Abstract:In February 2013, the law on the improvement of the rights of patients enacted a whole series of legal regulations for different areas of health care. In terms of physician liability, the Patient Rights Act and the introduction of sections 630a-h in the Civil Code (BGB) brought a transparency-oriented representation of general contractual aspects, a comprehensive legal regulation regarding patient education and consent, standardization of the treatment documentation, and a new basis for the right of access to the treatment file. The specificities of the treatment contract developed in the framework of supreme judicial jurisprudence were translated into legal form, and the presumed facts known from established case law and considered favorable to the patient under certain conditions were then summarized as exceptions to the principle of the objective burden of proof. In this paper the regulations in the new sections 630a-h of the Civil Code are presented and examined with regard to the consequences to be taken into account by the medical expert in the physician liability process.

Abstract:The Authors review Law No. 219/2017, with its important contribution to defining the roles and responsibilities of subjects in care relationship – a dynamic relationship (over time, for the condition of the interested party, to people who may be involved) – and regulating advance directives and shared planning of care. The Law promotes and enhances the relationship of care and trust between doctor and patient, which includes the competence, professional autonomy and responsibility of the doctor and the decisional autonomy and right to self-determination – to make an informed and voluntary choice about treatment proposed by the doctor - of the patient. For concrete implementation of the Law, an adequate information system and all the measures to guarantee certainty about the consequences of behaviour and protection of the rights of all the subjects involved are now essential. In addition, for advance directives, it is essential to reflect on the adequacy of medical information required by the Law itself for its drafting, considering that the citizen can contact qualified professionals and also independently find this information autonomously, selecting the sources of information.

Abstract:Objective: Introduction: Human life and health are considered to be of the highest social value, with particular emphasis on health care. However, the patient's rights are pretty often violated by medical professionals. According to statistics, a medical error is recognized as one of the most common causes of patient's rights violations in Europe and the United States. That's why the research of jurisdictional mechanisms of patients' rights protection in the context of medical error, seems particularly relevant. The aim: To propose the effective jurisdictional mechanisms of the patients' rights affected by medical error protection and to summarize scientific approaches for understanding the essence of medical error. Patients and methods: Materials and methods: The research used a set of general scientific and special methods of scientific cognition, in particular, dialectical; comparative legal; analysis and synthesis; formal-logical (dogmatic); statistical and generalization. The empirical base of the study is the statistics of the Prosecutor General's Office of Ukraine and the State Judicial Administration of Ukraine within 2014-2018, generalization of the practice of the Constitutional Court of Ukraine, as well as statistics in the field of protection of patients' rights of some countries of Europe, USA and Japan, as well as the authors' own experience who serve as a judge and a judge assistant of the Supreme Court, a judge of the Constitutional Court of Ukraine. Results: Results: It is argued that the most effective jurisdictional mechanisms for protecting the patients' rights affected by a medical error include: criminal, civil and constitutional ones. Summarizing national and foreign positions of scholars and practitioners, four main approaches to the interpretation of the "medical error" concept are highlighted. Conclusion: Conclusions: In order to protect the patients' rights adequately, including those affected by a medical error, the state must guarantee the right of access to jurisdictional protection mechanisms, as well as establish a system of non-jurisdictional mechanisms for the protection of health rights.
Multilevel governance framework on grievance redressal for patient rights violations in India

Abstract:The notion of patient rights encompasses the obligations of the state and healthcare providers to respect the dignity, autonomy and equality of care-seeking individuals in healthcare processes. Functional patient grievance redressal systems are key to ensuring that the rights of individuals seeking healthcare are protected. We critically examined the published literature from high-income and upper-middle-income countries to establish an analytical framework on grievance redressal for patient rights violations in health facilities. We then used lawsuits on patient rights violations from the Supreme Court of India to analyse the relevance of the developed framework to the Indian context. With market perspectives pervading the health sector, there is an increasing trend of adopting a consumerist approach to protecting patient rights. In this line, avenues for grievance redressal for patient rights violations are gaining traction. Some of the methods and instruments for patient rights implementation include charters, ombudsmen, tribunals, health professional councils, separating rules for redressal and professional liability in patient rights violations, blame-free reporting systems, direct community monitoring and the court system. The grievance redressal mechanisms for patient rights violations in health facilities showcase multilevel governance arrangements with overlapping decision-making units at the national and subnational levels. The privileged position of medical professionals in multilevel governance arrangements for grievance redressal puts care-seeking individuals at a disadvantaged position during dispute resolution processes. Inclusion of external structures in health services and the healthcare profession and laypersons in the grievance redressal processes is heavily contested. Normatively speaking, a patient grievance redressal system should be accessible, impartial and independent in its function, possess the required competence, have adequate authority, seek continuous quality improvement, offer feedback to the health system and be comprehensive and integrated within the larger healthcare regulatory architecture.

