Abstract:The Supreme Court of the United States held in Browning-Ferris Industries v.Kelco Disposal,492 U.S.257(1989) that the Excessive Fines Clause of the Eighth Amendment does not apply to punitive damages in cases between private parties;it applies exclusively to criminal prosecutions and punishments, which closed the theoretical and practical debate on this issue, and ruled on the constitutionality of punitive damages under the Due Process Clause of the Fourteenth Amendment.Due to the differences in Chinese and American legal traditions and systems, the establishment and improvement of multiple damages and punitive damages in China should not be simply duplicated.Yet there are several lessons that could be learned from the American legal practice: the application and reflection of constitutional law ought to be valued;more attention should be paid to the constitution while studying other branches of law;the scope and intensity of damages system in China need to be taken into consideration.
