Abstract:As the fundamental law of the state,constitutional implication the principles of respect and protection of human rights produced profound influence to our country criminal law system.Criminal law amendment(eight) on the penalty structure was adjusted from the reduction of death penalty,perfection of non imprisonment punishment,strengthen human rights protection of the special groups and other aspects.This adjustment reflected positive response of criminal law on constitutional respect and protection of human rights principles.Although adjustment still has many deficiencies,but the criminal law amendment(eight) on the adjustment of penalty structure actively promote China's criminal law humanity process.It has important significance in light of the constitution to respect and guarantee human rights principle.
