International Civil Litigation in China: A Practical Analysis of the Chinese Judicial System

Abstract:International civil litigation in China is on the rise in recent years. This trend inevitably continues with China's entry into the World Trade Organization. Given increasing foreign engagement in doing businesses with China, a better understanding of the Chinese judicial system becomes essential in terms of protection of foreign business interests. Jurisdiction, choice of law and enforcement of judgment are three primary concerns of foreign parties seeking judicial relief and remedies in China. Questions commonly asked include: what are the bases for a Chinese people's court to assert jurisdiction over foreign parties; what are the standards to determine judicial competence; how a Chinese people's court decides which law is going to be applied in each particular case involving "foreign elements"; and whether a judgment could be effectively enforced and by what means. Fear that China lacks the rule of law and an independent judicial system produces hesitancy to conduct business in China and pursue legal rights. Creating the public confidence in the judiciary is one of China's most important tasks as it seeks to attract international business. Judicial independence and justice are major challenges facing the ongoing Chinese judicial reform.

Abstract:Abstract The establishments of international commercial courts reflect the closer alignment of commercial transactions and the development of dispute resolution mechanisms. To mainly facilitate the developments of the ‘Belt and Road Initiative’, China established the China international commercial court (CICC) in 2018. It marked a significant step in the development of China’s judicial system. However, compared with other international commercial courts in the world, the construction of the CICC still has much room for improvement in the areas of jurisdiction, internationalization, and the recognition and enforcement of judgments. The China’s Supreme People’s Court (SPC) needs to consider how to refine the working procedures, enhance the internationalization, and promote the recognition and enforcement of the awards by the CICC. The SPC may need to update the current legal regime for the CICC based on the operation and the experience of trials. In addition to the efforts of the SPC to pave the way for developments, China needs to consider modifying the relevant rules and actively expand its judicial cooperation with other countries.

Abstract:The recent proliferation of international commercial courts has become a distinct phenomenon in the landscape of international dispute resolution. While the newer international commercial courts have followed the earlier ones and exhibited features of ‘specialisation’ and ‘internationalisation’, some have gone further to develop a new feature of ‘integration’ by incorporating elements of other methods of dispute resolution—notably, arbitration—into their design and operations. In this regard, the newly established China International Commercial Court (CICC) breaks new ground by creating a ‘one-stop’ and diversified dispute resolution mechanism, which institutionally integrates litigation, arbitration, and mediation into one unified platform. This mechanism is guided by the idea of ‘diversified dispute resolution mechanism’ reform promoted and practiced by the Chinese judicial system; underpinned by institutional arrangements such as the International Commercial Expert Committee (ICEC) and the Coordination and Guidance Office of the CICC; and implemented by procedural designs that deeply integrate international commercial litigation with arbitration and mediation. By conceptualizing the mechanism as an ‘integrated dispute resolution’ (IDR) system, enhancing institutional cooperation and setting up demonstrative IDR centres, the CICC and the ‘one-stop mechanism’ can be further improved to provide an innovative ‘Chinese approach’ to international commercial dispute resolution, for the Belt and Road region and beyond.

Abstract:Remarks delivered at the signing ceremony for the Cooperation Agreement between Peking University School of Transnational Law and Chengdu Intermediate People's Court. The judiciary in China and Peking University School of Transnational Law (STL) are both playing a central role in developing foreign-related rule of law and foreign-related legal talents in China. STL has been focused on this effort since the school's establishment in 2008, long before the development of foreign-related law and foreign-related legal talents had entered the spotlight. The term "transnational" law captures the increasingly clear reality that domestic law routinely interacts with foreign and international law and routinely has cross-border effects. Almost 70 years after Jessup's formulation of transnational law, that category of law must continue to develop, expand and adapt in response to - among many other intervening events - rapid and consequential developments in technology. The increasingly central role of data, artificial intelligence and algorithms in the global economy have blurred lines between jurisdictions, and even when boundaries between jurisdictions remain clear, states are becoming increasingly aggressive in developing rulemaking domestically that is unquestionably intended to have cross-border effects. And at the same time, states are developing creative, sophisticated responses - specifically, different forms of countermeasures - to address rulemaking by other states that is perceived to be excessively extraterritorial in its reach. All judiciaries, including the judiciary in China, must keep pace with these rapid changes.

