Abstract:Even if the administrative litigation system is not perfect, it is still a strategy selected in the system, by administrative counterparts struggling for their rights. In front of the administrative counterparts who struggle their rights, the difficulties of agency managing social affair have become increasingly prominent. The court, hardly guaranteed the independence in the litigation relationship, often trapped in a kind of embarrassing situations where it cannot help itself. This issue requires us to reflect on the administrative litigation system under the concept of people-oriented idea, so that a good way solving the problem can be found.

Abstract:As an independent request in administrative litigation,concurrently filing a request for examining the legality of regulatory documents should have four elements as the subj ect,the obj ect,the content and the time limit of the request.Courts examine the legality but do not relate to the legitimacy of regulatory documents.Examination of legality includes examining the subj ect (administrative power)legality,the procedure legality,and the content legality.As to whether the contents are legal or not,it does not relate to the examination of facts.If one regulatory document is found illegal,it is only within the very case inapplicable.

Abstract:"Administrative Litigation Law" endows people's courts with judicial review of consulting rules when hearing administrative cases. The "refusal to apply rules" in No. 5 guiding case is regarded as the transformation from the doctrine of individual refusal to apply rules to that of universal refusal. That is to say, courts have been authorized to declare rules void. In other words, the case expended the judicial review. According to the hierarchy of legal force established by "Legislation Law", courts should determine first whether the law of lower level contradicts the law of higher level before refusing to apply rules. The standards to determine contradiction are as follows. In the relationship between rights and obligations, contradiction occurs when rights laid down in the law of higher level are restricted or deprived by the law of lower level, and when obligations laid down in the law of higher level are expanded or added by the law of lower level. In the relationship between powers and duties, contradiction occurs when powers laid down in the law of higher level are expanded or added by the law of lower level, and when duties laid down in the law of higher level are exempted by the law of lower level.

Abstract:"Non-performance"of"Administrative Procedure Law"Article 54,paragraph 3 means the executive authorities in a negative way without any intention,and"no answer";and"delayed discharge"is a situation that the statutory or administrative organ do not end the administrative procedures within a legal or reasonable period of time.In the way of judgment to perform statutory duty,the"Administrative Procedure Law"only contains"procedural judge"in content,however it based on philosophy of administrative relief for the administrative counterpart to provide economic,effective.When"the Administrative Procedure Law"is revised in the future,it should recognize the"substantive judgment"legitimacy of judgments to perform duties as an exemption."Administrative omission"does not of course violate administrative law;therefore it is different from"non - performance statutory duties."To the"refusal to perform"administrative act,the Court should annul and redo the judgment.In order to reduce the possible"tired litigation"of administrative counterpart, the court can add certain restrictive"instructions"for administrative organ in redo judgment.It is helpful that pay attention to the situations like"refusal to perform"for the Court to fulfill its statutory duty to judge correctly.

Abstract:Dispute solution is a legislative value transformed from civil litigation into the laws applying to actions against administrative agencies’ decisions, which aims at increasing the ability to solve disputes through actions against administration. However, actions from executive decisions have their own unique nature that may intensify the relationship with supervision of power, another feature inherent in the actions from administrative decisions. By way of easing the tension between dispute solution and power supervision, we can see how far the laws can go in performing the function of dispute solution and can demarcate the legitimacy of the compromise in the actions from administrative decisions so as to further ensure the protection of civil rights.

Abstract:The Administrative Litigation Law of China 1989 paints a rosy picture in which the individual and the government face each other in court, both submitting to the judgment of the law. However, in reality, many administrative cases do not conclude with judicial rulings but largely with withdrawals by plaintiffs (varying between 30-57%). In recent years, coordination and settlement in administrative litigations are even advocated in the official directives.This paper employs national statistical data, articles and reports written by judges to demonstrate that in most situations, withdrawals in administrative cases have not only denied individual plaintiffs the opportunity to protect their legal rights through litigation, but also rendered illusory any potential contribution that litigations might have towards the rule of law. The large number of withdrawals indicates the degree of difficulty that the institution of administrative litigation faces. Efforts made by the Supreme People's Court to enhance the number of administrative cases or reduce the rate of withdrawal have failed to reverse the general pattern. The preference for coordination and settlement that courts at all levels have expressed in administrative litigation may be partly motivated by the prevailing judicial philosophy, but it is believed to be primarily a collective compromise that courts have made in face of challenging conditions.The paper indicates that the institution of administrative litigation, embedded in the contemporary political and social structure of China, cannot be a means for achieving constitutional governance in China, and its impact on social change is severely limited. To eliminate the obstacles to administrative litigation, the immediate priority should be the promotion of judicial independence and authority. In the long term, the reform depends on the growth of civil society and the perfection of democratic politics.

