Fine Penalty Systems in Countries such as Korea and their Enlightenments to China

Abstract:Fine penalty is an indispensable component in modern penalty system.In China,the application scope of fine has been broadened since 1997 when the criminal law amendment.However,a lot of deficiencies exposed gradually during the ten-year practice.Through comparison study on the system of fine penalty in countries such as Korea,it is easy to find that there exist many gaps and defaults in our country's fine penalty system.The system needs to be relocated.Only with the experience of other countries for reference could its application scope,executive ways conform to the mitigation,diversification and humanization of the world penalty system.In this way,the fine penalty in China can give full play to its function.
