected after discussion. Each systematic review was appraised using an eleven-point quality checklist from JBI. A thematic review was conducted to ascertain the themes across all systematic reviews. Three themes emerged (i) children’s voice is not taken seriously; (ii) relationships are an important determining factor in (un)successful participation; and (iii) the context of participation is important. Our conclusion is that despite mandated UNCRC requirements to involve children and young people within the child protection system, the possibilities for children and young people to express their views remain restricted.

Abstract:One of the most frequently cited principles in the 1989 United Nations Convention on the Rights of the Child is Article 12. This article provides a critical analysis of the challenges that child protection social work faces when implementing Article 12 in social work decision-making whilst simultaneously keeping children safe. The article begins with an outline of the general reasons for involving children in decisions that affect them but argues that despite being beneficial, implementing Article 12 has proved to be problematic due to theoretical, practical and ethical challenges within social work which will be examined. The article continues by arguing that it is possible to overcome these obstacles using Lundy’s model of conceptualising Article 12 as a real-world tool that offers practical solutions to help social work/workers overcome rather than avoid the identified challenges. It is intended that these suggestions will help empower social work/workers to discharge their legal obligation to enable children to be heard in decisions that affect them. The article concludes by arguing for a more empowering approach to children’s involvement in social work decision-making with some reflections on the future of Article 12 within the social work paradigm.

Abstract:Abstract This article provides a philosophical analysis of a putative right of the child to have their expressed views considered in matters that affect them. Article 12 of the United Nations Convention on the Rights of the Child 1989 is an influential and interesting statement of that right. The article shows that the child’s ‘right to a voice’ is complex. Its complexity lies in the problem of contrasting an adult’s normative power of choice with a child’s weighted views, in the various senses in which we might consider the child’s views, and in the questions of how to weight those views and how their weighting makes a practical difference in coming to a decision. In so doing we criticise other accounts that simply regard a child’s views as having consultative value. We also make better sense of how we might weight a child’s views. The philosophical issues addressed in the article carry implications for how we might understand Article 12 that are not satisfactorily identified and addressed in the voluminous literature on Article 12 within childhood studies. These issues also have implications for how we might understand the distinction between adults and children in respect of powers of personal choice. We conclude by emphasising the importance and value of the right that Article 12 seeks to formally identify.

Abstract:Abstract The UN Committee on the Rights of the Child has published its much-awaited General Comment No. 25 on children’s rights in the digital environment in 2021. Much of the conversations since its adoption have centred on how General Comment No. 25 influences State behaviours in the western world or globally. Little attention has been given as to what General Comment No. 25 means for children’s right to privacy in Africa. This article seeks to explore the role of General Comment No. 25 in clarifying States’ obligations in respect of children’s rights to privacy and data protection in the digital era on the African continent. In doing so, this article first contextualises General Comment No. 25 in the broader context of the United Nations human rights system and analyses its recommendations on children’s right to privacy. Second, the article examines children’s right to privacy in Africa and analyses the specific features of the African human rights system that influence the understanding of this right. Finally, the article illuminates certain child-specific privacy and data protection measures that are being or have been included or discussed in the law-making processes and policy debates in a selection of African countries and links them to both General Comment No. 25 and the socio-cultural context of the continent.

Abstract:Abstract In the European context, an understanding that States are responsible for an effective child protection system is well established. Further, all 47 members of the CoE have adopted the European Convention for the Protection of Human Rights and Fundamental Freedoms, and all European countries have ratified the UN Convention on the Rights of the Child (CRC). Thus, States have come to understand their responsibility in terms of the child’s right to protection. The aim of this article is to explicate core elements of an effective child protection system within a child’s rights framework. This aim is accomplished by highlighting and providing analysis of the principles set forth in the CRC and further elaborated in General Comment No. 13 (2011) and by the UN Children’s Fund (UNICEF), the main components of policies and other relevant documents of the European Union (EU) and the Council of Europe (CoE), and caselaw from the European Court of Human Rights (ECrtHR) and then presenting recommendations for an effective State-run child protection system.

Abstract:The United Nations Convention on the Rights of the Child asserts that all children have the right to protection from abuse and exploitation. In Aotearoa New Zealand, the prevalence of child maltreatment requires vigilant action from oral health practitioners (OHPs), who are often among the first in the position to recognise signs of abuse and neglect due to their frequent interactions with children in dental settings. The Dental Council of New Zealand sets professional requirements, highlighting practitioners' roles in responding to potential signs of maltreatment. Multiple statutes, including the Oranga Tamariki Act 1989 and the Family Violence Act 2018, govern OHPs' responses. Despite this, there is a notable gap in OHPs' confidence and understanding of their child protection roles, underlining the need for clear guidance on the legal and professional requirements that inform their responsibilities. This paper critically examines the professional responsibilities and policies governing OHPs in Aotearoa New Zealand regarding child protection responses. It also proposes the development of equity-focused guidelines, that are informed by Te Tiriti o Waitangi, emphasising culturally responsive practices, collaborations with Māori health providers and clear protocols for child protection responses.

Abstract:At present, children's rights are subject to special protection and defence. However, it was not always so. Children's constitutional rights have not kept pace with world constitutionalism. An analysis of the constitutional traditions of different states shows that the consolidation of children's rights has undergone a long period of legal consolidation and the most important place in this process is occupied by the Convention on the Rights of the Child of 1989, which approved the recognition of children's rights and their inclusion in the constitutional texts of all new Constitutions of states.

Abstract:Forty years after the adoption of the African Charter on Human and Peoples' Rights, the African architecture for the promotion and protection of human rights in Africa has been enriched both at the normative and institutional levels. This enrichment has led in legal analyses both to the affirmation of the existence of an 'African human rights system', on the one hand and, on the other, to the criticism of an unnecessarily complex and not always efficient mechanism. After highlighting the specific logic of the emerging African system, this article indicates the avenues for institutional and methodological reform that should lead to the construction of a truly coherent, effective and efficient African human rights system.

Abstract:This article aims to identify the nature of the interpretation of children’s rights in China. More specifically, it seeks to increase the understanding of the characteristics of the national perspective on children’s rights by examining and analysing the key issues relevant to the Chinese legislation. Using the concept of legal culture, the article offers a hermeneutic analysis of the Law of the People’s Republic of China on the Protection of Minors, in which the Chinese view of the rights of the child is explained in the light of a cultural background. The analysis shows that the Chinese view of the rights of the child is culturally coloured. In particular, the influence of the Confucian conception of family and the corresponding paternalistic social theory can be identified.