Abstract:The structure of administrative litigation is different from that of criminal litigation and civil litigation. The fundamental value of administrative litigation is not only to protect human rights, but also to keep the separation of powers. That is to say, on the one hand, administrative litigation focuses on the judicial control on the executive power. One the other hand, it prevents the judicial power from trespassing the executive power. In conclusion, it is the problem of the intensity of judicial review. Administrative litigation law should attach importance to the difference of fact issue and law issue, and correspondingly establish a system placing different intensity of judicial review according to different issues.

Abstract:The formulation of Administrative Procedure Law of the People's Republic of China(hereinafter referred to as The Administrative Procedure Law) was enforced more than 20 years ago,new situations and new problems have been constantly arising so that its adaptation shall be an issue which we must consider and solve.As to the legal reform,fruitful exchange of views shall be taken fully between the practitioners and the theorists,and there is no exception with the revising of The Administrative Procedure Law.In order to sort out the focus or difficult issues involved in the process of its amending,a systematic study shall be conducted upon the following factors including the confirmation of the public value of the administrative proceedings,the evaluation and analysis of the full use of existing resources,the necessity of its amending,the expanding of its scope of accepting cases,the realization of litigation types,the set of the administrative public interest litigation,the improvement of the jurisdiction of the trial level system,the innovation and integration of the litigation procedures,the positioning of the judicial interpretation,etc.,all of which shall be of great significance and great value to help advance the modification of The Administrative Procedure Law smoothly.

Abstract:Many structural defects and deep-seated contradictions of China's administrative procedure law has increasingly been exposed.Since these defects can not be completely solved only by judicial interpretation,it has become an urgent problem to revise the law.The RUC-version of expert recommended draft,which has been formally submitted to authoritive legal institutions,holds that the legislative spirit and the basic framework of current administrative procedure law is still viable,but part of it can not meet the requirement of the development of the rule of law in adminsitration and need to be modified.Therefore,the RUC-version of expert recommended draft proposed a series of specific suggestions.The main innovative high lights include:(1) adjusting the legislative purposes of the administrative procedure law;(2)adding the principle of final judicial adjudication;(3)using "administrative dispute" to alternate "specific administrative actions" as the basic standard of the scope of accepting cases and right of action so as to expand the scope of protection;(4)proposing the reform scheme of current administrative judicial system;(5)systematically designing the designated-outside jurisdiction system;(6)admitting the electronic-data evidence as a new type of evidence;(7)establishing the principle of suspending the execution of the sued administrative act;(8)adding mediation system and simple procedure;(9)systematically designing the system of commonweal administrative suit;(10)formalizing and strengthen the judicial suggestion system;(11)establishing special reserve system of indemnity(compensation) and system of payment order by courts;(12)adding measures of enforcement and enhanced the strength of enforcement.

Abstract:The legislative purpose of administrative reconsideration determines the basic principles of Administrative Reconsideration Law.All the concrete rules of administrative reconsideration also derive from it.From Regulation on Administrative Reconsideration(1990) to Administrative Reconsideration Law(1999) and Regulation on the Implementation of the Administrative Reconsideration Law(2007),the relationship between administrative reconsideration and administrative litigation changes accordingly.The former is not dependent on the latter any longer.They are now independent of each other.Furthermore,the legislative purpose of administrative reconsideration has evolved from supervision to settling administrative disputes.This evolution has also had an impact on concrete institution of administrative reconsideration.The legislative purpose is composite of multiple levels.In different cases,we decide which the first priority is.Settling administrative disputes is not the legislative purpose of administrative reconsideration,but an approach to realizing it.

Abstract:In the early construction of Chinese administrative law, the scholars were struggling for the legalization of administration. After the issue of Administrative Litigation Law in 1989, the goal of administrative law turned to structure and control of administrative power. Recently it is developing into administrative law doctrine, which focuses on administrative statutory interpretation based on the real legal order, and the essential element of legal method. From now on, we should promote the reform of administrative law system, which should be carried out under the Constitution, with the achievement of administrative goal as the focus. As for the general principle of administrative law, we should explore the meaning of efficiency principle. We should explore the law of administrative organization to construct the" mission-organization " paradigm in administrative organization law. We should focus on informal administrative action and choose the proper form of administrative action to realize administrative task. We should push the reform of administrative procedure law and pay attention to the simplification of administrative procedure. In the future, we should carry out detailed study on special area of administrative law, to foster the multi-learning between general administrative law theory and administrative law in special area and to enhance the systematization level of administrative law theory in China.
