Abstract:With the growing legal consciousness of nation,the contradiction in the clinical trials appears gradually.Researchers and subjects face many complicated problems.In that case,the clinical investigators and patients should clearly know their rights and obligations.Then,we should propose the practical ways to protect patients.There are three ways:(1) Medical Ethics Committee set up a position and the staff should track every stage of the clinical trial;(2) Regular doctor should provide professional advices to patients and let them know the effect of the clinical trial;(3) Improvement the registry of clinical trials as soon as possible.

Abstract:This article reviewed the history of hospital ethics committee construction in China and abroad,reconsidered this issue from the perspective of laws,policies,technology and doctor-patient relationship.As the article proposed,hospital ethics committee may have multi-functions,including: research ethics,clinical ethics and hospital management ethics.Various proposals were put forward for constructing of hospital ethics committees,including: establishing organization and supervision system,unifying internal management regulations and processes,implementing qualification accreditation and examination system,accelerating the training echelon of human resources.

Abstract:Abstract Background Respect for patients’ autonomy is usually considered to be an important ethical principle in Western countries; privacy is one of the implications of such respect. Healthcare professionals frequently encounter ethical dilemmas during their practice. The past few decades have seen an increased use of courts to resolve intractable ethical dilemmas across both the developed and the developing world. However, Chinese and American bioethics differ largely due to the influence of Chinese Confucianism and Western religions, respectively, and there is a dearth of comparative studies that explore cases of ethical dilemmas between China and the United States. Methods This paper discusses four typical cases with significant social impact. First, it compares two cases concerning patient privacy: the “Shihezi University Hospital Case”, in which a patient was used as a clinical teaching object without her permission, and the “New York-Presbyterian Hospital Case”, in which the hospital allowed the filming of a patient’s treatment without his consent. Second, it compares two cases regarding patient autonomy and potentially life-saving medical procedures: the “Case of Ms. L”, concerning a cohabitant’s refusal to sign a consent form for a pregnant woman’s caesarean, and the “Case of Mrs. V”, concerning a hospital’s insistence upon a blood transfusion for a dissenting patient. This paper introduces the supporting and opposing views for each case and discusses their social impact. It then compares and analyses the differences between China and the United States from cultural and legislative perspectives. Conclusions Ethical dilemmas have often occurred in China due to the late development of bioethics. However, the presence of bioethics earlier in the US than in China has not spared the US of ethical dilemmas. This paper highlights lessons and inspiration from the cases for healthcare professionals and introduces readers to the role and weight of privacy and autonomy in China and in the US from the perspectives of different cultures, religions and laws.

Abstract:The history of the development for the hospital ethics committee in domestic and abroad was discussed.At present,the hospital ethics committee has a great effect on the development of the bioethics and the clinic practice of the medicine,such as ethical review,supervision and evaluation,and consultation and coordination.However,there are also some problems in terms of the limitation the development of the hospital ethics committee,therefore,the organization structuring,the running system and the operating procedure,and the function of the hospital ethics committee should be improved in the future.

Abstract:Euthanasia has aroused lasting debates abroad and a few countries have legalized it.As it attracts more and more attention in China,this paper argues that in theory there should exist the(possibility) of legalizing euthanasia in China because it does not commit intentional homicide and in(addition it) complies with the humanistic spirit and socialist ethic.On the basis of the experience abroad and the(actual) situations in China,the legislation should pay attention to the following aspects: the object of(euthanasia) should be clarified;the subject's intention should be sincere and true;procedure should be strictly carried out and archive system should be improved.

Abstract:The authors proposed a survey on the ethics review of biomedical research involving human subjects by hospital ethics committee in 33 public hospitals in Shanghai.The results showed that most hospital ethics committees in Shanghai had detail operation procedures and requirements on initial review,expedited review,and adverse events review.However,most efforts need to be strengthening on following up review and adverse event review as well as standardize the procedures.

Abstract:In China,the subject to take the liability for medical damages is medical institutions while medical staff takes the liability only when they don't belong to any medical institutions.Doctors' duty of explanation serves for the demand of patients to know and make decisions and to a specific patient,doctors should not just give a simple explanation.If medical staff breaks the law,it means negligence and should not make a presumption of negligence.If damages are huge,medical staff should adduce no negligence,otherwise,the presumption of negligence should be adduced.Patients' right of control and decision-making of medical information should be ensured.And if medical institutions encroach this right,they should take civil liability.The second edition of Law of Tort Liability has made revisions about this.

Abstract:Objective In a new hospital,the construction of the ethics committee is also gradually evolving.This article aims to describe the current status of the ethics committee,analyze and summarize identified problems in the operation of the ethics committee,to propose a solution for better construction of ethics committee.At the same time,it can also provide certain reference for the new establishment of Ethics Committee of other institutions.Methods This paper analyzes the construction and current situation of operation of the ethics committee in detail.Results The ethics committee is running well,but there are still some problems such as management mode to be further optimized and ethical review system to be further strengthened.Conclusions The construction and capacity building of the EC is a continuing effort.On-going improvement of identified problems plays significant role in better construction of the ethics committee.