Abstract:The progress in medicine has contributed to the fact that for 50 years life expectancy in Germany has increased by three to four years per decade. The number of older people has considerably increased and at the same time there has been a decline in the birthrate with the effect that the portion of the people over 60 years, now a quarter of the population, will rise to a third of the population in 2040. The dual relationship between patient and physician has changed due to the extension of the statutory health insurance to more than 90% of the population. Today collective contracts made with the statutory health insurance determine the preconditions for entitlement, but often with uncertain legal concepts. The expenditure which occurred due to the demographic and epidemiologic changes caused the limitations of the contribution rates by the legislator. The health insurance funds have implemented further regementations by means of health care duties and action for recourse in case of exceeding the budget. Thus the politically intended limitation of the resources can bring the physician in a decision emergency condition or even in an ethical dilemma. He has to observe legal rules, especially in the field of the criminal law and the liability law. Thus the financial, organizational and structural deficits in the health care system that are resulting from the social legislation are shifted by means of the liability law to the individual physician or to other service providers. Even treatment guidelines cannot protect them from this because the "standard patient" does not exist. What we really need are appropriate reforms including adjustments of the insurance structures which offer the insured alternatives: Expansion of the financial elements of the statutory health insurance Adjustments of the health care structures with integration between the outpatient and inpatient sector Restriction of the legislator to the definition of framework provisions and service limits Orientation of the health care necessities to the health care needs of the patients Economy must not dominate over humanity Adjustment of the social legislation and the liability law Settlement of the details by the joint self-administration of physicians and health insurance funds.
Federal and Provincial Responsibilities to Implement Physician-Assisted Suicide

Abstract:In the most significant constitutional decision of the last generation, Carter v. Canada, the Supreme Court of Canada reversed itself and decided that it was possible for Parliament to enact safeguards that would be adequate to protect persons who are vulnerable in times of weakness, then proceeded to declare that Canadians were entitled to a s. 7 Charter right to physician-assisted death. David Baker and Gilbert Sharpe accepted the challenge issued by the Court and drafted a Bill to amend the Criminal Code in a manner they believed would strike a constitutional balance between providing access to the right declared by the Court and protecting the vulnerable. This article represents their attempt, along with co-author Rebeka Lauks, to explain many of the key provisions in their draft. Amongst the most noteworthy are their attempts to ensure that those choosing PAD are informed about quality of life, as well as treatment choices; to define vulnerability and to install safeguards adequate to protect persons while vulnerable; and finally a prior review process that would ensure both ready access to the Charter right declared by the Court and consistent and transparent application of the law. The authors have attempted to establish an alternative model to that currently in effect in the Benelux countries, which they regard as having been ineffective in achieving any of these objectives.

Abstract:Abstract Background According to EU policy, anyone in need of palliative care should be able to have access to it. It is therefore important to investigate which palliative care topics are subject to legislation and regulations in Europe and how these are implemented in (national) health care plans. This paper aims to deliver a structured overview of the legislation, existing regulations and the different health care policies regarding palliative care in seven European countries. Methods In 2008 an inventory of the organisation of palliative care was developed by the researchers of the Europall project. Included were two open questions about legislation, regulations, and health policy in palliative care. This questionnaire was completed using palliative care experts selected from Belgium, England, France, Germany, the Netherlands, Poland and Spain. Additionally, (grey) literature on palliative care health policy and regulations from the participating countries was collected to complete the inventory. Comparative analysis of country specific information was performed afterwards. Results In all countries palliative care regulations and policies existed (either in laws, royal decrees, or national policies). An explicit right to palliative care was mentioned in the Belgium, French and German law. In addition, access to palliative care was mentioned by all countries, varying from explicit regulations to policy intentions in national plans. Also, all countries had a national policy on palliative care, although sometimes mainly related to national cancer plans. Differences existed in policy regarding palliative care leave, advance directives, national funding, palliative care training, research, opioids and the role of volunteers. Conclusions Although all included European countries have policies on palliative care, countries largely differ in the presence of legislation and regulations on palliative care as well as the included topics. European healthcare policy recommendations should support palliative care access across Europe.

