Abstract:The Chinese Arbitration Law of 1995, together with the Civil Procedure Law and other sources of arbitration laws, is served as the legal bases for the Chinese arbitration system. Compared with advanced arbitration systems in the world, there still exist some defects of the Chinese Arbitration Law due to its lack of rich legislative experience and the conservative attitude toward arbitration. However, the Judicial Interpretation by the Supreme Court of China in 1995 makes a progress in Chinese Arbitration Law by strengthening the support to arbitration, but not playing the interventionist role of it.

Abstract:There exist the following serious problem concerning the establishment of the arbitration institution in the current arbitration legal system of China:the provisions on the establishment of arbitration organization in the Arbitration Law are short of social basis and legal foundations,which shakes the footstone of arbitration system-nature of neutrality and nongovernmental feature.Therefore,according to the historical causes for the development of arbitration system,the nature of arbitration and China's realities,the instauration of an arbitration organization shall be under the guidance of the legislatures instead of that of the administrative organs to avoid administrative intervention.
A Comparative Analysis of the Legal Regulation of International Commercial Arbitration in Russia and Mainland China

Abstract:This article examines international commercial arbitration, one of the most popular methods for the resolution of disputes that arise in the context of international commercial relations. The volume of trade between Russia and China has been gradually increasing in recent years, which testifies to the fact that the study of international commercial arbitration legal regulation in both nations is extremely relevant. The authors examine the concept of international commercial arbitration entities, as well as the sources of legal regulation that govern their establishment and operation in Russia and Mainland China. In addition, the procedures for case consideration, the elaboration of arbitration agreements, the rules for the creation of an arbitration commission, the requirements for arbitral awards and other aspects are investigated. The authors come to the conclusion that the regulations governing international commercial arbitration are similar in the two countries and are based on international law and national legal acts. Both Russia and China have adopted the norms outlined in the United Nations Commission on International Trade Law (UNCITRAL) Model Law into their legal systems although to different degrees. Both countries provide similar arbitration agreement norms and support the arbitration clause autonomy principle. The difference lies in the fact that China does not follow the competence-competence principle (the arbitrators’ power to determine their own competence to consider a certain dispute). Instead, the issue is referred either to the arbitration commission or to the state court for resolution. On the other hand, arbitrators in Russia have the right to determine their competence by themselves. According to Chinese law, a party requires arbitration court mediation in order to be able to submit a request for provisional protection measures to the state court, while under Russian law adirect request is allowed. In China, the norms for the recognition and enforcement of aforeign arbitration award by the court do not provide for the court’s ruling to be challenged; the refusal of the recognition and enforcement shall be possible only after the award has been considered by the Supreme People’s Court of the People’s Republic of China. In Russia, the legislation allows for both challenging and refusing the decision to recognize and enforce the award.

Abstract:As law is increasingly involved in politics, economics, culture and environment, law diplomacy is increasingly necessary. Law diplomacy is paralleled with political diplomacy, economic diplomacy, cultural diplomacy and military diplomacy, which refers to diplomatic activities to be based on laws as its content, mechanism and mediation. In law diplomacy, law perceptions and rule of law procedures are carried out, diplomatic issues are transformed into law issues, foreign affairs are handled in law procedures and behaviors, diplomatic disputes are legally solved, diplomatic methodologies are improved, and new scene of diplomatic work appears. Law diplomacy is not only a product of the change of international environment, but also a product of China’s domestic development to a larger extent. Since the turn of the century, China’s law diplomacy, especially China-ASEAN Legal Forum and the Legal Forum of China-Africa Cooperation Forum have developed fast and formed a relatively complete strategic layout of law diplomacy, have undertaken plenty of law diplomatic practices and laid an important foundation for the construction of law-diplomatic theory. Looking forward, China’s law diplomacy should further intensify its mechanization and institutionalization, improve theoretic construction, step up performance in order to make new contribution to promoting the general diplomacy of the nation, and to the building of a harmonious world.

