Abstract:In this essay, we describe the overlapping phenomena of new legal hubs (NLHs), international commercial courts, and arbitral courts. We survey their impact on the law and geopolitics of international commercial dispute resolution, identifying key issues these new dispute resolution institutions raise. While the rise of international commercial courts spans authoritarian and liberal states, Western and Asian states, common law and civil law traditions, it also highlights and builds upon regional differences. We question the assumption that the establishment of new courts is always consistent with an increase in the rule of law, particularly in non-democratic states. We close with thoughts about the potential influence and future role of these institutions. Some of the procedural innovations discussed here may lead to shifts in international commercial dispute resolution for years to come, but the question of whether there is sufficient demand for these new institutions lingers.

Abstract:The purpose of this piece is to reflect on the role currently played by mediation in the resolution of international commercial disputes. This objective is both broad and ambitious and the chapter benefits from the fact that this book contains over a dozen contributions from prestigious authors in the mediation sector who adroitly address a broad range of aspects of international commercial mediation. The chapter’s main focus is consequently the outlining and discussing of a specific series of issues that aim to complement the analysis developed by the other contributors in this edited volume.Section II therefore explores the new meaning that some scholars have attached to the widely used acronym ADR (alternative dispute resolution). Considering mediation an important part of the ‘appropriate dispute resolution’ mechanisms available to commercial disputants suggests that a new light is shining through this important sector and the principles that it embraces, such as access to justice. This central idea is developed in Section III, which addresses various highly topical issues in the framework of commercial mediation: the dilemma of compulsory mediation in non-family contexts; the impact of developments in information and communication technology on the mediation milieu; the role of ethics in the contemporary mediation world, and the structure and main objectives of training schemes in international commercial mediation. Section IV concludes the discussion and leads on to the thematic studies of international commercial mediation.

Abstract:This chapter represents an effort to link concepts that appear to be and are commonly placed in distant theoretical areas but belong much closer together in practical terms: the principles of internet governance, and the networked information society converging in rules on one hand; and self-regulation competences required for collaborative and alternative conflict management on the other. They condense the public and the private roles in compatible regulatory models that could match sociability, economics and technologies of the times. It is an essay on competences, public policies that are not preceded by standards and principles that do not seem to have been captured by the laws. The institutionalization strategy on Alternative Dispute Resolution (ADR) and Online Dispute Resolution (ODR) for cross-border consumer redress in the European Union will be the reference to assess regulatory impact and argue for consistency. Legislating ADR and ODR aims at supporting electronic commerce as an essential component of the digital agenda; the flagship initiative that establishes the digital single market according to the European 2020 Strategy. Questions must be raised considering the marked emphasis placed on promoting social changes merely by passing new laws. The importance of understanding that the European Union is not capable of supplanting its members in turning institutional formulas into operational strategies is underlined, as well as a reflection on the need to support the social and economic transformations that have followed the remarkable developments in telecommunications and other digital technologies. Conceiving a European dispute resolution culture, enabled and mediatized by technological solutions is a viable solution to prevent more of the perceived shortcomings of public actions, and a truly innovative ODR systems design, could support the transition. This text invites the integration of concepts, disciplines and practices, respect for principles and their consistent application to solutions that could improve human transactions for a sustainable digital economy where empowered private actors can efficiently contribute to the ongoing collective transformations of the global governance.

Abstract:Abstract This article critically reviews the establishment and operation of the China International Commercial Court (CICC) from an insider’s perspective. It offers a detailed introduction to a few of the innovative measures of the CICC, including the International Commercial Expert Committee, the ‘one-stop’ forum for a dispute settlement mechanism integrating litigation, mediation, and arbitration, more convenient litigation procedures, and the use of advanced technology in dispute resolution. More importantly, it candidly discusses the challenges facing the CICC and makes several recommendations for its improvement towards more professionalism and internationalization.

Abstract:Every transaction has the potential to go wrong and international commercial contracts are not spared this plight. It is when an international commercial contract fails – irrespective of the reasons, that the impact of different legal and cultural backgrounds of the parties come to light. The obvious venue for commercial disputes to be decided is generally understood to be in court (litigation) or before an arbitral tribunal (arbitration). However, there are numerous other alternative dispute mechanisms4 available to parties that are less well known and also deserve consideration; not least because they offer parties methods of resolving the dispute between them in a more time and cost-efficient manner, and with a stronger focus on the commercial interest of the parties. Mediation is one of these mechanisms.This chapter provides an overview of the basic concepts of mediation; how it distinguishes itself from but can also be employed together with other dispute resolution mechanisms such as, in particular, arbitration; the legal framework; and practical guidelines when drafting a mediation agreement in the context of international commercial contracts.

