On Emphasizing both the Procedural Justice and the Substantive Justice: As Viewed from the Criminal Judicature

Abstract:The procedural justice and substantive justice have their respective connotations and independent criterions. The value of procedural justice consists in the instrumental value that guarantees the substantive merits, the independent and terminative value, and value of increasing the acceptability of the substantive result of a case. The notion that pays equal attention to the procedural justice and the substantive justice should be emphasized that the dynamic and dialectic balance between two aspects should be maintained and their value orientations should be adjusted appropriately according to the actual situation. None of them should be considered more important, and the conception of procedure-standard should not be advocated.
