Abstract:Global limitation of liability is one of the most important concepts in maritime law. The Chinese Maritime Code devoted the whole of its Chapter XI to the concept and, since the Code's adoption in 1993, numerous court cases and supplementary regulations concerning the concept have been added into China's legal resources. In view of all these new developments, this article sets out to critically examine the concept with respect to applicable ships, persons entitled to limit, conduct barring limitation, limitation funds and, in particular, the right to invoke. Based on its different trading areas, China divides its limitation into international, coastal and inland, which is a unique and important feature when compared with many other jurisdictions. In addition to traditional maritime claims, discussion is extended to limitation of liability for oil pollution and nuclear damages.

Abstract:The transference of rural land contract and operation rights mostly includes transfer,subcontracting,hiring,exchanging,buy a share and mortgage.At present,the juristic character of main types of transference of rural land contract and operation rights in academe is different from the praxis.Thus,it makes against to let the behavior of the transference of rural land contract and operation rights to be legitimate,presentable and accurate.For letting the transference of rural land contract and operation rights to be "conditional,voluntary,canonical,orderly and legitimate " and sticking up for the two parties in the transference of rural land contract and operation rights,it is especially important to define the juristic character of main types of transference of rural land contract and operation rights.The conclusion of this study is: transfer,exchanging and mortgage belong to the nature of real rights;subcontracting and hiring belong to creditor's claim;buy a share belongs to creditor's claim.

Abstract:Subcontract is currently the most important circulation form of rural land contracted management right transfer.This article argues that: subcontract is an independent circulation form,belonging to the circulation of rural land contracted management right in the nature of obligatory right but still retaining the character of real right according to the law.Subcontractors can only create the rights in the nature of obligatory right;subcontracting is only applicable to the contracts obtained through the household system of contracted responsibility,and subcontractors have to be the members of contract-issuing party.The article find fault with the unscientific stipulation in Article 39 of The Rural Land Contracting Law which says "The contractor may,within a certain time limit,subtract or lease the right to operate the contracted land partially or wholly to a third party,which shall not alter the contracting relationship between both parties",and then put forward some amendatory proposals for perfecting it.

Abstract:Lien,deviating from the vicious demur of Roman Law,often overlaps with the simultaneous performance of defense right.But the two rights don't adapt to the common principle of concurrent right of claim because of no typical concurrence of rights between them due to their different nature and effect.The performance of lien lack of necessity and reasonability causes abuse of lien.A creditor,who obviously goes beyond the retention of obligation amount or keeps retention of creditor' property,is also supposed to abuse the lien.Lien does not apply to commitment by kindness but its object should be movable property given by debtor to creditor.

Abstract:The contractual choice-of-law clause is valid in determining the existence of maritime lien,although the latter is a kind of real rights.The shipowner,however,may therefore insert a no-lien clause into the time charterparty in prohibiting the charterer's authority of lien binding the vessel under the time charterparty.This paper examines the validity of such a clause and its effects on maritime lien by analyzing the authorities under American case law,followed by a conclusion of the general principles in determining the same.

Abstract:Nowadays,amendments to the Maritime Code have become a heated topic in China's academic circles.Scholars vary in their ways of modification.Judging from China's status quo and by reference of foreign experience,and with respect to the amendment principles of the Code,this paper proposes: while amending the Code, we should take into account both medium-scaled and small changes;we should give consideration to both the domestic and foreign elements;and we should stress both timeliness and prudence.The Code,after amendments,should be geared to developments of the day and to the advance of China's shipment economy and judicial practice.It should be expected to play a more important role in China's statutory framework.

Abstract:Abstract China’s role in the international maritime transport industry is undeniably growing: the country has become the second-largest ship-owning nation, its maritime ports are ranked among the top globally, and its national maritime transport company, COSCO Group, is ranked 4th among major shipping companies. However, its current legal framework is behind the commercial practices of the maritime transport industry and its operators. With both the evolution of China’s position on the global stage and the emergence of new judicial maritime practices, a revision was inevitable, particularly as China aims to build itself into a maritime power. Although the revision of the Maritime Law was included in the 13th National People’s Congress agenda for the period from 2018 to 2023, the revised Law has not yet been promulgated but is expected in near future. While the reform project focuses solely on the Chinese Maritime Law, China’s new ambitions could turn this moment into an opportunity to overhaul and rethink the role of Chinese maritime law in the current global context. Whether by modernizing its maritime law while maintaining its existing structure, or by rethinking its entire approach, China should consider the legal experience of current maritime powers, such as France, which could serve as a valuable source of inspiration for Chinese legislature in the future.

Abstract:Assignment of credit is an important system in the law of obligation, and closely related to jus rerem and the system of unjust enrichment. Under the contract law of China, where parties agree that the credit is unassignable, the agreement shall be observed. Making such affirmativeness concerning the validity of agreement is open to question. It is inconsistent with the trend in foreign countries, and not fit for the need of the economic development. Deepened probe should be made with respect to the issues concerning the concept, constituent requirements, and legal force of the system of assignment of credit.

Abstract:This piece serves as a response to the comments on my paper“Administrative Subcontract” made by Zhou Xueguang ,Zhang Jing ,Cao Zhenghan ,and Feng Shizheng .My reply focuses both on their critical comments and suggestions . Our differences center on such issues as the definition , content ,and causes of administrative subcontract system ,the definition and implications of ruling risks ,and authority allocation between the principal and the agent .In the reply I try to clarify the confusions and explain the reasons why we differ in these matters and indicate my stance . Following the commentators’ critical comments and suggestions ,I also discuss the possibilities and directions for further improvement of the administrative subcontract theory . In the conclusion ,I propose three criteria for a good theory and highlight the importance of interdisciplinary academic exchange and interaction in developing a good theory .