Abstract:This essay, a companion piece to “Discipline and Punish: despatches from the citation manual wars and other (literally) unspeakable stories” [Law's cultural mediations, special edition. 2001. Griffith Law Review 10(2)], undertakes a situated and critical cultural analysis of US law, with particular attention to the law school's insistent “training for hierarchy” and the interrelationship of that training with the bodies and texts that are constitutive of judge-made law in the United States. And who promptly told the student. And who promptly told the student. This essay revisits the early orientation of cultural studies work towards interrogating subject-formation and critically positioning and problematizing the scholarly subject and the various institutions, discourses and practices that produce both her subject position and her critical practice. At the same time it also stages an anti-racist, anti-sexist, and anti-classist engagement with the congeries of mechanisms by which hegemony is inscribed, reproduced, and accorded value by a range of practices to do with disciplinary texts and their production within US legal institutions. Both “semiotic”/“textualist” and “culturalist”, then, in orientation, this essay finds little space for celebration or play, although it alludes in its title, inter alia, to Inventing the Abbots, an artifact of popular US cinema that was at once both a reinscription of the family romance and an exploration of the mutually reinforcing and corrosive effects of class, sexism and secrets/silence. Finally, the essay seeks to explore questions raised by Meaghan Morris and Gayatri Spivak about the possibility or radical transformation through such critical cultural practice and the risks of iteration that is complicity, of submission to and collaboration with disciplinary violence, and of the complex politics of negotiation.

Abstract:International commercial dispute resolution mechanisms are often lauded for the flexibility that they provide, particularly in comparison to courts and tribunals which are oftentimes constrained by rules and regulations. This article will examine the ways in which arbitration, as well as other non-binding forms of alternative dispute resolution (ADR) such as mediation, can leverage their flexibility to facilitate the effective, economic, and expeditious resolution of international disputes. This can be achieved via the adoption of certain (often unburdensome) processes at various stages across the lifetime of a dispute, from the exchanges of case, to adducing evidence, and the finalization of an outcome. To contextualize the analysis, this article will also draw comparisons to the relevant options available in Singapore International Commercial Court (SICC).

Abstract:Recently, the establishment of international commercial courts in some countries has been creating fruitful changes in the dispute resolution industry. The article provides an overview of dispute resolution mechanisms in international commerce, pointing out that arbitration is the most commonly used mechanism while national courts are the least preferred method. However, both methods have characteristics that need to be improved. On that basis, the author introduces the birth of the international commercial court, approaching the research object from definition, and history and analyzing some salient characteristics by examining some typical international commercial courts that have been founded in Singapore, the United Arab Emirates (Dubai) and the UK (London). For some vital features of the international commercial court, the author analyzes them in comparison with those of arbitration and national courts so that readers may assure of the strengths and weaknesses of these three methods. Finally, after considering the number of caseloads heard in international commercial courts and confirming the potential development of this court model, the author comes to a proposal for Vietnam regarding researching, surveying, and building an international commercial court.