Abstract:Abstract China’s role in the international maritime transport industry is undeniably growing: the country has become the second-largest ship-owning nation, its maritime ports are ranked among the top globally, and its national maritime transport company, COSCO Group, is ranked 4th among major shipping companies. However, its current legal framework is behind the commercial practices of the maritime transport industry and its operators. With both the evolution of China’s position on the global stage and the emergence of new judicial maritime practices, a revision was inevitable, particularly as China aims to build itself into a maritime power. Although the revision of the Maritime Law was included in the 13th National People’s Congress agenda for the period from 2018 to 2023, the revised Law has not yet been promulgated but is expected in near future. While the reform project focuses solely on the Chinese Maritime Law, China’s new ambitions could turn this moment into an opportunity to overhaul and rethink the role of Chinese maritime law in the current global context. Whether by modernizing its maritime law while maintaining its existing structure, or by rethinking its entire approach, China should consider the legal experience of current maritime powers, such as France, which could serve as a valuable source of inspiration for Chinese legislature in the future.

Abstract:Under the background of social change and the great development of "Belt and Road" policy, China's international commercial arbitration is facing a higher level of development needs. In order to solve the existing problems, draw on the experience of the world's advanced international arbitration centers, improve the concept of arbitration, and improve the level of arbitration services, China should take the goal of building a China international commercial arbitration center comparable to the world-class level, and constantly explore the development path of arbitration. This paper analyzes the present situation and trend of international commercial arbitration in China, discusses the connotation and value of China international commercial arbitration center, put forward from government relations, institutional development, system architecture, modernization can assign four aspects to improve the arbitration center construction scheme, and innovatively put forward the horizontal and vertical two lines and special assigned to the development of the framework. Accordingly, China's international commercial arbitration system should be continuously improved, the credibility and discourse power of China's international commercial arbitration should be enhanced, and China should build an international arbitration brand with Chinese characteristics.

Abstract:As a special administrative region of China, Macao preserves a previous continental European civil law system with a transition into a Chinese constitutional and legal framework, embedded in a mixture of Chinese and Portuguese legal culture. Since its return to China in 1999, Macao has seen a rapid economic growth in the past 20 years with a drastic social and economic change. To respond to the increasing number of civil and commercial disputes, Macao adopted a new arbitration law at the end of 2019 to facilitate and promote the use of arbitration as an alternative to the court litigation in settling civil and commercial disputes. With a comparison of the content of Macao’s former Law on Voluntary Arbitration (29/96/M) of 1996 and the New Arbitration Law in light of the region’s civil procedure system, this article will provide an overview and preliminary analysis on Macao’s New Arbitration Law of 2019, with a focus on the scope of application of the New Arbitration Law, provisional and interim measures, and recognition and enforcement of arbitral awards.
International Civil Litigation in China: A Practical Analysis of the Chinese Judicial System

Abstract:International civil litigation in China is on the rise in recent years. This trend inevitably continues with China's entry into the World Trade Organization. Given increasing foreign engagement in doing businesses with China, a better understanding of the Chinese judicial system becomes essential in terms of protection of foreign business interests. Jurisdiction, choice of law and enforcement of judgment are three primary concerns of foreign parties seeking judicial relief and remedies in China. Questions commonly asked include: what are the bases for a Chinese people's court to assert jurisdiction over foreign parties; what are the standards to determine judicial competence; how a Chinese people's court decides which law is going to be applied in each particular case involving "foreign elements"; and whether a judgment could be effectively enforced and by what means. Fear that China lacks the rule of law and an independent judicial system produces hesitancy to conduct business in China and pursue legal rights. Creating the public confidence in the judiciary is one of China's most important tasks as it seeks to attract international business. Judicial independence and justice are major challenges facing the ongoing Chinese judicial reform.

International Arbitration of Maritime Delimitation: an Alternative for East Asia?