EVIDENCE-BASED MEDICINE AS PATIENT'S PROTECTION MEASURE IN JUDICIAL PRACTICE

Abstract:Objective: The aim: To identify the role of evidence-based medicine, its principles and approaches to patients' rights protection and the provision of medical service optimization, the skills of medical staff improvement, increasing the objectivity of court decisions in cases of non-providing quality care or death. Patients and methods: Materials and methods: The authors used the decisions by the European Court of Human Rights (ECtHR) on the statements of victims of unprofessional actions by doctors, international and domestic regulations on patients' rights, statistics on the results of criminal proceedings on violations of patients' rights over the past 5 years, case law of criminal and civil jurisdiction in this category of cases, the results of surveys of prosecutors, as well as the results of research by scientists in the field of medical law and criminalistics. The research is carried out on the basis of a harmonious combination of philosophical approaches, general scientific and special methods of scientific knowledge, the complex of which is chosen taking into account the goals and objectives, object and subject of research. Conclusion: Conclusions: In order to implement the patients' rights by legal means in accordance with the Convention for the Protection of Human Rights and Fundamental Freedoms, the European Charter of Patients' Rights and other international regulations in the field of medicine, the authors argue the need for greater implementation of evidence-based medicine into the practice of medical institutions as a means of improving the level of medical care and an obvious source of relevant information for litigation to protect the rights of patients and doctors. For patients' rights protection in the diagnosis and treatment of diseases, it is proposed to regulate a set of such measures: 1) to include in the educational programs of pharmacy and medicine such disciplines as «Evidence-Based Medicine» and «Rights of the patient and medical worker's rights»; 2) to oblige the doctor to explain to the patient or to his/her representative the differences of treatment protocols, to provide information to patients about official sources, which contain information on unified and updated treatment protocols and diagnosis of certain diseases, to obtain informed consent by the patient (his/her representative) on certain medical guideline; 3) to recognize medical guidelines as sources of law in criminal and civil proceedings as a kind of benchmarks for clarifying and assessing the facts of non-performance or improper performance of professional duties by a medical or pharmaceutical worker, violation of patients' rights, as well as means for doctors' legal protection and etc.

Abstract:In the Hospitals-patients compelling legal relationship, the Government assigns by law the power of coercive treatment to the Medical Institutions (involving only public hospitals) in light of the special nature of medical treatment and the purpose of safeguarding citizen's lives and health. The patients are forced to be isolated and treated and they must accept it consciously. The rights and obligations of two parties are apparently unequal. The medical institutions are more predominant while patients assume submissive roles. It is a kind of rights and obligations relationship between specific institutions and specific citizens with specific identities, based on special legal circumstances and for special purposes. Theoretically such administrative legal relationship is known as special power relationship among Continent Law System countries.In such legal relationship, the medical institutions act the part of administrative body. Current administrative bodies in our country mainly include administrative institutions and legally authorized organizations. In reality there exist a large number of enterprises and social groups which still have administrative functions. It is much proper to define such enterprises and social groups as "Public Corporation". This definition allows medical institutions to answer the outbreak of public sanitation emergencies calmly. On the other hand by referring to the definition we can perfect our administrative body system and advance the establishment of administrative law.In the Hospitals-patients compelling legal relationship, a series of rights and obligations of medical institutions caused by compelling relationships should be added to the law, thus allowing medical institutions to answer the outbreak of public sanitation emergencies calmly in accordance with their legal duties and rights so as to control the contagion effectively and ensure the healthy status of people.
Legislating for universal access to medicines: a rights-based cross-national comparison of UHC laws in 16 countries

Abstract:Universal health coverage (UHC) aims to ensure that all people have access to health services including essential medicines without risking financial hardship. Yet, in many low- and middle-income countries (LMICs) inadequate UHC fails to ensure universal access to medicines and protect the poor and vulnerable against catastrophic spending in the event of illness. A human rights approach to essential medicines in national UHC legislation could remedy these inequities. This study identifies and compares legal texts from national UHC legislation that promote universal access to medicines in the legislation of 16 mostly LMICs: Algeria, Chile, Colombia, Ghana, Indonesia, Jordan, Mexico, Morocco, Nigeria, Philippines, Rwanda, South Africa, Tanzania, Turkey, Tunisia and Uruguay. The assessment tool was developed based on WHO's policy guidelines for essential medicines and international human rights law; it consists of 12 principles in three domains: legal rights and obligations, good governance, and technical implementation. Relevant legislation was identified, mapped, collected and independently assessed by multi-disciplinary, multi-lingual teams. Legal rights and State obligations toward medicines are frequently codified in UHC law, while most good governance principles are less common. Some technical implementation principles are frequently embedded in national UHC law (i.e. pooled user contributions and financial coverage for the vulnerable), while others are infrequent (i.e. sufficient government financing) to almost absent (i.e. seeking international assistance and cooperation). Generally, upper-middle and high-income countries tended to embed explicit rights and obligations with clear boundaries, and universal mechanisms for accountability and redress in domestic law while less affluent countries took different approaches. This research presents national law makers with both a checklist and a wish list for legal reform for access to medicines, as well as examples of legal texts. It may support goal 7 of the WHO Medicines & Health Products Strategic Programme 2016-30 to develop model legislation for medicines reimbursement.

