“Causing Damages” in Discontinuation of a Crime

Abstract:"Causing damages"in discontinuation of a crime refers to the behaviors have constituted a misdemeanor at the time of satisfying the establishment conditions of discontinuation of a crime.The behaviors of "causing damages"must be the criminal behaviors before discontinuation rather than the behavior of discontinuation.No matter the relationship between misdemeanor and felony,the discontinued criminal of felony,who constitutes a misdemeanor due to "causing damages",should be deemed as the discontinued criminal of felony.At the time of reducing a penalty for the discontinued criminal of"causing damages",the relation between the reduced punishment and the statutory sentence for misdemeanors should also be considered.