Abstract:The article reveals the formal-legal basis for the institutionalisation of international commercial arbitration. It is found that states are still far from a unified understanding of the basic scope of human rights, but they have a clear common vision of the mechanism for protecting the interests of international commerce. Against the background of the economic and innovative successes of the EU and other countries in the world that have made human rights a priority, it would appear that the source of modern transnational trade problems lies precisely in another group of states in which commercial interests dominate human rights. This second type of state nourishes its development at the expense of the innovations of the first type of state, its constructive and passionate representatives. Innovative solutions are formulated by the freest people, whose freedom is legally and organisationally guaranteed, which becomes a source of release for their creative, productive existential energy. Therefore, the contradictions between these two types of entrepreneurs of nations give rise to commercial disputes regarding the path of development, as well as legal conflicts within each of these types of nations regarding the vector of development or decline. Strategically, it is an ontology of modern problems of international commercial disputes. It is emphasised that the institutionalisation of international commercial arbitration is conceived as the creation of legal models for interpretation, determination of cause-effect relations, assessment of all essential circumstances of commercial relations, about which the parties of this type of social interaction have not reached an agreement and are forced to turn to mediators, to whom they entrust jurisdiction over the dispute between them. It was noted that the legal reality of the institutionalisation of international commercial arbitration reflects the path of human development, which at the present stage is marked by crisis. Logical, rational, clear law is in a permanent process of critical evaluation of the synergy of creative, risky, adventurous, pragmatic entrepreneurship. Ideal legal models absorb the constructive activity of entrepreneurship, foreseeing its long-term prospects as positive. At the same time, it is the task of lawyers to reject those types of economic relationships that threaten common humanity. In conclusion, the UN Commission on International Trade Law is the only global body designed to ensure the optimal course of correlation processes between private international law and transnational commercial activity. At the same time, however, this Commission suffers from all the consequences of the UN's dysfunction. This is particularly evident in the UN's inability to prevent wars, famines, environmental disasters, military crimes and other global crises. It is advisable for the states to create a separate organisation in which they can coordinate their legal standards of joint entrepreneurship in the extractive industries, production, trade, finance, as well as the global environmental, national economic and other consequences of commercial projects. This organisation would become a convenient platform for honest parity in the unification of the legal practice of transnational entrepreneurship and the settlement of its disputes, based on the legal customs and traditions of different nations. This would provide a significant impetus for the healthy creation and application of international private law, capable of determining the vector both of global progress and of appropriate transformations in domestic national economic policies.

Abstract:One of the primary challenges for a law lecturer is to take students beyond their own assumptions about the parameters of a subject and provide them with new opportunities for exploration and a broader vision to enhance learning. A significant feature of law as a discipline of study in higher education that has the potential to impact on the curriculum and the way in which it is taught is the academic/vocational divide. Problem-based learning (PBL) activities make classroom settings unpredictable and surprising, and learning to deal with such uncertainty prepares students for one of the most crucial aspects of professional life: the ability to make judgements in a context of uncertainty. This article analyses the integration of PBL within an LLM module on International Commercial Dispute Resolution. The logic of using PBL in this module is to ensure that the more abstract and less engaging aspects of the course are learned in relation to a close involvement with problems that are highly relevant to students’ more concrete ideas of what the course is about and what competence would mean within it. The experience of the students with the PBL activities, captured in reflective narratives and anonymous questionnaires, is also discussed.

Abstract:In the last thirty years, international commercial courts (ICCs) have emerged around the world. ICCs offer adjudication in international commercial disputes. They are not creatures of international law – as their name may suggest – but specialized domestic courts embedded in national legal orders. The rise of ICCs is remarkable in that scholars expected commercial arbitration to gradually displace litigation in the twenty first century. What drives the creation of ICCs? Legal research suggests that ICCs are a manifestation of a new era of assertive unilateralism in global governance. Scholars point to states' geopolitical motives, backlashes against private authority in the form of arbitration, and economic statecraft. Drawing on the New Interdependence Approach, this study argues that most ICCs are the result of policy entrepreneurship of elite law firms in the pursuit of growing the global market for commercial litigation. Depending on the legal-political context, they forge coalitions with domestic judiciaries or political leaders to advance ICC projects. The study highlights deep-rooted changes in the global dispute resolution landscape, the important role of commercial law in International Political Economy (IPE), and points to the mostly overlooked significance of law firms and judiciaries as architects of global economic governance.

'One-Stop' Commercial Dispute Resolution Services: Implications for International Investment Law

Abstract:Many newly-created international commercial courts are supporting integrated commercial dispute resolution services, which blur lines between litigation, arbitration, and mediation services. Such “one-stop” commercial dispute resolution services will affect international arbitration generally and investment arbitration specifically. This chapter examines the likely impact of integrated international dispute resolution services on the investment arbitration regime in three respects: institutionalization, transparency, and enforcement. The chapter reaches the following conclusions.Regarding institutionalization, integrated dispute resolution services likely will contribute to the building momentum for greater institutionalization within the investment arbitration regime.Regarding transparency, integrated dispute resolution services likely will give rise to additional transparency gains within the regime by placing even greater attention on the need for coherent development of law, which requires public access to decision-making.Regarding enforcement, integrated dispute resolution services likely will narrow the existing enforceability gap between arbitral awards, on the one hand, and court judgments and mediated settlement agreements, on the other. A narrower enforceability gap would reduce the significance of one of the key advantages of international arbitration: an unmatched global enforcement regime. The diminished significance of that advantage likely would place additional pressure on the investment arbitration regime to address key vulnerabilities, notably recurrent perceptions of incoherent jurisprudence and arbitrator conflicts of interest.

