Abstract:In the Hospitals-patients compelling legal relationship, the Government assigns by law the power of coercive treatment to the Medical Institutions (involving only public hospitals) in light of the special nature of medical treatment and the purpose of safeguarding citizen's lives and health. The patients are forced to be isolated and treated and they must accept it consciously. The rights and obligations of two parties are apparently unequal. The medical institutions are more predominant while patients assume submissive roles. It is a kind of rights and obligations relationship between specific institutions and specific citizens with specific identities, based on special legal circumstances and for special purposes. Theoretically such administrative legal relationship is known as special power relationship among Continent Law System countries.In such legal relationship, the medical institutions act the part of administrative body. Current administrative bodies in our country mainly include administrative institutions and legally authorized organizations. In reality there exist a large number of enterprises and social groups which still have administrative functions. It is much proper to define such enterprises and social groups as "Public Corporation". This definition allows medical institutions to answer the outbreak of public sanitation emergencies calmly. On the other hand by referring to the definition we can perfect our administrative body system and advance the establishment of administrative law.In the Hospitals-patients compelling legal relationship, a series of rights and obligations of medical institutions caused by compelling relationships should be added to the law, thus allowing medical institutions to answer the outbreak of public sanitation emergencies calmly in accordance with their legal duties and rights so as to control the contagion effectively and ensure the healthy status of people.
