Understanding medical corruption in China: a mixed-methods study

Abstract:Medical corruption is a significant obstacle to achieving health-related Sustainable Development Goals. However, the understanding of medical corruption is limited, especially in developing countries. As the largest developing country, China is also plagued by medical corruption. By employing a mixed-methods design and combining data from three resources, this study attempts to examine patterns of medical corruption in China, explore its key drivers and investigate the perceived effectiveness of recent anti-corruption interventions. Using extracted data from 3546 cases on the China Judgments Online website between 2013 and 2019, we found that bribery, embezzlement and insurance fraud accounted for 68.1%, 22.8% and 9.1% of all medical corruption cases, respectively. Bribery was the major form of medical corruption. Approximately 80% of bribe-takers were healthcare providers, and most bribe-givers were suppliers of pharmaceuticals, medical equipment and consumables. Using a nationally representative household survey, we further found that the prevalence of informal payments from patients remained at a low level between 2011 and 2018. In 2018, only 0.4% of outpatients and 1.4% of inpatients reported that they had ever given 'red envelopes' to physicians in the past. Finally, we conducted interviews with 17 key informants to explore drivers of medical corruption and investigated the perceived effectiveness of recent anti-corruption interventions in China. Interview results showed that financial pressure and weak oversight were two main reasons for corrupt behaviours. Interview results also suggested that the anti-corruption campaign since 2012, the national volume-based procurement, and the special campaign against medical insurance fraud had reduced opportunities for medical corruption, implying China's positive progress in combating medical corruption. These findings hold lessons for anti-corruption interventions in China as well as other developing countries.

Abstract:Abstract In recent years China has witnessed a surge in medical disputes, including many widely reported violent riots, attacks, and protests in hospitals. This is the result of a confluence of inappropriate incentives in the health system, the consequent distorted behaviors of physicians, mounting social distrust of the medical profession, and institutional failures of the legal framework. The detrimental effects of the damaged doctor–patient relationship have begun to emerge, calling for rigorous study and serious policy intervention. Using a sequential exploratory design, this article seeks to explain medical disputes in Chinese public hospitals with primary data collected from Shenzhen City. The analysis finds that medical disputes of various forms are disturbingly widespread and reveals that inappropriate internal incentives in hospitals and the heavy workload of physicians undermine the quality of clinical encounters, which easily triggers disputes. Empirically, a heavy workload is associated with a larger number of disputes. A greater number of disputes are associated with higher-level hospitals, which can afford larger financial settlements. The resolution of disputes via the legal channel appears to be unpopular. This article argues that restoring a healthy doctor–patient relationship is no less important than other institutional aspects of health care reform.

Abstract:The bribery behavior of multinational corporations in China is characterized by the fact that the subjects of bribery are mostly world-renowned multinational corporations, and the objects of bribery gradually penetrate government officials. The means of bribery are more covert and more difficult to be detected and handled, and bribery involves the key fields of medicine, energy equipment, telecommunication, and finance. The reasons for the occurrence of bribery by Multinational corporations in China include the imperfect legal system, the punitive measures of giving bribes lightly and receiving bribes heavily, and the cultural system differences. In order to effectively strengthen the governance of the problem of active bribery of multinational corporations, it is necessary to strengthen theoretical legal research, analyze in depth the characteristics of the law of bribery crimes, amend and improve criminal laws in a timely manner, increase the efforts to combat the crime of active bribery. And strengthen international cooperation in combating the problem of active bribery of multinational corporations. Therefore, this paper identifies common multinational corporations’ behavioral tactics characteristics as well as feasible measures by examining the issue of multinational corporations’ bribery.
Negotiating Shanghai Mercy Hospital: Philanthropy, Business and Control of Madness in Republican China

Abstract:This study examines the initiation and administration of Mercy Hospital in Republican Shanghai. It explains the protracted negotiations that underpinned the collaboration between the Chinese founder Lu Bohong, the Shanghai Municipal Council (SMC) of the International Settlement and the Municipal Administration (FMA) of the French Concession. Despite mutual needs for a psychiatric hospital, the collaboration was undermined by disputes over funding shares and administrative direction. While Lu expected a symbolic modern philanthropy, the SMC and FMA saw it as an economic tool to relieve the responsibility of regulating refugees and the increasing mental patients. They repeatedly forced Lu to make concessions with financial instruments, but ended up non-cooperation, leading the patrons to compromise to keep their problem solver. However, after Lu's murder and the subsequent dysfunction of the Chinese municipal government, the SMC and FMA could not help but take on this task to protect their settlements from the threat.

Medical Malpractice and Hospitals' Response: A Patients' Perspective

Abstract:Objective To understand the patient's logical behavior when faced with medical malpractice and explore the proper approaches for hospitals.Method From five different hospitals,500 patients were surveyed using self-designed case tools(Vignette questionnaire).Result When dealing with medical malpractice,patients tended to continuously complaint to hospitals to seek a solution,and hoped to get early response.When faced with medical malpractice,they were most satisfied with the response that the hospital had made detailed explanations,comforted,apologized,and promised to share a small part of medical expenses;When hospitals beard the main responsibility,Patients tended to appeal to the court to seek a solution,while the ratio of patients who choose to make trouble with the hospital was less than 5% and there was no statistically significant between the two situations.The expected monetary compensation in Case one was significantly higher than the other.Conclusions Whether patients are satisfied with the attitude and solutions of hospitals is a significant factor in the development of medical malpractice.Hospitals should give reasonable explanations,account for their action,comfort patients and share some medical expenses;Patients' severity of suffering and the ratio of the responsibility are predictive of the monetary compensation.
The weakness of the strong: Examining the squeaky-wheel effect of hospital violence in China