Abstract:International arbitration, as a neutral, flexible, efficient and binding legal means of dispute resolution, has been effective in settling maritime delimitation disputes, especially in recent years since the UNCLOS came into force. There are a number of reasons (i.e. advantages) for its increased popularity. Reasonable expectations thus arise as to its applicability onto similar maritime delimitation disputes of the East Asian countries whose diplomatic efforts have mostly failed to address these matters. This article examines this practical issue primarily from the legal perspective by reviewing relevant international rules including the UNCLOS provisions on compulsory dispute resolution and cases such as the ongoing Philippines-China arbitration over the South China Sea. Observations are also made from the political and cultural perspectives as well. It concludes that, though multiple dispute settlement means are still encouraged, international arbitration could be an important alternative for East Asian countries seeking a peaceful solution to their maritime delimitation disputes.
Mediating State–society Disputes in China: Outsourced Lawyers and Their Selective Responses

Abstract:Where popular contention in China is concerned, third parties are not merely supporters of protesters but also allies of the state. Through quantitative and qualitative methods, this article uses an actor-centred perspective to explore the dual role of Chinese lawyers in state dispute resolution projects. When providing legal counselling services to the public, lawyers adopt selective strategies and channel non-political cases into legal channels while keeping political cases within the political arena. When handling social disputes for the government, however, they apply professional diagnoses and legal persuasion, and intervene through mediation and negotiation. Three factors constrain the effectiveness of Chinese lawyers during dispute resolution. These are the limited access to cases, the dilemmas inherent in acting simultaneously both as a third party and as a state agent, and the restricted influence of lawyers over the final resolution of social disputes. This article argues that the selective responses of Chinese lawyers during legal counselling and strategic defence of state power in dispute resolution make them a governance tool for stability maintenance. Their participation contributes more to legal repression than to legal development in contemporary China.
Comments on the Chinese Law of Conflict of Laws Applicable to Trusts: in Comparison with the U.S. Law and the Hague Convention

Abstract:China has entered a new era represented by the newly established China (Shanghai) Pilot Free Trade Zone, in which further reform and development of its financial system and capital market are highly prioritized. The trust as an important vehicle in development of the financial market in China as well as in the world will play an important role, and there will be more foreign elements involved in Chinese trusts. The Law of the People’s Republic of China on Application of Laws in Civil Relations with Foreign Elements provides rules, in its article 17, on the application of laws to trusts, which symbolizes the formal creation of rules of conflict of laws in China in this area. However, it seems to cause more problems than it may resolve. For example, it may not always be possible for the parties to determine the applicable law through consultation and agreement, and the parties’ right to choice of law should not be without limitation either. By allowing judges to choose from “the law of the situs where the trust property is situated” and “the law of the situs where the trust relationship occurred” in the absence of an effective choice of law by the parties may lead to a situation contrary to existing laws and may create uncertainty for the parties as well. This paper analyzes this article 17 by comparing it with the conflict law rules adopted in the United States and by the Hague Convention, identifies problems, and seeks to find solutions in order to promote the healthy development of the trust system in China.
A sociosemiotic approach to fundamental rights in China

Abstract:The legal term "fundamental rights" has been well recognized in international treaties and legislations. The present study investigates the stipulations on fundamental rights in the four versions (1954, 1975, 1978, and 1982) of and four Amendments (1988, 1993, 1999, and 2004) to the Constitution of the People's Republic of China (PRC) from a sociosemiotic perspective. The findings in this study indicate that the provisions in the Constitution are crafted in such a manner that the dominant social and political participants employ them to maintain their ruling position and promote social and economic developments. In the successive versions and Amendments to the PRC Constitution, the evolution of the provisions on fundamental rights not only demonstrates the development of fundamental rights in China, but also illuminates the underlying mediation mainly among the Chinese government, the Communist Party of China (CPC), and Chinese people. The connotation and validity therein is constructed through communication and competition among various participants. It is therefore argued that the status quo of fundamental rights in China is the result of mediation among the relevant participants under the impact of the social and economic development. The State and the CPC are thus suggested to loosen their grips to promote Chinese people's participation in the mediation process with more attention to the social and economic reality. This study also implies that the definition of a legal term is constrained by other sign systems and hence the importance of an understanding of terminological dynamicity.
Internationalization with Backward International Law

