Abstract:But the future looks bleak for local scrutiny of health organisations The public inquiry into Mid Staffordshire NHS Foundation Trust has left few reputations undamaged. But amid the wreckage two emerge with credit: the group Cure the NHS (www.curethenhs.co.uk), set up by patients, relatives, and friends to draw attention to failings at Stafford Hospital, and a local journalist, Shaun Lintern, who gave them a public voice. The rest—boards, regulators, managers, and most doctors and nurses—failed in their professional duty, some more egregiously than others. In identifying failure it was the outsiders who proved to be the true professionals. This is a sobering conclusion, because the past decade has seen a systematic failure to involve local people effectively in the NHS. Since the abolition of the community health councils in 2002 under Tony Blair’s government, each effort to replace them has proved feebler than the last. The councils were replaced firstly by patient and public involvement forums and then, in 2005, by local involvement networks (LINks). With the unconscious irony for which NHS publications are rightly celebrated, the document setting up LINks was entitled A Stronger Local Voice . Now a new plan is afoot to replace LINks with Healthwatch, but with little evidence that any lessons have been learnt. Abstract:A trail of errors in the recruitment, management, and oversight of the high profile surgeon Paolo Macchiarini has damaged the reputation of clinical research in Sweden, an investigation has concluded.1 Macchiarini carried out three trachea transplants at the Karolinska University Hospital between 2011 and 2013, using artificial tracheas made of polymer and coated with stem cells. All went wrong: two patients died and one has been kept alive only by constant hospital care since her operation. Nigel Hawkes reports on how standardised mortality ratios at Mid Staffordshire NHS Foundation Trust came to conceal the hospital’s failings The new NHS in England aims to empower the patient and shame failing hospitals by measuring and publishing outcomes. Open data will make health providers honest and patients better able to choose between them. How simple is that? Rather too simple, to judge by evidence presented to the public inquiry into Mid Staffordshire NHS Foundation Trust, which has shown that the old NHS had ingenious ways of burnishing its outcomes and concealing its failings. Even death, the most unambiguous outcome of all, lost its sting when changes in coding practice resulted in many deaths being excluded from the calculation of hospital mortality ratios. Whether this amounted to actual dishonesty may never be determined. In his final submission Tom Kark, counsel to the inquiry, suggested that it may not be necessary for Robert Francis, the inquiry’s chair, to make any finding of fact over claims that Mid-Staffs and two other West Midlands trusts engaged in a plan to lower their apparent mortality ratios by changing the way patients were coded.1 Nor did Kark reach any firm conclusion over the suggestion that West Midlands Strategic Health Authority (SHA) sought to muddy the waters by commissioning a critical report into mortality measures, published in the BMJ, from academics known to disbelieve in the method. Both these charges were made in evidence to the inquiry by Professor Brian Jarman, the father of the hospital standardised mortality ratio (HSMR, see box), which has been used for the past decade by the health analytics company Dr Foster to compare hospital performance. Abstract:How realistic are the predictions of the Five Year Forward View ? Since he published his Five Year Forward View in October, Simon Stevens has been walking on water. The chief executive of NHS England is (temporarily) able to do no wrong. Just as Melanesian islanders attribute magical powers to charismatic outsiders, Stevens has acquired a cargo cult of his own, deliciously lampooned in a series of tweets by the journalist Andy Cowper under the hashtag #SimonStevensfacts. Here’s a sample. “Hot? Bothered? Chant NHS England three times and Simon Stevens will appear with a chilled bottle of mineral water.” Impressive, but not quite as awe inspiring as another fact unearthed by Cowper. “Simon Stevens mined the Large Hadron Collider’s 27-km particle accelerator tunnels in a lunch break, using a plastic spoon.” Joking aside, it does seem that Stevens can currently get away with things that would bring derision on the heads of ordinary folk. For example, he has redefined the intervention process designed to rescue failing NHS services as a “success regime” rather than a “failure regime” to avoid demotivation and stigma. Abstract:Following the recent condemnation of the National Health Service charging regulations by medical colleges and the UK Faculty of Public Health, we demonstrate that through enactment of this policy, the medical profession is betraying its core ethical principles. Through dissection of the policy using Beauchamp and Childress' framework, a disrespect for autonomy becomes evident in the operationalisation of the charging regulations, just as a disregard for confidentiality was apparent in the data sharing Memorandum of Understanding. Negative consequences of the regulations are documented to highlight their importance for clinical decision makers under the principles of beneficence and non-maleficence. Exploration of the principle of justice illuminates the core differentiation between the border-bound duties of the State and borderless duties of the clinician, exposing a fundamental tension.

The scrutinised organisations invest large amounts of time and energy in preparation, which is diverted away from other priorities. The verdicts issued by national inspectors have strong consequences for service providers, users, and wider society. Abstract:The six year long Infected Blood Inquiry has finally reported.1 The first of its 2,527 pages contains a quotation from the medical peer Robert Winston, who described the events being investigated as "the worst treatment disaster in the history of the NHS." The administration of unsafe blood products to people with bleeding disorders during the 1980s caused about 1,250 infections with HIV, 380 among children. Many more contracted hepatitis C, as did an estimated 26 800 people who received blood transfusions. The Inquiry's author, former High Court Judge Brian Langstaff, is clear. This could, almost entirely, have been avoided and it should have been. However, it was not just the initial mistakes. It was also the response and, later, the cover up. Abstract:BackgroundHospital boards, those executive members charged with developing appropriate organisational strategies and cultures, have an important role to play in safeguarding the care provided by their organisation. However, recent concerns have been raised over boards’ ability to enact their duty to ensure the quality and safety of care. This paper offers critical reflection on the relationship between hospital board oversight and patient safety. In doing so it highlights new perspectives and suggestions for developing this area of study.MethodsThe article draws on 10 interviews with key informants and policy actors who form part of the ‘issue network’ interested in the promotion of patient safety in the English National Health Service.ResultsThe interviews surfaced a series of narratives regarding hospital board oversight of patient safety. These elaborated on the role of trust and intelligence in highlighting the potential dangers and limitations of approaches to hospital board oversight which have been narrowly focused on a risk-based view of organisational performance. In response, a need to engage with the development of trust based organisational relationships is identified, in which effective board oversight is built on ‘trust’ characterised by styles of leadership and behaviours that are attentive to the needs and concerns of both staff and patients. Effective board oversight also requires the gathering and triangulating of ‘intelligence’ generated from both national and local information sources.ConclusionsWe call for a re-imagination of hospital board oversight in the light of these different perspectives and articulate an emerging research agenda in this area.