Abstract:Securing fast, inexpensive, and enforceable redress is vital for the development of international commerce. In a changing international commercial dispute resolution landscape, the combined use of mediation and arbitration has emerged as a dispute resolution approach which offers these benefits. However, to date there has been little agreement on several aspects of the combined use of processes, which the literature often explains by referring to the practitioner’s legal culture, and there is debate as to how appropriate it is for the same neutral to conduct both mediation and arbitration. Identifying the main ways of addressing concerns associated with the same neutral conducting both mediation and arbitration (same neutral (arb)-med-arb), this book examines how effectively these methods achieve the goal of fast, inexpensive, and enforceable dispute resolution, evaluating to what extent the perception and use of the same neutral (arb)-med-arb depends on the practitioner’s legal culture, arguing that this is not a ‘one-size-fits-all’ process. Presenting an empirical study of the combined use of mediation and arbitration in international commercial dispute resolution, this book synthesises existing ways of addressing concerns associated with the same neutral (arb)-med-arb to provide recommendations on how to enhance the use of combinations in the future.

Abstract:Background: The historical determinants of the appearance of international arbitration correspond to the general tendency of the complication of legal relations of highly developed civilisations, where business processes are its drivers. It is expected that a complex transnational business layered on different levels of civilisation is characterised by an increase in the probability of misunderstandings regarding the proper fulfilment of obligations, the resolution of which is referred to as international arbitration, which, by nature, is more effective than national courts. In this regard, within legal doctrine and among legal practitioners, there is an ongoing discourse on strategies to mitigate risks associated with the execution of international arbitration decisions and related issues. Methods: The research employed a methodological toolkit encompassing formal and dialectical logic, a synergistic methodological approach. The primary method within this framework was the synergistic analysis of the transformation of formal-legal sources and the corresponding application practices. Additional methods included historical-legal, comparative-legal, formal-dogmatic methods and contextual analysis. Results and Conclusions: Formal-legal guarantees for the execution of international arbitration decisions represent a system of requirements governing the procedural and actual actions of state- authorised persons (bodies) that ultimately lead to such execution. The basis of such guarantees is the adequacy of the subject to which the method is applied. Firstly, the arbitrators must make the decision. Secondly, this concerns a property (commercial) dispute. Thirdly and fourthly, enforcement of arbitral awards made in the territory of a State other than the State where the recognition and enforcement of such awards are sought and arising out of differences between persons, whether physical or legal. These signs follow from the corresponding specific acts of private international law. The enforceability of an arbitral award depends on the timely and appropriate actions of the parties to the contract. Even during the negotiation of a foreign economic agreement, the result of an audit of the business partner’s reliability in terms of its ability to fulfil its financial and/or other obligations properly should be obtained.

Abstract:addition, this chapter explores other factors, such as the growth of judicial review, particularly when dealing with politically sensitive issues. Another factor addressed here is how the Woolf Reforms have increased the discretion, and hence the power, of judges with the objective of speeding up proceedings and keeping down the costs; albeit the latter has yet to be achieved. The last factor explored is the jurisdictional expansion in the medical law field. She argues that courts have now to deal with ethically sensitive issues where there is a lack of social consensus. Based on the author’s previous research and ad hoc interviews, this chapter provides an interesting insight into judges’ work and their motivations when applying for a judicial position. Finally, Genn boldly poses the question whether the reduction of proceedings and trials, coupled with the diversion of disputes from courts to private ADR providers, is a welcome development or a sign of diminishing confidence in our public courts. The flow of the book of course suggests the second view. Finally, ch 5 concludes by recapitulating and arguing that the civil justice system should not be measured simply in terms of cost efficiency; other values must also be taken into account, such as ensuring enforcement of legal rights and the advance of legal policies that have an impact on the development of society. Overall, this is a brief but thought-provoking monograph that contributes significantly to the scholarly debate. Its lucid language and relatively short length allows for the maintenance of a focused and robust argument on the importance and irreplaceable role of the civil courts.
