Abstract:A core theme of China’s Belt and Road Initiative (“BRI”) is connectivity, which extends to BRI-related dispute resolution. But BRI-related advances in dispute resolution connectivity will be occurring in an international trade environment that is becoming increasingly fractured; the extent to which a fractured trade environment might impede BRI-related opportunities for dispute resolution connectivity merits close consideration. A range of initiatives in Asia lower the risk of states “detaching” themselves from China. Particularly with respect to dispute resolution, China has participated in the conclusion of a Regional Comprehensive Economic Partnership agreement, the launch of the China International Commercial Court (“CICC”) and the International Commercial Dispute Prevention and Settlement Organization, as well as the development of a number of instruments that improve the enforceability of dispute resolution outcomes in a range of settings, including a few dozen bilateral treaties on judicial assistance as well as a set of multilateral instruments covering mediated settlement agreements (the Singapore Convention on Mediation), choice of court agreements (the Hague Choice of Court Convention), and court judgments (the Hague Judgments Convention).But a low risk of separation from China does not entail a low risk of criticism of China. Malaysia’s recent suspension, and subsequent resumption, of a few major BRI projects provides one clear example. In the particular context of dispute resolution, many responses to the launch of the CICC by China’s Supreme People’s Court have been critical or, at a minimum, skeptical.Rather than leading to separation, criticism instead can be a form of engagement. International engagement with the BRI and the Asian Infrastructure Investment Bank has been strong notwithstanding significant criticism of both initiatives. An increasingly fractured trade environment likely will not impede China’s advancement of dispute resolution connectivity, particularly given the active rulemaking and institution building occurring on China’s side of the divide.

Abstract:Abstract This article critically reviews the establishment and operation of the China International Commercial Court (CICC) from an insider’s perspective. It offers a detailed introduction to a few of the innovative measures of the CICC, including the International Commercial Expert Committee, the ‘one-stop’ forum for a dispute settlement mechanism integrating litigation, mediation, and arbitration, more convenient litigation procedures, and the use of advanced technology in dispute resolution. More importantly, it candidly discusses the challenges facing the CICC and makes several recommendations for its improvement towards more professionalism and internationalization.

Abstract:The United Nations Convention on International Settlement Agreements Resulting from Mediation of 2018 provides a unifi ed and eff ective legal framework for the enforcement of settlement agreements resulting from mediation and facilitates the use of international commercial mediation. China is in the fi rst group of 46 countries to sign the Convention. The signing of the Convention is conducive to the settlement of international commercial disputes in the context of the Belt and Road Initiative. It also helps to enhance the legal regime of China's commercial mediation, and to construct a diversified dispute settlement mechanism. Nonetheless, China's commercial mediation law is not well established and mediation is confi ned to a limited coverage. Eff orts should be made to accelerate the commercial mediation legislation and build a full-fl edged mediation system.

Abstract:The recent proliferation of international commercial courts has become a distinct phenomenon in the landscape of international dispute resolution. While the newer international commercial courts have followed the earlier ones and exhibited features of ‘specialisation’ and ‘internationalisation’, some have gone further to develop a new feature of ‘integration’ by incorporating elements of other methods of dispute resolution—notably, arbitration—into their design and operations. In this regard, the newly established China International Commercial Court (CICC) breaks new ground by creating a ‘one-stop’ and diversified dispute resolution mechanism, which institutionally integrates litigation, arbitration, and mediation into one unified platform. This mechanism is guided by the idea of ‘diversified dispute resolution mechanism’ reform promoted and practiced by the Chinese judicial system; underpinned by institutional arrangements such as the International Commercial Expert Committee (ICEC) and the Coordination and Guidance Office of the CICC; and implemented by procedural designs that deeply integrate international commercial litigation with arbitration and mediation. By conceptualizing the mechanism as an ‘integrated dispute resolution’ (IDR) system, enhancing institutional cooperation and setting up demonstrative IDR centres, the CICC and the ‘one-stop mechanism’ can be further improved to provide an innovative ‘Chinese approach’ to international commercial dispute resolution, for the Belt and Road region and beyond.

