Abstract:The court plays an important role in resolving social disputes. However, because of the obvious defects in the court's structure nowadays, it can not perform well as expected. Taking the death penalty review process as an example, the power of death penalty review's return lead to the bloated organizations of the Supreme Court, the trial mainly by document as well as by inquiry could not solve the administration of the process or realize the expectation of averting erroneous judgments. Moreover, the centralized reviews brought the problem of centralized appeals and visits. In order to solve these problems, rationalizing the structure of the Supreme Court, constructing the district circuit court and hearing procedure are the reforming approaches of legal realism.

Abstract:Pretrial agreement initially was conceived as a measure for the juveniles who had slight crime.In the post-Enron era,it became a basic way for American justice ministry to handle serious criminal cases made by listed companies.The legal obligation such as paying fines in pretrial agreement is a kind of out-and-out "punishment",which is implemented without conviction or the label of "criminal punishment",so that it is a kind of "punishment without conviction".In the Stein case,the federal court reviewed the constitutionality of pretrial agreement for the first time,and considered that the activity that the procuratorate pressed on the defendant causing KPMG ended the payment of lawyer fee violated the Sixth Amendment to the constitution of the United States.Besides,pretrial agreement had fundamental flaws in the design,so that it also violated the equal and applicable law principles.

Abstract:The fast processing procedure of minor criminal cases is emerged in the context of the criminal policy of tempering justice with mercy; it has a great significance to reshape the criminal judicial justice and efficiency value. The fast processing procedure of minor criminal cases should distinguish the scope of application that is to adapt to the light and light, the heavy and light, non-criminal, non-penalty and non-imprisonment to improve the efficiency of lawsuit. And meanwhile, for the problems in the standards of incrimination and the law enforcement, the prosecutors' discretion and the sanctions methods, the reasonable way both from the theoretical and practical aspects should be recommended to improve the procedure.

Abstract:Institutional reform is the route to bring the justice back on the right track. In the process of the reform,it is necessary both to find out the deep roots of such phenomena as the judicial corruption,the judicial injustice and the justice without authority,and to pay attention to the direct causes which lead to these phenomena; it is necessary both to take the difficulties and possible negative effects of relevant reform measures publicized by the Decision on Major Issues Concerning Comprehensively Deepening Reforms into consideration,and to make thoughtful designs of relevant countermeasures regarding this; it is necessary both to make clear what is the long-term plan,and to explicit what is the pressing matter of the moment. Meanwhile,the most pressing reform task for the reform of criminal justice system is to take powerful control measures to deal with issues of the intervention of the official in the party and in the government,the repayment of the confiscation of property,the overflow of the evaluation index and the low judicial ability.

Abstract:Summary trials experienced in three district courts prove that such a simplified general procedure does not defeat the people's expectation for being time-saving;and it alleviates the burden of caseload to some extent.However,there is still much room for us to increase efficiency while ensuring fairness and impartiality.The more the procedure is simplified,the easier it will be accepted.Furthermore,fairness and impartiality of procedure lies in the voluntary and willingness of the accused and the judge's intent to be informative.

Abstract:The rule of law affects crime, and crime is an important obstacle to business in developing countries. In this paper, we study a criminal judicial reform aimed at increasing the speed of courts. In this reform called Active Case Management (ACM), judges are instructed to take more active control of their cases by organizing pre-trial conferences and setting up deadlines with the overall objective of reducing adjournments; i.e., postponements of hearings to later dates. Importantly, the reform was implemented only in some pilot courts, selected in a plausibly exogenous way. We employ a triple difference analysis, comparing the time to disposition of criminal cases versus civil cases, in treated courts versus control courts, for cases filed before and after the reform. We find an increase in the speed of courts. The quality of legal processes improves. More cases get completed. Crime reduces in the treated areas in the long run. Firms respond by spending less on protection against crime which affects their operations.

The Perfection of Non-penalty Rectification System about Minor Crime in our Country

Abstract:Since the minors are not mature in physiology and intelligence,their outlooks on life and the values not yet formed thoroughly.They should be rectified in the non-penalty measures to their crimes as far as possible.At present our country′s legal rules providing the non-penalty processes for minor crimes are just "Criminal law" 17th article and 37th article.The 37th article looks on "that crimes because they are so slight that they are not deserved the penalties" as" a pocket",all cases within this "pocket" may be given "exemption from punishments ".These two stipulations displayed the altogether eight non-penalty rectification measures.Obviously,this kind of stipulation is too simple and far from the system stratification plane and thus just nominal in practice.In the semantics,the non-penalty rectification system about minor crime should contain four aspects in contents and five aspects in extension.To construct this system needs to determine the basic guiding principles,clear about the applicable objects,formulate exhaustive rectification measures and design normal standards of operation procedure to each of the measures.

Abstract:At present, establishment of diversified Chinese quick transaction mechanism of minor criminal case has become an important project that the judicial organ have to confront due to the reason that the simple procedure set up by Criminal Law of our country is not efficient for transacting the increasing minor criminal cases. Since 2014, Standing Committee of the National People's Congress has authorized the Supreme People's Court and the Supreme People's Procuratorate to launch reform of quick transaction mechanism of minor criminal case in 14 cities like Beijing according to the overall scheme of Central judicial system reform. Since the reform, Courts around have begun to focus on protecting the lawful rights and interests of the criminal suspect and the defendant when they are establishing quick verdict program of minor criminal cases so as to ensure the justice of the case, of which useful experience has been taken. But from the perspective of judicial practice, judicial process of places is not unified because more principled rules of quick transaction mechanism of minor criminal case are launched only by the Supreme People's Court and the Supreme People's Procuratorate. Many problems occur in practice: application and scope are not inconsistent; time is too long in handle procedures before trial, which will influence efficiency; cooperation of public security unit, the inspecting authorities, and courts are not efficient; evidence system of minor criminal cases is not perfect…… These problems have restricted the function of quick transaction mechanism. Therefore, quick transaction mechanism of minor criminal case is to be standardized.

