Abstract:The criminal procedure system of China will be under significant adjustment with the furtherance of the reform of the national supervision system, especially the implementation of recent Supervision Law of the People's Republic of China. The fresh investigative power of supervisory organs will bring about a brand - new mode of"investigation to public prosecution. " Compared with the previous mode, the major features of this new mode are that procuratorial organs shall take the investigation conclusions made by supervisory organs as examination objects and it is very difficult for them to make a decision not to initiate a public prosecution since compulsory measures have already been taken onto the accused. It has a close relationship with the political nature of the supervisory power, the special status of supervisory organs, and the announcement of opening a case in advance. This new mode may have some hidden troubles especially when the"investigation - centered"situation will perhaps be formed, such as the increase of atypical wrongful cases and the weakening of the rights protection of the accused. Some possible ways out of these traps are to urge supervisory organs to follow the criminal - procedure - law - related spirit when duty - related crimes are investigated, to make procuratorial organs capable of exerting legal supervision power of this behavior, and to give full play to lawyers" functions in handling cases of duty - related crimes.