Comparative Analysis of the Singapore Convention in Light of the New York and Hague Choice of Court Conventions

Abstract:The United Nations Convention on International Settlement Agreements Resulting from Mediation (the Singapore Convention) is an international convention on cross-border relief for commercial settlement agreements. It is an important legal instrument on resolving commercial disputes through mediation. This chapter provides a focused analysis of the Singapore Convention’s core provisions, including the scope of application, general principles, grounds for refusing to grant relief, and reservations together with a comprehensive interpretation of key concepts such as “settlement” and “mediation.” Meanwhile, this chapter also provides a comparative study of the relevant provisions from the Singapore Convention against those from the New York Convention and the Hague Choice of Court Convention in light of Chinese laws and regulations. Finally, this article reaches the conclusion that China should actively seek to accede to the Singapore Convention and improve relevant domestic laws and regulations in an effort to accelerate the diversification of civil and commercial dispute resolution regimes, which will help the establishment of a community of shared future for mankind.

Abstract:Both China and the United States are members of the New York Convention.Because of differences in court systems,sources of law,and legal methodology,the Convention' s application differs dramatically between the two countries.The arbitral awards are divided into three categories in Chinese law: they are domestic awards,foreign-related awards,and foreign awards.While recognizing and enforcing them,the criteria of Chinese judicial review is not the same.However,the arbitral awards are not clearly distinguished into foreign or domestic ones in American laws.Both federal law and state law can be applied to the international arbitration case in the U.S..Standards for determining the non-domestic awards vary from China to the United States,and the Convention' s application scope is different in both Chinese and the U.S.courts as well.However,China and the United States share the common idea of enhancing and encouraging the healthy and steady development of international commercial arbitration.

Abstract:In the light of China's newly installed sanction laws recently being considered by Chinese court in a judicial review procedure for an arbitral award, this article examines two aspects of these laws that have been largely overlooked by previous research: their private international law nature and the impact they have on the enforcement of foreign arbitral awards. In their function, the Chinese sanction laws should neither fulfil the role of rules established to utilize private persons to implement Chinese state policy, nor, in their application, contradict China's claimed role in the international legal and political framework. Accordingly, two routes are offered as to how these laws should be applied: first, the legal restrains on private enforcement of the sanction laws should be made available; and secondly, China should ensure that its sanction laws do not compromise the New York Convention's remit.

Abstract:Abstract China’s role in the international maritime transport industry is undeniably growing: the country has become the second-largest ship-owning nation, its maritime ports are ranked among the top globally, and its national maritime transport company, COSCO Group, is ranked 4th among major shipping companies. However, its current legal framework is behind the commercial practices of the maritime transport industry and its operators. With both the evolution of China’s position on the global stage and the emergence of new judicial maritime practices, a revision was inevitable, particularly as China aims to build itself into a maritime power. Although the revision of the Maritime Law was included in the 13th National People’s Congress agenda for the period from 2018 to 2023, the revised Law has not yet been promulgated but is expected in near future. While the reform project focuses solely on the Chinese Maritime Law, China’s new ambitions could turn this moment into an opportunity to overhaul and rethink the role of Chinese maritime law in the current global context. Whether by modernizing its maritime law while maintaining its existing structure, or by rethinking its entire approach, China should consider the legal experience of current maritime powers, such as France, which could serve as a valuable source of inspiration for Chinese legislature in the future.
A Diversified Dispute Resolution Mechanism for Settling International Commercial Disputes in China

Abstract:Globalization and international trade call for dispute resolution service competitions among various nations. China is building a Diversified Dispute Resolution Mechanism (DDRM) to connect litigation with alternative dispute resolution methods to enhance the efficiency and flexibility of its dispute resolution system and improve the legal environment for foreign investment. This Chapter demonstrates China’s latest development in international commercial dispute resolution from three perspectives: the construction of the Chinese International Commercial Court under the Belt-and-Road Initiative, arbitration reforms in FTZs, and the development of commercial mediation in China with the impact of the Singapore Mediation Convention on Mediation. These judicial reforms and legal practices prove that China is moving towards the modernization of its commercial dispute resolution system, but further legislative and judicial reforms are required. Structure: The structure of this chapter consists of five sections. Section I summarizes the concept of a diversified dispute resolution mechanism (DDSM) in the background of China’s further integration into the world market and embracing international rules of commercial dispute resolution. Section II to IV demonstrates the framework of the DDSM from three perspectives: international commercial court, arbitration, and commercial mediation. Section II focuses on China’s International Commercial Court with emphasis on its jurisdiction, expertise in foreign law ascertainment, procedural reforms, and the construction of a one-stop international commercial dispute resolution platform. Section III concentrates on international arbitration reforms in the context of free trade zones. The FTZs serve as a judicial experiment for allowing foreign arbitration institutions to administer international commercial disputes in China, with practical challenges, such as the legality concern of foreign arbitration institutions, the scope of foreign-related disputes, and judicial support for the arbitration proceedings administered by foreign arbitration institutions. Section IV discusses the mediation legal framework in China, focusing on judicial mediation and commercial mediation, with a light touch on the impact of the Singapore Convention on China’s mediation development. Section V concludes with current challenges to China’s development in a diversified dispute resolution mechanism and provides recommendations for the future development of the DDRM.<br>
Experimenting with International Commercial Dispute Resolution

