Abstract:Compensation for vessel-source oil pollution is a key issue in protecting the interests of both victims and the marine environment, as well as in the prevention of oil pollution. International standards on compensation for vessel-source oil pollution have been established by various relevant international conventions. This paper investigates how China is implementing such international standards for vessel-source oil pollution compensation and reveals the potential problems on the way of improving its compensation standards. It is found that China is making efforts to enhance its compensation capacity, and is moving closer to the international standards. However, such compensation will not be adequate if a major oil pollution incident occurs in the Chinese sea areas, and becoming a member of the International Oil Pollution Compensation Fund may give stronger protection for victims in China.

Abstract:China has made great efforts to establish a compensation system for oil pollution damage from ships. Several laws and regulations have come into effect since 2010 that have brought significant changes to the legal regime of compensation for oil pollution damage. In this article, the new legal regime for compensation for oil pollution damage from ships is examined to illustrate how China is moving closer to the international standard in this area.

Abstract:Maritime safety has undergone considerable change in the past decades, particularly inits improved approach to risk quantification analysis. This article reviews the challenges of maritime safety analysis and the different approaches used to quantify the risks in maritime transportation. Formal safety assessment (FSA) is examined with a focus on its deficiencies, and its recent developments are described at the International Maritime Organization (IMO) level. The possible applications of FSA in maritime security and piracy analysis are discussed given its growing impacts on safety at sea. Some new uncertainty and risk modelling techniques are also presented to demonstrate how risk quantification analysis facilitates the transformation of maritime safety culture from a reactive prescriptive scheme towards a proactive goal-setting regime.

Abstract:This paper studies the contributing factors of maritime piracy by analyzing previous incidents that have been reported to the International Maritime Organization (IMO). Part of the analysis is to filter those ship types that are particularly vulnerable to piracy attacks. The paper also introduces the guidelines developed by the IMO and the industry envisaging to minimize the risk to ships that are exposed to attacks from pirates. It further describes the initiatives taken to develop a sustainable mechanism in the high-risk area (HRA)(1) to suppress piracy and other maritime crimes. This study reflects the fact that maritime security and piracy issues' importance has been increasingly recognized in the 40 year history of Maritime Policy & Management.

Abstract:Global limitation of liability is one of the most important concepts in maritime law. The Chinese Maritime Code devoted the whole of its Chapter XI to the concept and, since the Code's adoption in 1993, numerous court cases and supplementary regulations concerning the concept have been added into China's legal resources. In view of all these new developments, this article sets out to critically examine the concept with respect to applicable ships, persons entitled to limit, conduct barring limitation, limitation funds and, in particular, the right to invoke. Based on its different trading areas, China divides its limitation into international, coastal and inland, which is a unique and important feature when compared with many other jurisdictions. In addition to traditional maritime claims, discussion is extended to limitation of liability for oil pollution and nuclear damages.

Abstract:In China′s international trade practice,the legal system concerning the subjects of marine cargo insurance contracts is based on the special provisions of the"maritime law",while the insurable interest provision is based on the general clause of the"Insurance Law",which results in a phenomenon of a serious disconnect between the legal system and the reality of economic transactions.The newly revised"Insurance Law"is expected to have a positive impact on the practice of marine cargo insurance due to the reconstruction of time effect of the insurable interest.

Legal certainty of ownership of the ship is therefore desirable but it is under challenge with regard to the judicial sale of a ship: the effects of a judicial sale may be denied in a jurisdiction other than the place where it was sold under the principles of state jurisdiction.

Abstract:Abstract China’s role in the international maritime transport industry is undeniably growing: the country has become the second-largest ship-owning nation, its maritime ports are ranked among the top globally, and its national maritime transport company, COSCO Group, is ranked 4th among major shipping companies. However, its current legal framework is behind the commercial practices of the maritime transport industry and its operators. With both the evolution of China’s position on the global stage and the emergence of new judicial maritime practices, a revision was inevitable, particularly as China aims to build itself into a maritime power. Although the revision of the Maritime Law was included in the 13th National People’s Congress agenda for the period from 2018 to 2023, the revised Law has not yet been promulgated but is expected in near future. While the reform project focuses solely on the Chinese Maritime Law, China’s new ambitions could turn this moment into an opportunity to overhaul and rethink the role of Chinese maritime law in the current global context. Whether by modernizing its maritime law while maintaining its existing structure, or by rethinking its entire approach, China should consider the legal experience of current maritime powers, such as France, which could serve as a valuable source of inspiration for Chinese legislature in the future.