Abstract:This article discusses a mechanism for dispute resolution, called the “China model,” for newly-launched panda bonds. This China model contemplates a two-step approach for resolving disputes between Chinese bond investors and foreign sovereign issuers; namely, arbitration in China to settle disputes between the two sides and enforcement of Chinese arbitral awards by courts of foreign sovereigns. This article argues that the existence of the China model reflects a deep tension between China’s goal of internationalization and the backwardness of its international law regime. This is evidenced by China’s adoption of an absolute doctrine of sovereign immunity, which prevents Chinese courts from accepting disputes against foreign sovereigns and was abandoned by developed countries many decades ago. This article further discusses three factors that contribute to the backwardness of China’s international law regime: the continuing impact of historical debt disputes, within which China still defends itself using the absolute immunity doctrine; the failure of China’s approach to rely on international convention to change its position on sovereign immunity; and the challenge of drafting a comprehensive sovereign immunity statute in China due to lack of support among stakeholders within the country.

Abstract:There is much debate currently on how to revise the grounds for non-enforcing arbitral award stipulated in article 213 of China civil procedural law. To provide beneficial reference for related discussion, it is necessary to do an empirical analysis of the first-hand data from the arbitration and judicial practice. Study on rulings concerned with the non-enforcement of the awards issued by Beijing Arbitration Commission from 1995 to 2010 expresses that factors illustrating the non-enforcement of an award are diverse. From the perspective of practice, at least the ground related to fact finding stipulated in Article 213 (4) should be changed into "falsifying or concealing evidence" which is stipulated as grounds of setting aside award in Article 58 of China arbitration law.

Abstract:Arbitration of labour disputes, as an important way to protect the rights and interests of workers, aims to achieve better resolution of labour disputes and maintenance of labour relations through the front-loading of arbitration of labour disputes. With the continuous development of the society, labour dispute disputes are increasing, and the procedural rights and interests of workers in labour dispute arbitration are also more and more prominent. Based on this problem, China needs to carry out a series of reforms to the labour dispute arbitration system, to fill the gaps in the existing legal regulations, and to propose a series of targeted measures for the difficulties encountered by workers in labour dispute arbitration.

The Arbitration Validity Of Bot Concession Agreement In China

Abstract:There are several approaches available to settle disputes in BOT concession, among which arbitration is a commonly used one. But a controversy over a BOT project, which happened in 2005, elicited a legal crisis in arbitration on cases concerning BOT investment under China's current laws. A relevant question is then asked: whether the disputes arising from a BOT concession agreement could be submitted for arbitration?This paper firstly analyzes the relative laws in China, especially the law system of arbitration, the Arbitration Law of P. R. C and some other separate regulations concerned. Based on prudential examination on Article 2 and Article 3 of the Arbitration Law, key provisions related to arbitrability, together with other arbitrational separate regulations, it is concluded that under current Chinese laws the BOT concession agreement disputes cannot be arbitrated.The conclusion above will however, obviously make against the promotion of infrastructure investments in China. This paper then suggests the areas for improvements to this legal crisis so as to make the investments in China by BOT model go on wheels. One of the most effective ways is to enact a BOT separate regulation, in which the present separate regulations are used for reference. In addition, it is necessary to amend the 1994 Arbitration Law, with consulting the Government Procurement Law, in order to cope with the fast social and economic developments in China.

Abstract:Insurance contract law and insurance industry law were revised extensively in the second amendment of China's insurance law on February 28th,2009.Particularly,according to the need in reality,dispute in practice and consensus in academics,many law systems about personal insurance and property insurance were redesigned.For the insurable interest rules,disclosure regulations and the assignment regulations of insurance subject,which key amended in insurance contract law,the legislative changes and its reason are stated clearly and analyzed deeply.Furthermore,which need to be improved is suggested.
