Abstract:Even if the administrative litigation system is not perfect, it is still a strategy selected in the system, by administrative counterparts struggling for their rights. The court, hardly guaranteed the independence in the litigation relationship, often trapped in a kind of embarrassing situations where it cannot help itself. Abstract:"Non-performance"of"Administrative Procedure Law"Article 54,paragraph 3 means the executive authorities in a negative way without any intention,and"no answer";and"delayed discharge"is a situation that the statutory or administrative organ do not end the administrative procedures within a legal or reasonable period of time.In the way of judgment to perform statutory duty,the"Administrative Procedure Law"only contains"procedural judge"in content,however it based on philosophy of administrative relief for the administrative counterpart to provide economic,effective.When"the Administrative Procedure Law"is revised in the future,it should recognize the"substantive judgment"legitimacy of judgments to perform duties as an exemption."Administrative omission"does not of course violate administrative law;therefore it is different from"non - performance statutory duties."To the"refusal to perform"administrative act,the Court should annul and redo the judgment.In order to reduce the possible"tired litigation"of administrative counterpart, the court can add certain restrictive"instructions"for administrative organ in redo judgment.It is helpful that pay attention to the situations like"refusal to perform"for the Court to fulfill its statutory duty to judge correctly.

Abstract:As an important link to promote the process of the rules of administrative law,administrative litigation types have not been definite in existing law. Taking the needs of the trialinto consideration,we have to face the following questions: the types of litigation applied to the violation of the legal procedure are too simple; there isn't a standard for distinguishing an objectivelitigation from a reviewing one; the litigation types and the judgment species haven't been linked up. In order to build the system of types of administrative litigation in our country,we can perfect it on the base of drawing on the experiences of foreign countries. In addition,courts have to be required to make particular judgments according to different types of the administrative litigation.

Abstract:As an independent request in administrative litigation,concurrently filing a request for examining the legality of regulatory documents should have four elements as the subj ect,the obj ect,the content and the time limit of the request.Courts examine the legality but do not relate to the legitimacy of regulatory documents.Examination of legality includes examining the subj ect (administrative power)legality,the procedure legality,and the content legality.As to whether the contents are legal or not,it does not relate to the examination of facts.If one regulatory document is found illegal,it is only within the very case inapplicable.

Abstract:"Administrative Litigation Law" endows people's courts with judicial review of consulting rules when hearing administrative cases. The "refusal to apply rules" in No. 5 guiding case is regarded as the transformation from the doctrine of individual refusal to apply rules to that of universal refusal. That is to say, courts have been authorized to declare rules void. In other words, the case expended the judicial review. According to the hierarchy of legal force established by "Legislation Law", courts should determine first whether the law of lower level contradicts the law of higher level before refusing to apply rules. The standards to determine contradiction are as follows. In the relationship between rights and obligations, contradiction occurs when rights laid down in the law of higher level are restricted or deprived by the law of lower level, and when obligations laid down in the law of higher level are expanded or added by the law of lower level. In the relationship between powers and duties, contradiction occurs when powers laid down in the law of higher level are expanded or added by the law of lower level, and when duties laid down in the law of higher level are exempted by the law of lower level.

Abstract:Mediation is inapplicable in administrative procedure,but the reconciliation is not prohibited by Administrative Procedure Law. Administrative discretion is the criterion foundation of reconciliation in administrative procedure. Because of the practical needs,without modifying Administrative Procedure Law,reconciliation in administrative procedure can be valid as a result of legal interpretations of the relative regulation of Civil Procedure Law,which makes it legitimate as a legal basis.

Abstract:Administrative reconsideration can divert part of the administrative disputes,and correct some of the illegal administrative acts,yet due to the limited resolving capacity,administrative reconsideration often causes dispute to move into law suit,or leads to insufficient supervision due to unrealized corrective function. The negative impact from administrative reconsideration on administrative litigation comes both from institutional designing and from other negative factors in practice. To build harmonious relationship between administrative reconsideration and administrative litigation,the positioning of the administrative reconsideration shall take resolution of disputes as its primary goal,and take administrative supervision and right remedy as its secondary goal. In the event when the reconsideration decides to maintain the original specific administrative act,it should take the original organization as the defendant and the reconsideration agency as the third party. Administrative reconsideration shall partially adopted the principle of statement-based hearing procedure,and hold hearing or court trial when the resolution is likely to be negative to the applicant or other persons. Administrative reconsideration committee should be set up as an independent agency.

