Abstract:Legal realism is a family of theories about the nature of law developed in the first half of the 20th century in the United States and Scandinavia. The essential tenet of legal realism is that all law is made by human beings and is therefore subject to human foibles, frailties and imperfections. It has become quite common today to identify Justice Oliver Wendell Holmes as the main precursor of American Legal Realism. For Chinese criminal justice system, it is a new, helpful and realistic topic. China is a pluralistic society in its transitional period now, and the social conflicts are very serious, which is a big challenge for Chinese criminal justice system. Western legal realists criticize formalism and syllogistic type of trial, look law as a society engine with multiple targets, and pay attention to justice behaviors, disputes resolution and social issues as well. In Chinese circumstance, legal realism does not mean to deny formalism, but mean that we should rationally treat formalism and blend objectivism in it. Moreover, interest balance should be applied in criminal judgments and attentions should be paid to experience summarizing beyond simple deductive reasoning. Legal realism also means that we should focus on turning social justice into reality and constructing a pluralistic disputes resolution mechanism with the litigation system and the alternative one well —connected. Anyway, legal realism is not a panacea for Chinese criminal judicial reform, but can provide a methodological guidance for it, especially for solving extreme social conflicts and disputes. In a word, it will be a very helpful theory for Chinese criminal justice system in transitional period.

Abstract:This book presents a new theoretical framework for understanding the regulation of international trade. For this purpose, it analyses a series of integrated studies of relations between the EU, the WTO and China. It consists of three main parts. Part I introduces the basic concepts. It surveys the literature on law and globalisation, introduces the concept of sites of governance and the theory of global legal pluralism and sketches the foundations of global legal pluralism. It shows that each site of governance has both a structural dimension, consisting of institutions, norms and dispute resolution processes, and a relational dimension, comprising its relations with other sites of governance. The totality of sites of governance constitutes a new form of global legal pluralism. Part II analyses global legal pluralism in action in relations between the EU, the WTO and China. It examines the construction of relations between sites, ways in which relations between sites give rise to new legal concepts or transform the character of rules, the tension between regionalism and international integration and the governance of international production networks. It emphasises the reciprocal interaction between the structural features and the relational features of sites. Part III explores new directions in global legal pluralism. It first analyses regional trade agreements as a way of creating new sites of governance, focusing on agreements involving China. Then it considers how to enhance ethical values in international trade regulation. Based on an institutional analysis of relations between the WTO and other sites of governance, it proposes ways in which global legal pluralism can be used to reform the WTO, today the predominant institution in the regulation of international trade, including trade between the EU and China.

Abstract:Studies on the sources of change in the Chinese legal system are usually based on the statist epistemology, i.e. the will of the state directs and even determines all aspects of change in the legal system. Although this epistemology can partially explain the re-creation of the Chinese legal system during the earlier period of reform and opening up, it fails to provide a comprehensive picture of the present complex situation. Taking as an example the changes in the Chinese legal profession during reform and opening up, this study employs quantitative data and empirical methods to explore the multiple dynamic impacts of the state, the market and society on the Chinese legal system. The study also proposes a theoretical framework of "structural constraints" on legal change. Since reform and opening up, the Chinese legal system has undergone a transition from state dominance to multi-agent interactions between the state, the market, society, and the legal system itself.

Abstract:As law is increasingly involved in politics, economics, culture and environment, law diplomacy is increasingly necessary. Law diplomacy is paralleled with political diplomacy, economic diplomacy, cultural diplomacy and military diplomacy, which refers to diplomatic activities to be based on laws as its content, mechanism and mediation. In law diplomacy, law perceptions and rule of law procedures are carried out, diplomatic issues are transformed into law issues, foreign affairs are handled in law procedures and behaviors, diplomatic disputes are legally solved, diplomatic methodologies are improved, and new scene of diplomatic work appears. Law diplomacy is not only a product of the change of international environment, but also a product of China’s domestic development to a larger extent. Since the turn of the century, China’s law diplomacy, especially China-ASEAN Legal Forum and the Legal Forum of China-Africa Cooperation Forum have developed fast and formed a relatively complete strategic layout of law diplomacy, have undertaken plenty of law diplomatic practices and laid an important foundation for the construction of law-diplomatic theory. Looking forward, China’s law diplomacy should further intensify its mechanization and institutionalization, improve theoretic construction, step up performance in order to make new contribution to promoting the general diplomacy of the nation, and to the building of a harmonious world.

Abstract:Cyberspace, with the rapidly growing network of users and communication technologies, provides venues for myriad social and political interactions. The very technology that enables the development of cyberspace itself also makes detailed and cumulative observation possible. This study aims to investigate cyber discourse in the context of China from the perspective of political and legal integration. Theoretical insight is transformed from viewing cyberspace as a research object to regarding it as a research ontology. To fill in this uncharted domain, this study aims to examine (a) the hidden connotations of the political discourse in cyberspace, (b) the new features of legal regulation in cyberspace, and (c) the relation between political discourse and legal practice. Centering on both political and legal discourse on cyberspace, the findings of this study indicate that there is a dialectical relationship between political discourse and legal practice in cyberspace. With the findings, this study contributes to the discursive construction by extending the discourse studies into cyberspace and integrating the discourse studies with politics and law.