Abstract:Hospital violence has become a worldwide issue that disturbs health care systems. China is in a particular dilemma between meeting the healthcare demand of 1.39 billion residents and ensuring the safety of 12.3 million health professionals. Drawing on data from an administrative survey, we presented the types and distribution of disruptive behaviors, as well as the summary statistics of 225 medical disputes that took place from 2012 to 2013 in Z city. Logit and OLS regression analyses show that disruptive behaviors, characterized by the number of protest participants and the length of protest, can significantly predict whether the claimant receives compensation and the amount of compensation. All else equal, a one-person increase in the number of participants is associated with 3.94% higher odds of getting compensated, whereas a one-day increase in the length of protest is associated with a 1.03% increase in the odds of receiving compensation. Further analyses show that the link between disruptive behaviors and compensation outcomes is due to the involvement of the state, which tends to press hospitals to pay when substantial violence is present. Chinese government's overwhelming emphasis on social stability gives protestors leverage against hospitals, which can be summarized as "the squeaky wheel gets the grease." Ironically, the sensitivity of Chinese government towards social stability becomes a weakness of its own. Government's active intervention to reach a peace-oriented goal will incentivize patients to resort to violence in pursuit of compensation. This study has implications for understanding the Chinese government's logic of addressing social problems that range from hospital violence, labor disputes, land disputes to demolition compensation and civil petitions.

Abstract:Both public and academic scrutiny of the financial relationships between the medical device industry and the healthcare society occur less frequently than those involving the pharmaceutical industry, and Japan is no exception to these shortcomings. This paper examines the ethical and legal challenges inherent in Japan's medical device industry through the lens of bribery scandals, placing these issues within the broader context of global healthcare corruption. It aims to derive lessons and suggest universal strategies for ethical and legal enhancements. The discussion includes two notable cases: one involving inappropriate transactions between a cancer center and a biliary stent manufacturer, and another concerning a corrupt donation scheme between a medical device company and a university's anesthesiology department, which was found guilty. In our analysis, we also acknowledge the industry's efforts toward compliance and reform to maintain a balanced perspective. The analysis not only highlights the unique culture and structure of the Japanese medical device industry, such as the exploitation of flexible pricing and opaque financial practices but also contrasts these issues with the tightly regulated pharmaceutical industry. This approach reveals both sector-specific challenges and common corruption drivers, enhancing our understanding of why such scandals occur and persist. We propose ethical and compliance-focused business measures such as centralizing donation decisions, limiting the financial independence of marketing divisions, and increasing transparency, alongside adopting mandatory disclosure practices based on successful models from the United States and Europe. By emphasizing integrity and presenting diverse perspectives, this study aims to elevate ethical and legal standards in the medical device industry and improve patient health outcomes worldwide.

Abstract:Object To standardize hospital high-value consumables purchasing procedure to eliminate corruption.Methods The deficiencies of some tertiary Grade A hospital were analyzed in high-value consumables purchasing, and some suggestions based on foreign countries' achievements were proposed including completing high-value consumables purchasing procedure and making anti-corruption efforts in medical institutions.Results It's suggested that high-value consumables management system be completed, admission qualification management and purchasing procedure be standardized and supervision mechanism be established in the hospital.Conclusion Improved high-value consumables purchasing procedure contributes to anti corruption in medical institutions.

Abstract:The Chinese government is making unprecedented efforts to curb corruption resulting in several high profile prosecutions involving local and foreign businesses. Accordingly, we examined the influence of national culture on the intolerance of bribery, based on the premise that bribery is more intolerable when it is committed by the actor seen as more agentic in a given culture. As predicted, Studies 1a, 1b, and 2 found that the Chinese were more intolerant of organizational bribery than individual bribery, whereas just the opposite was true among Americans. Further supporting our reasoning, Study 2 showed that these cross-cultural differences were mediated by participants' tendencies to make internal attributions for the bribe payers' behavior. Study 3 found that when Chinese or American culture was primed, bicultural participants showed analogous reactions, but only when they believed their two cultural identities to be compatible (rather than conflicting) with each other. Abstract:The paper analyzed the internal causes of the corruption risk control mechanism at public hospitals in China. Based on the current development of such mechanism, the authors proposed such measures as pre-warning, intermediate supervision and follow-up actions against the corruption risk exposure commonly found at such hospitals. These efforts aim at further improvement of the corruption risk control of the hospitals.

Abstract:The mechanism by way of self remedy lack of objective evaluation of professional medical, medical law problems of medical disputes, resulting in many medical disputes cannot be solved the objective and fair. There is no uniform opinion medical circles on such terms. Abstract:According to the data of report on hospital violence investigation, the awareness and attitude on hospital violence in view of hospital, medical staff and patient are analyzed. It shows that the main inducement of hospital violence event is the huge gap between actual treatment result and patient’s expectation. The deep level cause is the overmuch of social contradictions accumulation. Both of hospital and patient think that the main responsibility body of violence event is hospital and patient. Most of the investigated think vicious event belongs to criminal offence. 96.8%of the medical staff negates hospital violence. According to the analysis, suggestions are presented.