Abstract:International commercial courts have proliferated in the past 20 years. In 2018, China established specialized international commercial courts in Shenzhen and Xi’an. They are the two branches of the China International Commercial Court (CICC). Since then there has been a proliferation of literature on the CICC. This article provides insights into the recent development of the CICC. The first part of the article explores the background against which the CICC was established. The second part narrates its recent development. The challenges the CICC faces to improve its attractiveness and competitiveness are discussed in the third part and the fourth part considers possible competition between international commercial courts in different jurisdictions. The article closes with a few concluding remarks on the place of the CICC in the global transnational commercial dispute resolution community.

Connectivity and Decoupling: Belt and Road Dispute Resolution in a Fractured Trade Environment

Abstract:A core theme of China’s Belt and Road Initiative (“BRI”) is connectivity, which extends to BRI-related dispute resolution. But BRI-related advances in dispute resolution connectivity will be occurring in an international trade environment that is becoming increasingly fractured; the extent to which a fractured trade environment might impede BRI-related opportunities for dispute resolution connectivity merits close consideration. A range of initiatives in Asia lower the risk of states “detaching” themselves from China. Particularly with respect to dispute resolution, China has participated in the conclusion of a Regional Comprehensive Economic Partnership agreement, the launch of the China International Commercial Court (“CICC”) and the International Commercial Dispute Prevention and Settlement Organization, as well as the development of a number of instruments that improve the enforceability of dispute resolution outcomes in a range of settings, including a few dozen bilateral treaties on judicial assistance as well as a set of multilateral instruments covering mediated settlement agreements (the Singapore Convention on Mediation), choice of court agreements (the Hague Choice of Court Convention), and court judgments (the Hague Judgments Convention).But a low risk of separation from China does not entail a low risk of criticism of China. Malaysia’s recent suspension, and subsequent resumption, of a few major BRI projects provides one clear example. In the particular context of dispute resolution, many responses to the launch of the CICC by China’s Supreme People’s Court have been critical or, at a minimum, skeptical.Rather than leading to separation, criticism instead can be a form of engagement. International engagement with the BRI and the Asian Infrastructure Investment Bank has been strong notwithstanding significant criticism of both initiatives. An increasingly fractured trade environment likely will not impede China’s advancement of dispute resolution connectivity, particularly given the active rulemaking and institution building occurring on China’s side of the divide.

Abstract:As law is increasingly involved in politics, economics, culture and environment, law diplomacy is increasingly necessary. Law diplomacy is paralleled with political diplomacy, economic diplomacy, cultural diplomacy and military diplomacy, which refers to diplomatic activities to be based on laws as its content, mechanism and mediation. In law diplomacy, law perceptions and rule of law procedures are carried out, diplomatic issues are transformed into law issues, foreign affairs are handled in law procedures and behaviors, diplomatic disputes are legally solved, diplomatic methodologies are improved, and new scene of diplomatic work appears. Law diplomacy is not only a product of the change of international environment, but also a product of China’s domestic development to a larger extent. Since the turn of the century, China’s law diplomacy, especially China-ASEAN Legal Forum and the Legal Forum of China-Africa Cooperation Forum have developed fast and formed a relatively complete strategic layout of law diplomacy, have undertaken plenty of law diplomatic practices and laid an important foundation for the construction of law-diplomatic theory. Looking forward, China’s law diplomacy should further intensify its mechanization and institutionalization, improve theoretic construction, step up performance in order to make new contribution to promoting the general diplomacy of the nation, and to the building of a harmonious world.

Abstract:Abstract Historically, Singapore has played an important role in the growth and success of the old maritime Silk Road. Today, Singapore remains an important stop on the Belt and Road, though its advantages now also lie in its position as a trusted, neutral forum for the efficient resolution of disputes as well as a platform for the sharing of ideas for the development of a legal framework for dispute resolution in the Belt and Road Initiative. Three initiatives have been taken by Singapore to strengthen its new position, including the Asian Business Law Institute, the Singapore International Commercial Court, and the Singapore–China Annual Legal and Judicial Roundtable.

