On Prosecution's Benefit and Administrative Public Interest Litigation

Abstract:The prosecution's benefit refers to the necessity to imply a proceeding to provide a party with equity relief.Its passive effects lie in that it restricts the accuser's indiscriminate prosecution,eliminates the accuser's unnecessary contestation and avoids waste of judicial resources.Its active effect shows itself in facilitating the formation of rights and benefits without precise validation by the substantive law.Thus,the extreme agreement between the prosecution's benefit's active effects and the administrative law's value seek under the conditions of modern service and administration provides foundation for the formation of administrative public interest litigation. Actually,it can also effectively prevent indiscriminate prosecutions in administrative public interest litigation to measure and judge the plaintiff by prosecution's benefit.