Abstract:The 1982 United Nations Law of Sea Convention” signed by more than 150 nations went into effective on 16 November 1994, and has brought about great changes in peoples’ sense of oceans. According to some provisions of the Convention, great changes take place in the ranges of jurisdictional sea areas and the ownership of marine resources and rights and interests of maritime nations and also in the resources and rights and interests of the international waters of all the countries in the world. Since the Convention entered into force, the international maritime order has been greatly restructured, and the new concept “sea land” comes into being. Oceans have become the focus of world attention. People get more and more aware that the 21st century is an era of ocean. The authors introduce the aims and contents of the Convention, expound principles adopted by China and the neighboring countries, declare the development of marine economy of China and the developed countries, and describe contents, forms and characteristics of the marine integration management.

Abstract:Under the current system of maritime law in China,crew’s claims to wages and benefits as provided in the labor contract,have been put in the first place among all maritime claims secured by the priority claim to seagoing ships.However,owing to the historical limits in the time when maritime law was enacted,it was quite ambiguous in relation to the way the provisions concerning crew’s claims to wages and benefits secured by the priority claim to seagoing ships should be applied.Accordingly,efforts are needed in theoretical studies so as to guarantee a proper application of the law.

Abstract:Abstract Part XII of the United Nations Convention on the Law of the Sea ( UNCLOS ) on the protection and preservation of the marine environment contains provisions that are worded in a general manner. As “the problems of ocean space are closely interrelated and need to be considered as a whole”, these provisions need to be interpreted in harmony with the wider corpus of international law. However, when marine environmental disputes are brought before the UNCLOS dispute settlement bodies, their jurisdiction is limited to disputes arising under UNCLOS . The tribunals, therefore, have to navigate between deciding disputes in a hollistic manner and remaining within their jurisdictional limits. This article discusses the techniques used by UNCLOS tribunals to resort to other sources of international law when settling marine environmental disputes. It will then assess whether, in doing so, the tribunals have remained within their jurisdictional parameters and the wider implications of this practice.

Abstract:In January 1998, Taiwan promulgated the Law of the Republic of China (ROC) on the Territorial Sea and the Contiguous Zone and the Law of the Republic of China on the Exclusive Economic Zone (EEZ) and the Continental Shelf, both of which came into force on January 21, 1998. On June 26, 1998, China adopted the Law of the People's Republic of China on the Exclusive Economic Zone and the Continental Shelf, which is the most significant maritime legislation since its 1992 Law on the Territorial Sea and the Contiguous Zone. This article studies the recent maritime legislation developments in Mainland China and Taiwan, the differences and similarities between the two sets of laws, their implications for the Asia-Pacific region, and the potential challenges for the United States.

Abstract:The South China Sea (‘SCS’)constitutes a typical semi-enclosed sea under Article 122 of UN-CLOS,which imposes the duty of cooperation on the bordering states around SCS.However,due to the hor-tatory language of Article 123 of UNCLOS,the legal nature of the duty to cooperate is not without controver-sies.In light of the general rule of treaty interpretation,there exists the mandatory duty of cooperation for the SCS states.In comparison with the advanced experience of cooperation between costal countries of Euro-pean semi-enclosed seas,the cooperation in the SCS remains at the initial stage.Such an unsatisfactory sta-tus quo could be ascribed to the following factors:the disturbance of territorial and maritime boundary dis-putes,the lack of regional treaties or institutions,and the absence of powerful regional organizations.Be that as it may,the SCS States should keep self-restraint,and conduct certain functional cooperation in less sensitive areas before the settlement of territorial and maritime disputes,so as to make the SCS “sea of co-operation,sea of friendship”.

Abstract:Abstract International marine environmental law has found its primary sources in international legal principles and conventions. At the regional level, some organisations prefer soft laws as their main instruments for regional marine environmental protection. This article proposes that coastal states could use soft law instruments in the South China Sea ( scs ) region to protect the marine environment through robust institutional processes, addressing environmental degradation concerns against a tense geopolitical backdrop. Based on discussions of regional practices, this article proposes that scs coastal states could strengthen their regional cooperation efforts using the existing soft-law structures by strengthening implementation cooperation through specific and targeted measures.

While multiple organizations have evolved over the years to address the various threats and challenges at the sub-regional level, the absence of an overarching institution that could synergize these efforts to improve wider maritime governance has hampered overall efforts. This article explains how such an 'umbrella' organization could be created to enhance maritime safety and security in the Indo-Pacific region.

Abstract:It is submitted in this article that,as the legal relationship between distressed ships not requiring a rescue of persons on board and the coastal states is ambiguous under the existing international law,it is necessary for the international society to cooperate in establishing a legal basis for ensuring that such distressed ships be accepted for entry by coastal states.Besides,it is suggested that to accept such ships under certain circumstances is in the interest of China as a coastal state who has a big fleet.
