Abstract:The article focuses on the protection of children’s rights in international humanitarian law. All over the world, thousands of children are exposed to the dangers of armed conflict. Children are recruited into the civil militia, ranks of the state army, and other military formations. Many children are abducted from schools, streets, and their homes. Some «voluntarily» join the ranks of military formations because they have no alternative: the reason for this is discrimination, numerous restrictions, poverty and other factors. Specialists in legal issues emphasize the need to prohibit the involvement and use of children, that is, persons who have not reached the age of 18, in armed conflicts. Thus, International Humanitarian Law prohibits the involvement and participation of children under the age of 15 in military operations, whether internal or international conflict. Despite this, about 200,000 child soldiers are involved in more than 20 military conflicts around the world. Hundreds of thousands of children became witnesses and participants of hostilities in Ukraine. This vulnerable group is easy to manipulate due to age-related psychological characteristics.

Abstract:The relevance of the work is determined by the need to improve the protection of children’s rights as the most vulnerable category of the population during the military conflict. The study aims to analyse the existing international mechanisms for the protection of children’s rights during the armed conflict and their effectiveness using the case of Ukraine. The work employed a doctrinal approach, the method of comparative law, a statistical method, and a content analysis. The research established that at the international level, there is an extensive system of legal documents and relationships between countries and international organisations aimed at protecting children’s rights during military conflict, but this system cannot provide the expected results. Using the case of Ukraine, it was proved that children’s rights are regularly violated in the war with Russia: 512 children were killed, and 1,158 were injured as of December 14, 2023. In Ukraine, numerous measures are taken to protect the children’s rights during the armed conflict. International cooperation plays an important role, but protective mechanisms still need significant improvement. The research results are useful in improving government measures related to protecting children’s rights in armed conflict.

Abstract:International law has a vital role in securing more excellent protection for refugee children. There are 82.4 million people fleeing war, violence, persecution, and human rights violations in 2020 globally, 42% of refugees are children under the age of 18. Therefore this study raised the question of what international conventions govern child refugees. This research uses normative research.The results found that the 1951 refugee convention and the 1967 protocol are international arrangements regulating refugee children. Simultaneously, the Convention on the right of Children (CRC) also offers more detailed and comprehensive legal guidelines on child care, including refugee children. Those two conventions have contributed to firm legal protection for child refugees, but there is also a weakness when a country only ratifies one of them. Thus, for legal certainty, a new legal instrument in the form of a convention on the rights of child refugees is needed to fulfill the rights of child refugees properly. Abstract:This article provides an understanding of the relevance and importance of the principles of human rights and the UN Convention on the Rights of the Child. The article pays special attention to the importance of observing children's rights and encouraging advocacy activities of public and children's organizations regarding the protection of children's rights. In the presented study, the author analyzes the articles of the Convention and considers them as social rights (the right to life and development, health care and access to medical care, the right to education, family life, family reunification, the right to assistance in the maximum possible social integration for disabled children, as well as the right to support parents so that they can protect the rights of their children), economic rights (the right to decent living conditions, to social security, to protection from economic exploitation), cultural rights (the right to respect for language, culture and religion, for the abolition of traditional practices that may harm the well-being of the child), protective rights (the right to protect the interests of the child, protection from physical and sexual violence and exploitation, protection from participation in military conflicts, protection from abuse rights and humiliation), civil and political rights (the right to be heard and taken seriously, the right to freedom from discrimination in the exercise of rights, the right to freedom of religion and belief, the right to privacy, to information, to respect for physical and personal integrity and freedom from all forms of violence, torture or other cruel, inhuman, degrading treatment, the right to respect for the order of detention and criminal judiciary). It is emphasized that the mentioned international legal act plays an important fundamental role in the development of social consciousness and the practice of protecting children's rights and freedoms. It provides the legal basis for the necessary protection of persons under the age of 18.