Abstract:In order to create a well-functioning internal market for Artificial Intelligence (AI)-systems, the European Commission recently proposed the Artificial Intelligence Act. However, this legislative proposal pays limited attention to the health-specific risks the use of AI poses to patients’ rights. This article outlines that fundamental rights impacts associated with AI such as discrimination, diminished privacy and opaque decision-making are exacerbated in the context of health and may threaten the protection of foundational values and core patients’ rights. However, while the EU is facilitating and promoting the use and availability of AI in the health sector in Europe via the Digital Single Market, it is unclear whether it can provide the concomitant patients’ rights protection. This article theorises the Europeanisation of health AI by exploring legal challenges through a patients’ rights lens in order to determine if the European regulatory approach for AI provides for sufficient protection to patients’ rights.
Multi-level protection of rights: India's Mental Healthcare Act, 2017 and the United Nations' Convention on the Rights of Persons with Disabilities (Articles 12 and 14)

Abstract:Mental health law is a feature of mental health systems around the world, so legislative reform is an important way to advance compliance with the United Nations' Convention on the Rights of Persons with Disabilities (CRPD). This paper provides an overview of India's Mental Healthcare Act, 2017 in the context of Articles 12 ('Equal recognition before the law') and 14 ('Liberty and security of person'). Notwithstanding the potential of law to produce change, exclusive or disproportionate emphasis on law draws attention from other areas in need of equal if not greater reform, such as public education, mental health services, physical healthcare, social care networks, criminal justice systems, and gathering political backing for the profound reforms needed to transform the socio-economic landscapes in which mental illness develops, diagnoses are made, treatment is provided (or not provided), recovery occurs (or does not occur), and social citizenship is protected and promoted (or eroded and obstructed). There is a particular issue with misunderstandings of psychiatry in academic discussions of mental health legislation which appears to stem from lack of engagement with the full diversity of service-user views and the evidence base for psychiatric care. Greater recognition of upstream factors that shape both suffering and services would acknowledge that the decisions of politicians and service managers have a much greater impact on rights, especially the right to treatment and support, than the decisions of individual clinicians whose options are often very limited at the level of individual care. India's legislation seeks to address not only individual-level care, but also this higher level of reform through its articulation of an explicit 'right to access mental healthcare and treatment'. Similar multi-level legislative reform elsewhere would increase cooperation from all stakeholders, improve compliance with the CRPD, and help move towards zero coercion in mental health services.
Litigating the right to health: what can we learn from a comparative law and health care systems approach

Abstract:This article presents research demonstrating that the right to health plays different roles in different types of health systems. In high-income countries with tax-funded health systems, we usually encounter a lack of an enforceable right to heath. In contrast, rights play a more significant role in social health insurance/managed competition systems (which are present in a mixture of high-income and middle-income countries). There is concern, for example in Colombia, that a high volume of rights litigation can challenge the very sustainability of a public health care system and distort resources away from those most in need. Finally, in middle-income countries with big gaps between a poor public health system and a rich private one, we are more likely to find an express constitutional right to health care (or one is inferred from, for example, the right to life). In some of these countries, constitutional rights were included as part of the transition to democracy and an attempt to address huge inequities within society. Here the scale of health inequities suggests that courts need to be bolder in their interpretation of health care rights. We conclude that in adjudicating health rights, courts should scrutinize decision-making through the lens of health equity and equality to better achieve the inherent values of health human rights.
Legal Protection for Victims of Medical Malpractice during the COVID-19 Pandemic: A Study on Legislation

