The Adversarialness and the Cooperation in Judicial Process

Abstract:The traditional criminal litigation theory,with the presumption of innocence and procedural justice as its characteristics,is based on the confrontation between the state and the accused in the action. But when the accused makes confessions,this basis for the adversarial justice disappears,so it becomes possible for the state and the accused to cooperate in the litigation.Under this condition,the prosecutors and the accused can cooperate through negotiation and compromise,which is characterized with"negoti- ated public cooperation";and the victim and the accused can negotiate to reach the agreement to recon- cile,which belongs to the"mode of private cooperation".In contrast to the mode of adversarial justice, the cooperative justice has already come into being with an initial independent theoretical framework, which covers the interest view of pragmatism,the judicial justice view based on the litigation coopera- tion,and the third kind legal value view in addition to the substantial justice and procedure justice.