Abstract:The plight of refugees is currently one of the concerning global human rights issues. The refugee population is largely comprised of women and children who become displaced during armed conflicts; this is because the majority of persons killed or who become victims of forced disappearance are men. Forcibly displaced children face direct physical threats, as well as a variety of health-related problems. Although forcibly displaced children generally include those who are not refugees, this contribution is only concerned with refugee children. Refugee children are vulnerable to different types of abuse and exploitation, and often become the target of discrimination, sexual exploitation and social marginalisation in the refugee transit camps and countries of exile. Although the Convention on the Rights of Child, 1989 was adopted to protect children’s rights worldwide, the true impact of these provisions remains uncertain. This contribution examines the extent to which the adherence to the Convention on the Rights of the Child is promoted in Africa. This study compares the situation in South Africa, Tanzania and Zambia to pinpoint the legal and practical challenges that face refugee children in those countries. The contribution concludes with recommended solutions for effectively protecting and promoting refugee children’s rights in Africa.

Yet, among the 41,000 references in the Library's collections, only a handful of recent publications focus on how this protection applies to persons with disabilities. In this article, two ICRC reference librarians take stock of this gap in their collections and consider its implications.

Abstract:The International humanitarian law, through a set of international conventions, protects prisoners of war from any violation orinfringement of human rights during their captivity. The status of prisoners of war is only applicable in international armed conflicts.After The Hague Convention had failed to identify the categories of fighters who would benefit from their privileges as prisoners of war in World War II, the Third and Fourth Geneva Conventions and their protocols were established to justify the inclusion of broader categories of combatants. Descriptive and analytical approaches are used in the study reported in this article to identify the category of people regarded as prisoners of war. by examining international treaties and agreements in relation to the definition of a prisoner of war before characterising the individuals who fulfil the criteria of “prisoner of war” under these treaties. Moreover, it explains the legal mechanisms necessary to ensure that the parties involved in international conflicts comply with the international conventions on prisoners of war. This article concludes that the prisoners of war are often members of the military forces of one of the belligerents who fall into the hands of the opposing party and other types of people who possess the right to the status of prisoners of war or can be treated as prisoners of war following the Third Geneva Convention of 1949. In contrast, traitors, deserters and mercenaries are not considered the prisoners of war. If they commit a war crime, they can be prosecuted by the internal law of the Detaining Power. On the other hand, the overlapping definitions of the prisoners of war can create confusion in combatant interactions during the armed conflict, hence increases violations. Consequently, states must take practical steps to prevent any expected violations against the prisoners of war, for instance enacting national laws to ensure international treaties compliance and raise the awareness of international law among leaders and officials during armed conflicts to limit the violence against combatants.

Abstract:The article is devoted to the study of violations of children’s rights by the Russian Federation during the armed aggression against Ukraine. The article analyzes the international documents on child protection, defines the concept of “child” in the understanding of international institutions. It was found that the special status of children and the need for their legal protection is declared in the Universal Declaration of Human Rights, the UN Convention on the Rights of the Child. The international documents that provide for the protection of children’s rights during military aggression have been established, in particular, it has been determined that the Russian Federation systematically violates the norms of the UN Convention on the Rights of the Child, the Geneva Convention and the Hague Convention. Violations of the right to life and protection from torture, the right to security, personal integrity and dignity, the right to protection from sexual violence, the right to safe living and healthy development, the right to property and housing, the right to education and other children’s rights. Emphasis was placed on the need for preventive activities to prevent further violations of children’s rights, as well as the importance of strengthening the state’s evacuation mechanisms, agreements on green corridors with Russia and its military at various levels. The Rome Statute is analyzed for signs that may indicate a possible qualification of the aggressive actions of the Russian Federation. It has been established that the actions of Russian servicemen can be qualified as war crimes, namely the intentional commission of acts that expose the civilian population to starvation as a means of waging war by depriving it of its necessities for survival, including intentional obstruction of assistance, as provided for in the Geneva Conventions. Emphasis is placed on the importance of teaching children the rules of conduct in shelters, in dangerous places, during air raids. It is recommended that children who have already fallen victim to the occupiers be provided with qualified medical and psychological services.

