Abstract:Abstract There are many different ways in which modern Corpus Linguistics can be used to enrich and broaden our understanding of legal discourse. Based on the central principle of co-occurrence and co-selection in language construction, this paper reviews current applications of Corpus Linguistics in the area of legal discourse focusing on issues ranging from phraseology, variation in legal discourse, legal translation, register and genre perspectives on legal discourse, legal discourse in forensic contexts to evaluative language in judicial settings. It revisits the notion of ‘corpus’ and it highlights the relevance of various types of legal corpora and computer tools in legal linguistic research.

Abstract:The paper encompasses such fields as language, communication, text, law in terms of legal communication. According to language, I try to define the language itself as well as the linguistic focusing mainly on accomplishments of De Saussure. Secondly, it was introduced the subject of communication and its history while taking into consideration the purpose of the paper: legal communication. Legal communication is based on juridical language and legal language. I discussed them and emphasised distinctions between them. This part of the paper, which I can describe as an introduction part, ends with an indication of the research on the field of legal communication. The second part deals in general with communication and problems concerning this matter. I paid attention to the problem of communicativeness, because this matter is not as easy to be provided in legal communication as it seems to be. I moved on to the text as a part of legal communication, its main assumptions which by scholars are perceived as unable to be fulfilled and levels of interpretation this kind of text. This topic is followed by the issue of terminology which is the key to understand the text relating to law. Then I come back to the language, however, this time I point out the command of Polish language, its culture and the language of law stressing aspects regarding correctness. I decided also to include the subject of legal translation which apart from the issues mentioned above needs the specialised knowledge. The final part presents the main thoughts and my conclusions noticing the mutual influence between presented areas as well as the general need of expanding knowledge specifically in relation to language and law.

Abstract:Abstract In the latter half of the 20th century, with the development of philosophy studies, Western jurisprudence also witnessed a linguistic turn in its field. A series of academic schools appeared consecutively, such as the school of semantic analysis, the school of new rhetoric, the school of legal interpretation, and the school of structural semiotics. Their analytical paradigms, which were skeptical of the views of legal languages in traditional theories of jurisprudence, are interdisciplinary and multidimensional in nature and characteristics. Normally, there are three methods used in the linguistic turn of Western jurisprudence, that is, the method of symbolic restoration, the method of structural and functional analysis, and the method of legal hermeneutics. Promoted by the linguistic turn, two traditions of legal semiotics also developed. One is the legal theory based on Greimasian semiotics, and the other is based on Peircean semiotics. The linguistic turn in jurisprudence still represents a breakthrough and innovation in the paradigm of legal theoretical studies, as it leads to a re-examination of language, which is no longer treated as a tool but as a philosophical afterthought in relation to the human being.

Abstract:The article is devoted to the theoretical analysis of the scientific work on the problems of linguistic features of the legal language arising at the intersection of language and law. The current problems arising from the above interaction in the state, socio-legal, professional and private spheres have been described, the issues of debate have been outlined and the need for a comprehensive approach to their further study has been substantiated. The purpose of the article is to summarise the scientific investigations carried out in the “language and law” coordinate system and to identify specific linguistic problems related to the legal language and the ways of their solution. Nowadays, modern legal linguistics has faced an acute issue of developing a special methodology which should take into account both natural language, legal linguistic and legal aspects. The article uses the method of analysis of theoretical sources relevant to the research topic, which involves the collection and extraction of scientific information belonging to the group of empirical methods of scientific knowledge, as well as processing and analysis of the data obtained, which belongs to the methods of theoretical knowledge. On the basis of a systematic analysis, the linguistic and legal research on the problem has been reviewed; the main vectors of domestic and foreign jurisprudence development with a projection on the linguistics of law have been identified; the issues of streamlining legal terminology, searching for interlingual equivalents and creating dictionaries of legal terms have been considered; the problems of combining theoretical and applied methods for qualitative linguistic examination of legal texts have been characterised; the positive and negative consequences of semantic and textual linguistic examinations of legal texts have been studied. The article discusses the debatable approaches to semantic and textual examination of legal texts, its positive and negative consequences, and substantiates the need to expand the subject area in order to create a single modern research space in the coordinate system “language and law”.
A Corpus-Based Interpretation of the Discourse–cognitive–society Triangle on Chinese Court Judgments

Abstract:A court judgment is a common legal discourse and the final carrier of court trial activities. From the perspective of socio-cognitive discourse analysis, this study aims to describe and explore the Chinese court judgments in a corpus-based method, concentrating on the interactions among discourse, cognitive, and social dimensions. We have three key findings through an empirical qualitative analysis of the court judgments in China. First, the discourse dimension of Chinese court judgments is both society-oriented and cognition-oriented. The discourse components could mark the cognition sources in court judgments. Second, the cognitive source of faith is a part of social cognition on law and regulation, and induction and paraphrase provide the personal cognition to testimony, documentary, or hearsay evidence. Besides, the cognitive source of inference could change personal cognition into a social consensus through a reasoning process. Third, the social function of court judgments corresponds to the cognitive source and builds the surface structure with various discourse components. Moreover, a probe into the multi-dimensional relationship in court judgments can offer practical insights into the interpretation of legal texts in Chinese judicial decision-making.

Abstract:While a much investigated concept because of its importance in shaping human discourse, modality has still not been given an agreed understanding. Using authentic Chinese court judgments in Hong Kong, this paper aims to unravel the complexity of modality as exemplified in its usage in the legal domain. It examines formal, semantic, and functional approaches to modality, showing their weaknesses in identifying and explaining modality in legal discourse. It proposes a socio-semiotic approach as an alternative for giving us a better understanding of modality in respect of its meaning and function in our language as a sign system.