Attribution and Judicial Control in Chinese Court Judgments: a Corpus-Based Study

Abstract:The present corpus-based study deals with attribution in court judgments from three perspectives: the forms of appellate judgments, authorial voices in appellate judgments, and attribution to the sources of law. The results in the study are threefold. First, all the appellate judgments from Mainland China and Taiwan are the judgment of the court; both single-opinion judgments and multiple-opinion judgments are found in the appellate judgments from Hong Kong. Secondly, only institutional self-references are found in the appellate judgments of Mainland China and Taiwan. Thirdly, more divergent forms in terms of sources of law are found in Hong Kong in contrast with Mainland China and Taiwan. Through the analysis of the results obtained in this study, the author argues that in Hong Kong the individual judge’s power is foregrounded and what is backgrounded is the court. In contrast, in the Mainland China and Taiwan judgments, one can only hear the voices of the court rather than those of the individual judge. The discursive presentation of focusing on different power agents can find its root in social construction, because the discursive structure is constrained by and representative of social structure.
Interventions In Hong Kong Courts: A Case-Based Study

Abstract:Interventions in courtroom have been the research interest for many scholars. This case-based study examines the interventions by judges or counsels in the courts of Hong Kong with the aim to contribute the study on interventions in courtroom. There are two worth-noting findings in this study: as powerful participants in court interactions, the judges and the counsels are used to and more than happy to use interventions; as a neutral adjudicator, the judges should refrain themselves from unfair interventions by themselves but also from counsels. The propriety of judges' behavior in their interventions is, in return judged by other judges of a higher court. The conflict between solidarity as a discursive code and neutrality as a professional ethic complicate the interventions in courtroom, which is a complex of different social actors.
The Sinophone lawyer: China's cross‐border impact on the legal profession

Abstract:Abstract This article studies China's cross‐border impact on the legal profession, and develops the concept of the Sinophone lawyer to capture the inter‐jurisdictional transformation. Using Hong Kong as a case study, the article identifies a process of ‘Sinophonication’ brought about by Chinese capital; that is, lawyers and law firms have critically changed the language in which they practise. The fact that the Chinese language is multilingual and polyphonic further assigns different values to different aspects of linguistic proficiency and different levels of the legal profession. For law firm partners, the ability to speak Mandarin and Mandarin cultural literacy are now indispensable. For associates, the ability to read and write simplified Chinese is essential. A lower level of paralegals has been created, attracting native speakers from Mandarin‐speaking jurisdictions to serve as associates at a lower salary and with less career security. The article draws on qualitative interviews with solicitors, barristers, and foreign lawyers in Hong Kong, and quantitative data from Hong Kong Lawyer (1996–2016) and the annual reports of the Law Society of Hong Kong (1994–2016).

Abstract:Since the inception of the Belt and Road Initiative in 2013, Chinas foreign economic and trade engagements have experienced ongoing growth and expansion. In response to the broader cross-border market, the establishment of a multifaceted dispute resolution framework encompassing litigation, mediation, and arbitration has emerged as a crucial undertaking. This framework is designed to address the growing complexity of international cooperation disputes. Among them, litigation is the most credible and the last guarantee of fairness and justice. Chinas cross-border civil and commercial litigation (Hereinafter referred to as the CBCC litigation) has developed rapidly under the Belt and Road Initiative. However, there are still a series of problems in case filing, service, application of law, proof of foreign laws, and execution of overseas judgments. Due to the national policy of one country, two systems, the Guangdong-Hong Kong-Macao Greater Bay Area (Hereinafter referred to as the Greater Bay Area) has gained unique regional advantages and strategic value in the CBCC litigation reform and practice. This research summarises the development status of the Greater Bay Area since the Belt and Road Initiative. It identifies three development directions for the modernisation reform of the litigation in the region: high efficiency, legalisation, and internationalisation. In these three directions, the Greater Bay Area has made certain achievements. These achievements prove that Chinas CBCC litigation is actively entering the international track, deepening the determination of international cooperation and exposing the shortcomings of the current cross-border judicial practice. China still has considerable space to progress ahead in enhancing the effectiveness of cross-border dispute resolution, integrating reform initiatives into legal statutes, and advancing international judicial collaboration.

It offers a detailed introduction to a few of the innovative measures of the CICC, including the International Commercial Expert Committee, the ‘one-stop’ forum for a dispute settlement mechanism integrating litigation, mediation, and arbitration, more convenient litigation procedures, and the use of advanced technology in dispute resolution.