This paper focuses on the legal pluralism in the field of legal English and how to make innovative use of the theory. Abstract:By reviewing lawsuits against Alibaba, this article explores the evolving model of platform governance that expresses and constitutes the historical political economy of China's Internet at large. It outlines the significance of platform immunity in legal cases and conceptualizes the construct as a common carrier of governance registering crossscale, cross-unit, and cross-context concordance and discordance. Beyond the censorship imaginary that has conventionally defined China's Internet governance, the article ultimately reveals a model of fragmented governance: a model that encompasses many moving parts, legal and administrative, authoritarian and mercantile, and across disjointed issue areas from speech to digital trade, from copyright to trademark-a model that sustains platform immunity as a common carrier, keeps alive power struggles among collective interests, makes haphazard institutional tweaking, and repeats regulatory compromises.

Abstract:China has undergone dramatically social, economical and political transitions since the launch of opening and reform policy in1978.In transitional China, local governance has received intensive scholarly interests.Among the studies of urban China, overseas scholars are active and contribute to theorization greatly.The aim of this paper is to review the existing literature on China's changing local governance, focusing on overseas scholars' contributions.The paper involves three aspects, including the general background of transition, theoretical debate on the role of local government, and new directions for further research.Regarding the context of China's changing local governance, this study highlights the triple processes of decentralization, globalization and marketization.Through decentralization, local governments have become active agents with their interests in local economic development.The deepening process of globalization has induced heavy competition for mobile capitals among local governments, leading to governance restructuring.The shift from centrally planned economy to socialist market economy has also exerted impacts on local governance restructuring, due to the emerging of various non-state sectors.For the theoretical debate on the role of local government in economic and urban development, which is essential for understanding the changing of local governance, this study summarizes two major perspectives--strong local state and ineffective state.The author argues that the analysis of local government's role in economic and urban development is affected by four factors.They are government scalars on which the role of local government is examined, political and economic statuses of localities, geographical foundation, theories and approaches adopted for studies.Based on the existing literature, this study highlights two directions for further research--deepening the understanding of China's local governance(intra-jurisdiction) and inter-jurisdiction relationship.Regarding local governance in intra-jurisdiction, further studies should direct attention to stakeholder analysis and interaction among stakeholders.Stakeholders include not only government, but also non-governmental organization, community, media, private sectors, etc.In addition, the governing process, especially the process of coalition building and policy-making, should be investigated for deepening the understanding of changing local governance.

Abstract:The rise of China represents a far-reaching process of international relations in the twentieth century, which should bring about extensive but uncertain ramifications. How China interacts with international legal order—namely, how China takes advantage of international law to facilitate and justify its rise and whether and how international law is relied upon to engage a rising China—has been inviting growing debates among academics and policy circles. A couple of recently eye-catching events, for instance, China-Philippines South China Sea (SCS) arbitration and the China-U.S. trade war, have intensified unease in international society. Abstract:This book examines China’s striving for a constitutional order in the 20th century from comparative, historical, and theoretical perspectives. Through a comprehensive study of six major constitutional reforms experienced by China in the last century, Shiping Hua explores pragmatism, instrumentalism, statism, and favoritism as the key features of the Chinese legal culture. Abstract:EU investment in China has increased dramatically since the early 1990s and is poised to increase further in light of Chinas recent accession to the World Trade Organisation. This book explores and critically appraises the existing legal framework governing EU-China investment relations,particularly EU investment in China. The current legal framework is composed of Chinese law, EU law and applicable international law, but the Chinese law is unsystematic and hard to discover and the EU has acquired only shared external investment competence which is vaguely defined. The applicable international treaties are incomplete, incoherent, or either too general or too specialised. Besides this, the international fora to settle investment disputes are still not readily available. Furthermore while law has played a very important role in decision-making by EU investors, the Chinese legal system is generally perceived as ineffective and lacking in effective enforcement of court and arbitration decisions. What the book demonstrates is that the time is ripe for a new international legal framework for foreign investment in China, and that as EU-China economic and political relations continue to improve, construction of such a framework is not only necessary, but also possible.

Abstract:A series of realistic problems have appeared in the contemporary society in China when the social reforms are carried out.The existence of partition between city and country,the extreme gap between the rich and the poor,and the crisis of stratum identity,all challenge greatly to the growth of the modern law order.Removing the fence between city and country,providing more fluxional opportunities and systematic space;restraining the abuse of social power,strengthening the rising fluxion of civilian;strengthening the sense of stratum identity through the structure reformation and the system changes,all these are the effective means to deal with the conflicts in the society transformation.