Abstract:OBJECTIVE:The objectives of this study are to understand the current functions, structure and operation of hospital ethics committees (HECs) in Shanghai and to facilitate their improvement.METHODS:(1) A questionnaire survey, (2) interviews with secretaries and (3) on-site document reviews of HECs in Shanghai were used in the study, which surveyed 33 hospitals.RESULTS:In Shanghai, 57.56% of the surveyed hospitals established HECs from 1998 to 2005. Most HECs used bioethical review of research involving human subjects as well as bioethical review or consultation regarding medical care services and administrative decision- making. Of the surveyed HECs, 14.3% did not provide any formal bioethical training to the HECs' members and many HECs had no standard operating procedures. Some HECs had no clear definition of what was "conflict of interest" that should be considered by the HECs, while 44.4% of the HECs did not perform continuing review.DISCUSSION:After the issues of related national regulations, more and more hospitals established HECs in Shanghai, but the functions of HECs need to be further developed and formal training on bioethics should be provided to HEC members. To assure the independence and good performance of HECs, the conflict of interest procedure, the standard operating procedures and bioethical review should be improved.CONCLUSION:HECs in Shanghai had developed in the preceding 10 years and they played great roles in protecting the rights and welfare of human subjects and patients; some areas need improvement.

Abstract:As doctors, we find it disturbing to read the paper "Burnout in physicians who are exposed to workplace violence" (January 2020).1 Workplace violence experienced by doctors has been documented both in developed and developing countries. Reports show that Chinese medical professionals are being injured, disabled, or even killed by patients or their family members.2,3 The killing of a doctor in Beijing in 2019 attracted national attention. China's top legislative body has approved the first fundamental and comprehensive law to protect health-care professionals. The bill will take effect on June 1, 2020. However, the law alone will not solve the problem. We need to treat it from the root and address the issues that have led to this health-care-related violence. A multi-faceted action must be launched to reduce violence against doctors in China urgently.

Abstract:In the Hospitals-patients compelling legal relationship, the Government assigns by law the power of coercive treatment to the Medical Institutions (involving only public hospitals) in light of the special nature of medical treatment and the purpose of safeguarding citizen's lives and health. The patients are forced to be isolated and treated and they must accept it consciously. The rights and obligations of two parties are apparently unequal. The medical institutions are more predominant while patients assume submissive roles. It is a kind of rights and obligations relationship between specific institutions and specific citizens with specific identities, based on special legal circumstances and for special purposes. Theoretically such administrative legal relationship is known as special power relationship among Continent Law System countries.In such legal relationship, the medical institutions act the part of administrative body. Current administrative bodies in our country mainly include administrative institutions and legally authorized organizations. In reality there exist a large number of enterprises and social groups which still have administrative functions. It is much proper to define such enterprises and social groups as "Public Corporation". This definition allows medical institutions to answer the outbreak of public sanitation emergencies calmly. On the other hand by referring to the definition we can perfect our administrative body system and advance the establishment of administrative law.In the Hospitals-patients compelling legal relationship, a series of rights and obligations of medical institutions caused by compelling relationships should be added to the law, thus allowing medical institutions to answer the outbreak of public sanitation emergencies calmly in accordance with their legal duties and rights so as to control the contagion effectively and ensure the healthy status of people.

Abstract:This paper aims to provide policy recommendations for health legislation in China considering spe-cific political, social and economic local conditions, through reviewing and analysing the status and common charac-teristics of health legislation and historical development in respective countries, and summarizing experiences and les-sons learnt. Most industrialized countries have the common political value that government has the final responsibility of securing universal access to essential healthcare regardless of geographic and economic restraints. Health legislation in each country experienced multiple reforms in concurrence with political evolution. All countries with public domina-ted health financing systems have private health insurance and private healthcare services, few of their service deliv-ery systems are privately dominated. All countries have been towards the way to build an integrated health service de-livery system. Appropriate and stable health financing system has been established to be in line with the economic de-velopment and national income level. As an overarching law for the health sector, the Essential Health Law should clearly define the fundamental orientation, the essential value and the basic framework of health issues with more maro-perspective and higher level point of views. It should highlights the core political value that, government should take the final responsibility of securing universal access to essential healthcare and medicines regardless of differences in gender, age, religion, social class and financial capacity.

Abstract:In this paper, the evolution of the ethics committees for health research, their history, membership, and function in China and Australia is described. Investigators in each country compared the history and governance of their ethical systems based on the published evidence rather than personal opinions. Similarly, examples of challenges were selected from the literature. In both countries, the aim was to maximize the social benefits of research and minimize the risk imposed on the participants. Common challenges include maintaining independence, funding and delivering timely ethical reviews of the research projects. These challenges can be difficult where research ethics committees rely on voluntary contributions and lack a strong resource base. They must adapt to the increasingly rapid pace of research as well as the technological sophistication. Population health research can challenge the conventional views of consent and privacy. The principles of the sound ethical review are common in both countries; governance arrangements and operational procedures, however, can differ, reflecting the cultural values and norms of their host countries and in respect of legal environments. By studying the evolution and function of ethics committees in the two countries, we established the differences in the governance and health systems, while similar ethical objectives helped sustain collaborative research.