Abstract:Abstract This is the guest editors’ introductory paper to the special issue “Situating jurilinguistics across cultures using translation and discourse approaches.” The introduction showcases the interdisciplinary vocation of jurilinguistics from its conception almost forty years ago. It is argued that jurilinguistics has achieved its current maturity by diversifying the disciplinary lenses of the originally contributing disciplines of legal translation and legal studies while keeping faithful to its original principles—facing practical problems with a rigorous outlook, venturing into any new domains that may prove enlightening, and combining professional and academic perspectives. The authors highlight how the series of conferences “Jurilinguistics: Interdisciplinary Approaches to the Study of Language and Law” have been instrumental in enhancing the scope of jurilinguistics. Finally, the articles gathered in this special issue are presented and their contributions in advancing the knowledge available for practitioners and scholars meeting at the interface between law and language are underscored.

Abstract:Law as one sign system can be recorded and interpreted by another sign system—media. If each transaction in court is taken as a sign, it can be interpreted or transferred by different signs of media for the same purpose, though with different effects. This study focuses on the transformative effects of the semiotic revolution in media on law. The present research revealed that the evolution of media has driven the administration of justice to pay more attention to the process of court proceedings. This research also discusses the semiotic conflict and compatibility between the sign subsystems within media upon interpreting the administration of justice. In addition, disequilibrium between different sign systems highlights the consequent need for intersemiotic translation, consciousness and evaluation as part of decision making on court domains.

Abstract:In this study, parallel corpora of the Civil and Commercial Laws and the English translation of the People's Republic of China (hereinafter P. R. C.) are built. Modal verbs in the legal texts are examined from the perspective of genre analysis and semantics. Moreover, a comparative study on different variations of legal genre is adopted. This study further explores the findings from a sociosemiotic perspective in terms of the distinctions on modal verbs and modality between different variations of legal genre. The authors have noticed the disparity of modal verbs in different situations depends on distinct functions of situations. Although linguistic and textual analyses are significant in exploring issues of legal texts, it is not enough to linger within these domains.

Abstract:AbstractThe aim of the paper is to discuss legal language systems as culturally constituted sign-systems that are continuously evolving in time and space. To understand messages formulated in legal languages, one needs to realize that law is culture-bound, which in turn means that law reflects society’s mentality, tolerance, knowledge, social perceptions, etc. At the same time, law is a living reality impacted by various global phenomena and other legal systems. Therefore, this legal reality has “divergent potentialities” (Hasegawa, Ko. 2016. “A glance at the dynamics of ‘confluence’ in a legal system – notes on H. Patrick Glenn’s insights concerningLegal Traditions of the World”. InTransnational Legal Theory. Vol. 7/1: 1–8, 3), which enable it to develop in various directions depending on wider social, political and technological contexts. Additionally, when communicating law interlingually and intralingually, one needs to take into account the knowledge of senders and recipients since the degree of commensurability of law depends on the uniformity of interpretation on meanings. When discussing the issues of sign meaning interpretation, the authors will focus on non-decomposable units and fuzzy units. The meaning of such terms is subject to interpretation through the prism of tacit knowledge. Therefore, the interpretation of any culturally constituted sign-system is burdened with some loss of information and meaning deficiency.
Linguistic Variation and Legal Representation in Legislative Discourse: A Corpus-Based Multi-Dimensional Study

Abstract:This study starts with the multi-dimensional analysis of describing linguistic variation in legislative discourse through three corpora (Chinese legislative corpus, the corresponding English translation corpus and American legislative corpus). Based on the findings from the multi-dimensional data derived from the factor analysis, contrastive interpretations are provided for related legal representations. This study then goes further to apply the corpus-based multi-dimensional analytical approach, deducing total 53 features into 5 interpretable underlying dimensions, represented as: Dimension 1 Involved Production vs. Specialized Information Density; Dimension 2 Narrative vs. Non-Narrative Discourse; Dimension 3 Author-centered Explicitness vs. Situational-dependent Reference; Dimension 4 Overly vs. Not Overly Expression of Persuasion; and Dimension 5 Abstract Description vs. Non-impersonal Style. After the analysis of certain typical patterns among these five dimensions, this study identifies and discusses four legal representations (non-narrative and explicitness, high informational density, the decontextualized style, and less overly persuasion) as key features represented in legislative discourse. Finally, general characteristics, tendencies and preferences identified in the three types of legislative texts are further deduced and interpreted from jurisprudential perspectives.

Abstract:Dialogue is of cardinal importance in maintaining the interpersonal relationship between judges and facilitating judgment drafting as collaborative problem solving. It is also important for the check and balance between courts and the legislature. A court judgment can therefore be taken as a dialogue between judges as well as that between courts and the legislature. Based on the analysis of some judgments in Hong Kong, the purpose of the paper is to exemplify rhetorical preferences of the dialogue and to unravel the underlying pragmatic rationale. The paper further identifies rhetorical strategies such as modality and intertextuality as creating space for dialogue.

Abstract:This is an interdisciplinary publication located in the discipline of forensic linguistics/ language and law. This handbook includes varying comparative African and global case studies on the use of language(s) in courtroom discourse and higher education institutions: Kenya; Morocco; Nigeria; Australia; Belgium Canada and India. These African and global case studies form the backdrop for the critique of the monolingual English language of record policy for South African courts, the core of this handbook, discussed in relation to case law and the beleaguered legal interpretation profession. This handbook argues that linguistic transformation and decolonisation of South Africa’s legal and higher education systems needs to be undertaken where legal practitioners are linguistically equipped to litigate in a bilingual/ multilingual courtroom that enables access to justice for the majority of African language speaking litigants, enforcing their constitutional language rights.