Abstract:This study examines the forms of legal protection available for victims of medical malpractice. This study uses normative legal research with a statute approach. The collected legal material is then qualitatively analyzed to describe the problem and answer the study objectives. The results show that the complexity of health service provision during the COVID-19 pandemic increases the risk of errors and medical malpractice. The Government has established a series of legal protections, including civil, criminal, and administrative, to facilitate victims of medical malpractice claim their rights. Civil legal protection ensures patients’ rights to seek compensation through out-of-court dispute resolution, such as negotiation, mediation, and arbitration. Meanwhile, criminal legal protection regulated punishments such as imprisonment or a fine for doctors proven guilty of medical malpractice. On the other hand, administrative legal protection provides a complaint mechanism for patients, ensuring that the Government and Honorary Council will impose administrative sanctions on doctors proven guilty of medical malpractice. Therefore, it is recommended that the Government continue strengthening and enhancing public awareness regarding patients’ rights and the available legal protection mechanisms, especially during the COVID-19 pandemic. This role is crucial for empowering the community to protect themselves from potential medical malpractice. Furthermore, healthcare personnel should be given maximum support through adequate facilities and equipment provision, as well as capacity enhancement through ongoing training and education, to enable them to provide optimal health services in the face of this pandemic challenge. In addition, there needs to be a strengthening of the monitoring system and legislation to prevent and effectively handle medical malpractice cases.

Abstract:The hospital's legal responsibility to fulfill the patient's rights cannot be separated from the hospital's obligations to the patient, according to the law. This is governed by the Health Law, the Hospital Law, and the Law on Medical Practice. Various statutory provisions were also applied during the Covid-19 pandemic, which was declared a public health emergency, including the Infectious Disease Outbreak Law, the Health Quarantine Law, Presidential Decree No. 11 of 2020 concerning the Determination of the Corona Virus Disease 2019 (Covid-19) Public Health Emergency, and Permenkes No. 4 of 2018 concerning Hospital Obligations and Patience. In practice, the growing number of Covid-19 cases in Indonesia has resulted in hospitals being unable to accommodate patients in need of treatment, particularly those with severe and critical conditions who require intensive care units. With bed occupancy rates (BOR) exceeding 85 percent in almost all hospitals, the community must understand that hospitals must prioritize care for patients with moderate, severe, or life-threatening conditions. In any case, the Covid-19 pandemic had an effect on the quality of hospital care provided to patients. The study used normative juridical research methods and empirical evidence to examine hospitals' legal responsibility for upholding patient rights during the Covid-19 pandemic. The study's findings indicate that, despite limitations in providing excellent health care to patients, hospitals must uphold patient rights to safety and security during hospitalization. As a result, it is necessary to establish a legal framework that protects the rights of health care workers and hospitals providing services to patients during this pandemic, particularly the protection of work standards, occupational health and safety standards, and labor social security standards. In terms of facilities and infrastructure, the government must assist by increasing the number of emergency hospitals to accommodate the anticipated increase in Covid-19 patients.

Abstract:The study of jurisprudence--law, legal reasoning, and the legal system--has become progressively more common in medical school curricula. Familiarity with jurisprudence helps physicians practice medicine well, collaborate productively with lawyers, and be more effective in public discourse about health care delivery. Moreover, the study of jurisprudence can help physicians polish the methods and clarify the purposes common to law and medicine. Empirical studies over the last 30 years demonstrate patterns of change in the frequency and focus of jurisprudence teaching in medical school curricula that can guide contemporary efforts to devise or refine curricula in medical jurisprudence. The general goal of such curricula should be to enhance physicians' clinical, institutional, and public effectiveness. These curricula should adhere to principles of sound pedagogy and be based on informed answers to the central questions of what should be taught, when, how, and by whom, and how the curriculum should be evaluated. Developing skills and changing attitudes are more important than imparting information about particular doctrines and laws. Curriculum planners should take into account the intellectual styles of the learners; integrate, not just coordinate, the new courses with the rest of the curriculum; build on features that medicine and law share and where they collaborate; and ensure intra- and inter-curricular coherence and continuity. Even though limitations of time, people, and money and differences in educational goals will influence what, when, and how medical jurisprudence is taught, the effort should be made if physicians are to be better empowered to use the law and their law colleagues to serve patients and promote public welfare.

Abstract:The law regulating medical end-of-life decisions aims to support patients to receive high-quality health care. It does so through ensuring treatment received reflects the person's wishes and values and protecting health professionals who provide adequate pain and symptom relief even if that treatment may coincidentally hasten death. However, good decision-making is predicated by those involved, including patients themselves and those supporting patients, being familiar with the law and the role it plays in the decision-making process. This article reports on a study exploring the role that law plays in end-of-life decision-making from the perspective of terminally-ill patients, their substitute decision-makers and family members. While participants' decision-making practices were often underpinned by a legal framework, the role of the law was largely invisible. Community education is needed for the public to know their legal rights and responsibilities, and to understand that the law plays a role in supporting end-of-life decision-making.