Abstract:In this essay, we describe the overlapping phenomena of new legal hubs (NLHs), international commercial courts, and arbitral courts. We survey their impact on the law and geopolitics of international commercial dispute resolution, identifying key issues these new dispute resolution institutions raise. While the rise of international commercial courts spans authoritarian and liberal states, Western and Asian states, common law and civil law traditions, it also highlights and builds upon regional differences. We question the assumption that the establishment of new courts is always consistent with an increase in the rule of law, particularly in non-democratic states. We close with thoughts about the potential influence and future role of these institutions. Some of the procedural innovations discussed here may lead to shifts in international commercial dispute resolution for years to come, but the question of whether there is sufficient demand for these new institutions lingers.

Abstract:The agreement between the two parties' will no foreign factors play in foreign dispute arbitration agreement shall be determined according to the applicable law of arbitration agreement,rather than directly according to the Chinese law determined invalid.According to the current law,if there are no circumstances listed by the Article 5 of the "New York Convention",the foreign arbitral awards without foreign elements controversial should be given the recognition and enforcement by our court.Meanwhile,the domestic dispute shall be prohibited foreign arbitration.Referring to the U.S.practice,we can confirm that "New York Convention" cannot be applied to foreign arbitration between domestic parties,unless the applicant provides evidence of out-of-state property or substantial connection to the dispute relation.

Abstract:Dispute resolution in China has always been a major field of legal research in Chinese legal studies. Gu Weixia’s book, Dispute Resolution in China: Litigation, Arbitration, Mediation, and Their Interaction, published in 2021 by Routledge, should receive high commendation and wide readership as an original and timely contribution to knowledge in this field. Three features have made Gu’s book valuable. First, a particular strength of Gu’s book is its extensive research. The book has encompassed an impressively wide landscape of the various dispute resolution systems in China, covering litigation, arbitration, mediation, and the mixed processes of the above. A private international law and international dispute resolution scholar by training, Gu is probably one of the first scholars to address dispute resolution systems from the prism of a dynamic ecology of multiplicity of approaches to dispute resolution and, more significantly, delve into the mixed processes arising out of the interactions...

Abstract:Abstract This paper contains materials reflecting the practice of Chinese practice in private international law in 2018. First, the statistics of the foreign-related civil or commercial cases decided by Chinese courts is extracted from the Report on the Work of the Supreme People’s Court (SPC) in 2018. Second, the SPC judicial interpretation concerning the enforcement of arbitral awards is translated, and the interpretation reflects a pro-arbitration tendency in Chinese courts. Third, six cases, on the validity of a choice of court clause, the conflict of laws issues regarding personal injury on the high seas, visitation rights and uncontested divorces, as well as the recognition of foreign judgments, are noted. Fourth, the paper introduces a case embodying the “one-stop” international commercial dispute resolution mechanism in Chinese courts. Finally, the paper also covers six representative decisions regarding the parties’ status, the presumption of the parties’ intention as to choice of law, and the validity of arbitration agreements.

Today, Singapore remains an important stop on the Belt and Road, though its advantages now also lie in its position as a trusted, neutral forum for the efficient resolution of disputes as well as a platform for the sharing of ideas for the development of a legal framework for dispute resolution in the Belt and Road Initiative. Three initiatives have been taken by Singapore to strengthen its new position, including the Asian Business Law Institute, the Singapore International Commercial Court, and the Singapore–China Annual Legal and Judicial Roundtable.