Abstract:Juvenile criminal cases of two years in B Court,A City show the practical problem in criminal penalty for juvenile delinquent,which lies in inadequate implementation of criminal judicial policy for juveniles,the insufficiency of lenient penalty and unbalance of sentencing.The main reason is that it lacks the right of determining sentence and severe regulations in substance and institutional barriers in exercising right of sentencing discretion in procedure.Therefore,it is necessary to perfect mechanism of criminal penalty for juvenile delinquent by perfecting criminal substantive regulations and guarantee mechanism in sentencing procedure to provide legal basis and ensure sentencing justice.

Abstract:Minor crimes can still be handled using the concept of a restorative justice approach. Restorative justice has an implementation method by means of penal mediation or by diversion of criminal acts. Penal mediation is used in handling ordinary crimes, in the sense that it is carried out by adults, while the use of diversion is carried out in cases involving children and is in the Children's Court. The problem in this research is how the punishment system for minor crimes is based on Pancasila justice. The research method uses a constructivist paradigm, with a social legal research approach method, and a descriptive research type. Types and sources of data use secondary materials in the form of primary legal materials, secondary legal materials and tertiary legal materials. Data collection methods use literature and qualitative analysis methods. The results of the research are that the punishment system for minor crimes is not yet fair, legal action is still carried out procedurally. One effort that can be made is a policy approach to resolving minor crimes (Tipiring) through restorative justice; so it is necessary to reconstruct the Regulations on Light Crimes Based on Pancasila Justice, namely in the Criminal Procedure Code (KUHAP), in Article 205 Paragraph 1 and the Republic of Indonesia Prosecutor's Regulation Number 15 of 2020 concerning Termination of Prosecution.

Abstract:Decriminalization and depenalization are among the most important issues in modern criminal law reforms. However, there is still a need for a further study of their justification. Scholars have justified decriminalization in terms of social detriment. This paper forms an attempt to prove that social detriment is not the main reason for decriminalizing conducts in question. The main reason for decriminalization is that the criminal law cannot control such conducts effectively. In addition,some scholars argue that decriminalization and depenalization contradict the theory of retribution, and that we must give up the theory of retribution if we implement decriminalization and depenalization. This paper argues that decriminalization and depenalization do not contradict the theory of retribution,and that the theory of retribution can completely justify decriminalization and depenalization.

Abstract:From the amendment of criminal procedure law in 1996 on,many obvious changes emerged in criminal judicial practice including defense,compulsory measures,method of trial and the implementation of the innocence assumption,which reflected both the advantages and limitations of the amendment to some extent.However,new challenges face the theory of criminal procedure such as guarantee mechanism of the procedure law enforcement,judicial remedy for the right to defense,and formalistic trial proceedings.In addition,conflicts between Chinese legal culture and occidental one should not be ignored though unprompted reform of criminal justice is in process of expandedness.The success in criminal judicial reform shall be acquired by establishing the remedy mechanism for the rights,advancing systematic reform,and transforming the procedural conception regarding criminal lawsuit.

Abstract:Within the past three decades, legal changes have transformed the juvenile court from a nominally rehabilitative social welfare agency into a second-class criminal court for young offenders. The migration of blacks from the rural south to the urban north that began more than three-quarters of a century ago, the structural transformation of cities and the economy over the past quarter of a century, and the current public and political linkages between race and serious youth crime provided the impetus for recent punitive juvenile justice policies. Two competing conceptions of young people - innocence and responsibility - have facilitated the juvenile court's metamorphosis from a welfare into a penal organization as policy makers selectively manipulate these competing social constructs to conduct a form of `criminological triage'. At the `soft end', states have shifted non-criminal status offenders out of the juvenile system into a `hidden system' in the private-sector mental health and chemical dependency industries. At the `hard end', states transfer increasing numbers of youths, disproportionately minority, into the criminal justice system. In the `middle', states' sentencing policies escalate the punishments imposed on those delinquents, again disproportionately minority, who remain in an increasingly criminalized juvenile justice system. These changes in youth sentencing policy reflect both a change in the social construction of adolescence and in strategies of social control. As a result, very little remains of the Progressives' idea of a rehabilitative juvenile court.

Abstract:Within the past three decades, judicial decisions and legal changes have transformed the juvenile court from a nominally rehabilitative social welfare agency into a scaled-down, second-class criminal court that provides young offenders with neither therapy nor justice. The migration of African Americans from the rural South to the urban North that began three-quarters of a century ago, the macrostructural transformation of American cities and the economy over the past quarter of a century, and the current linkages in the popular and political culture between race and serious youth crime provide the impetus for get-tough policies to crack down on juveniles. The procedural and substantive convergence between juvenile and criminal courts has occurred because juvenile courts attempt to combine social welfare and criminal social control in one agency. If states uncouple social welfare from social control, then they can try all of fenders in one integrated criminal justice system. But states must formally recognize youthfulness as a mitigating factor at sentencing. A youth discount—shorter sentences for reduced culpability— provides a practical administrative mechanism to recognize youthfulness as a mitigating factor.