Abstract:The objective of this paper is to examine the specific provisions, within the framework of International Humanitarian Law (IHL), that protect the human right to food of the civilian population and to observe to what extent the protection of access to food is an issue taken into account by IHL during the development of an armed conflict. Answering these questions requires a detailed analysis of this branch of international law, in order to identify the specific rules of IHL that aim, directly or indirectly, to ensure that civilians do not see denied their access to food during the armed conflict, whether international or non-international. In many armed conflicts, a greater number of civilians die from food deprivation than as a direct result of hostilities. In this sense, the Statute of the International Criminal Court criminalizes those acts that, during the armed conflict, violate IHL prohibitions related to food issues, thus we will also mention them, with the aim of clarifying the possible individual criminal responsibility attributed to those who carry out such acts. The scientific method that has been used in this work is the legal-sociological method, insofar as it is the one that we consider most appropriate for the multidisciplinary approach, always from the legal point of view, regarding the understanding of the rules, the lack of them, their effectiveness, their rationale, etc. This method is based on the idea that law cannot be studied as an isolated domain but must be analysed as part of social reality. The elaboration of this work, with a multidisciplinary object, has also required the use of several methodological techniques, such as social and legal analysis, legal deduction and induction, description and interdisciplinarity.

Abstract:With the evolution and development of jus in bello, conflicts of both internal and international character have given due consideration to limit human casualties and minimize suffering. Post-World War trials in Nuremberg and Tokyo played a crucial role in influencing modern International Criminal Law. The international community soon realized the necessity to draft various international legal documents and establish the International Criminal Court to prosecute individuals for various categories of crimes including War Crimes. Article 8 of the Rome Statute has classified acts of destruction of the natural environment and cultural property within the ambit of the definition of War Crime. However, with a higher threshold required to prove the crime of destruction of the natural environment and a human rights approach taken in cases of destruction of cultural property, both areas seem to need much exploration and research. This paper scrutinizes the development of laws of war and dives deep into the jurisprudence laid down in various decisions of the ICC to protect these civilian objects during armed conflict. It further elucidates the lacunas in the law and explains how they may lose their protection guaranteed by humanitarian law and can be the target of attack if these civilian objects are used to achieve a military advantage. Based on the elucidation of various primary sources like legislations and case laws along with secondary sources like legal textbooks and commentaries, law review articles, and legal encyclopedias, the paper generated is descriptive with a slight element of critical analysis of the international legal framework.

Abstract:The relevance of the study is due to the urgent need to address the critical state of children’s rights in the context of military aggression against Ukraine, which requires immediate measures to strengthen their protection. The main purpose of this study is to examine the concept of child security as an integral part of national security. Methodologically, the study is based on a critical analysis of scientific sources and the international and Ukrainian legal framework for the protection of children’s rights in general and in armed conflict in particular. The study also analysed relevant statistics. The results of the study highlight the state of child rights protection in Ukraine in the context of Russia’s full-scale invasion. The state of national legislation in the field of child protection and its compliance with international standards are examined, and ways to improve the Ukrainian legal framework are proposed. The urgency of expanding international cooperation to restore the psychological and moral well-being of children is substantiated. The author emphasizes the need to increase funding for organizations involved in supporting and protecting children’s rights, recognizing that children represent the future of the state. The author emphasizes the role of juvenile justice bodies in the implementation of the state’s domestic policy, which is an integral part of national security, is guided by international and national legal norms and is aimed at guaranteeing and protecting the rights and freedoms of children. Long-term perspective goals for state bodies are formulated. By addressing a previously unexplored area, the study improves understanding of the important link between child security and national security. In practice, the findings offer valuable insights for policymakers and stakeholders in protecting the rights and well-being of children, who are among the most vulnerable citizens in times of armed conflict.

Abstract:This paper considers the efforts of United Nations and international agencies to address the threats to Palestinian children arising from Israeli occupation. It contains an account of the reasons why agencies have failed, over many years, to prevent systematic violations by the Israeli authorities and settlers. The discussion is organised around two inter-related domains: institutional and political. The paper argues that, in the occupied Palestinian territory (oPt), limitations to the ways in which child protection has been conceptualised and pursued in practice are abundantly evident. Nevertheless, political pressure by Western donor governments serves to constrain an approach to child protection that is more preventative in nature, that addresses more explicitly Israeli violations of international law, and that reflects the experience and aspirations of Palestinian children themselves. Ultimately, therefore, the failure to protect Palestinian children must be seen not only as a result of humanitarian miscalculation but also as a consequence of political strategy.
