Abstract:Commemorating Professor Tony Angelo's tireless efforts and multiple achievements in translating legal rules, principles and cultures from abroad, including many from Japan, this article focuses on an ongoing project to translate selected works of a leading Japanese legal sociologist, Professor Takao Tanase. Part 2 locates Tanase's critical "hermeneutical" understanding of law and society, or of facts and norms, within various paradigms in the English-language world of "Japanese Law". These include a first wave of culturalist approaches; a model instead emphasising the institutional barriers to invoking the law in Japan; another model emphasising "elite management"; and a very different "economic analysis" of Japanese law-related behaviour. Tanase's work instead joins an emerging "hybrid paradigm" that takes more seriously new understandings and measures of culture `project. As Tony taught us only too well, interpreting foreign legalese can be hard enough. But the most difficult task often lies in conveying the way it is embedded in a broader socio-legal praxis and discourse abroad. These challenges will not go away even in our globalised world, thereby securing the future for comparative socio-legal scholarship.

Abstract:The Belt and Road has created numerous possibilities for international development in which diversified conflicts could also be observed. This would include commercial disputes related to infrastructure constructions and engineering projects, community quarrels such as cross-border family and labor issues, and even the disharmony regarding official collaborations. This chapter therefore aims to explore promising methods, measures, and policies in handling of potential conflicts in this field of practice. Apart from reviewing existing practice, the chapter will introduce in particular relevant innovation in commercial dispute resolution. The feasibility of adopting the innovation for other types of conflict will also be assessed. Finally, this paper makes an argument that professional bodies in conflict management should be significant to foster policy collaboration across the regions and countries under the Belt and Road.

Abstract:Transfers of rule of law between legal systems have been discussed extensively in academia. Yet, so far, scholarship has predominantly centered around the issue’s socio-political dimensions. The volume departs from these common scholarly paths and assesses rule of law transfers as a legal phenomenon. Its analytical perspective assumes that the process of transferring the rule of law does not only concern a legal concept but also holds a legal dimension itself. Against this backdrop, the volume features eight distinct contributions, introducing and applying the said perspective. They approach the topic from diverse angles, covering a wide range of legal fields, including EU law, public international law, international human rights law, international criminal law, international humanitarian law and international economic law – with each contribution succeeding in highlighting the relevance of “the law behind rule of law transfers”.

Abstract:Once the domain of elitist practitioners and scholars, international cultural law has emerged as the new frontier of international law. The rise of international cultural law as a distinct field of study reflects the Zeitgeist characterised by increased globalisation and the vitality of international law in governing global phenomena. International cultural law has made headlines and attracted the varied interests of academics and policy-makers, museum curators and collectors, human rights activists and investment lawyers, and artists and economists just to mention a few. International cultural law includes extremely diverse components and constitutes a good example of multilevel governance and legal pluralism. The return of cultural artefacts to their legitimate owners, the recovery of underwater cultural heritage, and the protection and promotion of artistic expressions are just some of the issues regulated by such a field of study.The book focusses on the particular area of the restitution of cultural property and dispute settlement mechanisms used in international disputes relating to cultural objects within the larger field of international cultural law. This is an area in which public law aspects (e.g., state succession, international conventions etc.) intermingle with procedural and private law aspects (private property rights, statute of limitations, forum non conveniens to mention but a few). This book addresses the question of ‘who owns culture?’ by examining recent cases and conflicting interests. The approach is mainly legal, but interdisciplinary approaches have been adopted as well.

Abstract:A civilisation cannot exist without culture. It would sound like a truism if it wasn’t for the legal lack of acknowledgment of this fact. Although military and even economic threats justify emergency exemptions to treaty obligations, culture tends to be perceived as less important, along with environmental concerns or social responsibility. Given the significance of cultural heritage, the questions arise about the extent to which the protection of this heritage constitutes a fundamental duty of a host state and whether vague provisions are used as a veil for the mistreatment of foreign investments. By referring to a range of state intervention (normative, administrative and judicial actions) and cultural goods (tangible and intangible, already protected and aspiring to be enlisted), I analyse cases from Poland and South Africa. I try to find the equilibrium between the perception of culture as an object of international investment law, to be weighed against other considerations, and as a constituent factor crucial to a state’s identity and substance.

Abstract:This book presents a new theoretical framework for understanding the regulation of international trade. For this purpose, it analyses a series of integrated studies of relations between the EU, the WTO and China. It consists of three main parts. Part I introduces the basic concepts. It surveys the literature on law and globalisation, introduces the concept of sites of governance and the theory of global legal pluralism and sketches the foundations of global legal pluralism. It shows that each site of governance has both a structural dimension, consisting of institutions, norms and dispute resolution processes, and a relational dimension, comprising its relations with other sites of governance. The totality of sites of governance constitutes a new form of global legal pluralism. Part II analyses global legal pluralism in action in relations between the EU, the WTO and China. It examines the construction of relations between sites, ways in which relations between sites give rise to new legal concepts or transform the character of rules, the tension between regionalism and international integration and the governance of international production networks. It emphasises the reciprocal interaction between the structural features and the relational features of sites. Part III explores new directions in global legal pluralism. It first analyses regional trade agreements as a way of creating new sites of governance, focusing on agreements involving China. Then it considers how to enhance ethical values in international trade regulation. Based on an institutional analysis of relations between the WTO and other sites of governance, it proposes ways in which global legal pluralism can be used to reform the WTO, today the predominant institution in the regulation of international trade, including trade between the EU and China.