Abstract:Dispute solution is a legislative value transformed from civil litigation into the laws applying to actions against administrative agencies’ decisions, which aims at increasing the ability to solve disputes through actions against administration. However, actions from executive decisions have their own unique nature that may intensify the relationship with supervision of power, another feature inherent in the actions from administrative decisions. By way of easing the tension between dispute solution and power supervision, we can see how far the laws can go in performing the function of dispute solution and can demarcate the legitimacy of the compromise in the actions from administrative decisions so as to further ensure the protection of civil rights.

Abstract:The distribution of Objective Burden of Proof is a lasting theme disputed in Administrative Procedural Law. In this essay, the writer considers the proper explanation of the 32 article of Administrative Procedural Law concludes that the defendant should bear responsibilities to prove the legality of its specific actions in administrative affairs. However, there have not been sufficient and effective reasons to justify this distribution of Burden of Proof. Therefore, a standard theory on a substantial justice basis is still needed as the fundamental theory of this issue.

Litigations Without a Ruling: the Predicament of Administrative Law in China

Abstract:The Administrative Litigation Law of China 1989 paints a rosy picture in which the individual and the government face each other in court, both submitting to the judgment of the law. However, in reality, many administrative cases do not conclude with judicial rulings but largely with withdrawals by plaintiffs (varying between 30-57%). In recent years, coordination and settlement in administrative litigations are even advocated in the official directives.This paper employs national statistical data, articles and reports written by judges to demonstrate that in most situations, withdrawals in administrative cases have not only denied individual plaintiffs the opportunity to protect their legal rights through litigation, but also rendered illusory any potential contribution that litigations might have towards the rule of law. The large number of withdrawals indicates the degree of difficulty that the institution of administrative litigation faces. Efforts made by the Supreme People's Court to enhance the number of administrative cases or reduce the rate of withdrawal have failed to reverse the general pattern. The preference for coordination and settlement that courts at all levels have expressed in administrative litigation may be partly motivated by the prevailing judicial philosophy, but it is believed to be primarily a collective compromise that courts have made in face of challenging conditions.The paper indicates that the institution of administrative litigation, embedded in the contemporary political and social structure of China, cannot be a means for achieving constitutional governance in China, and its impact on social change is severely limited. To eliminate the obstacles to administrative litigation, the immediate priority should be the promotion of judicial independence and authority. In the long term, the reform depends on the growth of civil society and the perfection of democratic politics.

Abstract:This article explores the pursuit of "Dao" in the overall private society,which is a peculiar topic of the history of Chinese political thought.The discussion mainly examines the plight faced by the pre-Qin liti-gants and underlying causes.Starting from the ideal model in the concept of pre-Qin judicature, "Yu v.Rui",this article analyzed the positive and negative meanings of the lawsuit for the public power;from the positive perspective,being a judicator means the gains of authority and social recognition;while from the negative perspective,the simple emergency of litigation reflects the undermining of social stability and ethical principles.On the basis of that analysis,the reasons underlying the necessity of resolving litigation in an official way and the hopes for no disputes are further probed into.In fact,both phenomena are rooted in the contradictions of public and private,which is actually the most fundamental conflict of values for the litigants in the Chinese legal culture.Litigation involves two sets of public-private,namely coordinating the private by the public method and achieving social justice through the harmonization of the private;hence,the two levels of public of the litigation appear in the forms of "public" in fair decision and social justice.

Abstract:The social credit punishments have various forms that involve public entities and private actors as well,which are embedded in the joint punishment mechanism,and mostly based on non-legislative rules as the direct basis.Regarding the issue of the litigability of the social credit punishments in administrative litigation,it is necessary to remove the shackles of the doctrine of qualified defendants,and use an analysis framework with a combination of formalistic institution approach,substantive function approach and taking into consideration of the structural arrangements of a specific legal system to discern whether the punishment in question is an action of public administration.And then given that the joint punishments usually constitute a multi-stages administrative procedure or multiple administrative actions,there should be more targeted interpretation and application of the doctrines of "action that have no actual impact" "internal action", "procedural action" and "inheritance of illegality of action".
