Abstract:In the crime of stipulated potential damage and actual damage simultaneously,there are various theories on the problem of whether there is discontinuation after the emergence of a legal dangerous state and on the relationship between the potential damage offense and the actual damage offense.In fact,because of the unique criminal intention which directs to the actual damage,the potential damage offense is not an independent criminal pattern but a provision of penalty which is to restrict the apply of penalty,including the attempted and the discontinued pattern of the actual damage offense.Therefore,although it is a discontinuation of the actual damage crime in nature,it can be punished according to the statutory sentence of the potential damage offense only.
