Abstract:The novel place of the method of economic analysis of l aw lies in the substitution the method of economic analysis to traditional legal method. Though research styles are different for method of economic analysis of law and Marxist economic method, they are consistent on the values. As a kind o f powerful analysis tool, the economic method has already produced epoch- makin g revolutionary influence on a great deal of fields, such as science of law, pol itical science, etc, has irreplaceable advantages. But the method of economic an alysis of law exists insufficient too, it can not at all substitute the traditio nal legal method either. Abstract:There are two main paradigms in classifying the law study from the methodology angle,that is,the formalism inside and the toolism outside.The formalism neglects the social constraints and pressures falling into the law autonomy utopian,while the toolism is the opposite.Bourdieu's field theory has provided the methodology to overcome the shortcomings of the two paradigms.This text suggests studying laws in the Bourdieu's field theory and discusses the specific strategies which are applicable.

Abstract:Later in his life,Derrida showed an increasing tendency toward more pragmatic fields such as politics,law,ethics and theology.His few lectures/works on law have laid a solid theoretical foundation for post-modern study of law,especially his Force de loi,Le Fondement mystique de l'autorit(The Force of Law:The Mythical Foundation of Authority),which covers a wide range of topics in law,justice,violence,authority and the mythical nature of authority,and has played a decisive role in the study of law,politics and literature.Derrida uses his theory of deconstruction to expose the complex ties between these sectors.He looks into the relations between law and language,and between justice and violence,laying bare the paradoxical relation between law and justice.He believes that law can be deconstructed,but justice cannot.Exactly because justice can't be deconstructed,it is possible to employ deconstruction in studying justice.Justice,indeed,is not meant to be reached,but without such an unreachable ideal,we would have nothing to expect.Despite the widespread misinterpretation of his deconstruction,Derrida advocates an elevation of responsibility through deconstruction.In the post-modern era,deconstruction makes thinking possible where there is a dead end,and thus makes it possible to construct new ideas.

Abstract:This essay, a companion piece to “Discipline and Punish: despatches from the citation manual wars and other (literally) unspeakable stories” [Law's cultural mediations, special edition. 2001. Griffith Law Review 10(2)], undertakes a situated and critical cultural analysis of US law, with particular attention to the law school's insistent “training for hierarchy” and the interrelationship of that training with the bodies and texts that are constitutive of judge-made law in the United States. And who promptly told the student. And who promptly told the student. This essay revisits the early orientation of cultural studies work towards interrogating subject-formation and critically positioning and problematizing the scholarly subject and the various institutions, discourses and practices that produce both her subject position and her critical practice. At the same time it also stages an anti-racist, anti-sexist, and anti-classist engagement with the congeries of mechanisms by which hegemony is inscribed, reproduced, and accorded value by a range of practices to do with disciplinary texts and their production within US legal institutions. Both “semiotic”/“textualist” and “culturalist”, then, in orientation, this essay finds little space for celebration or play, although it alludes in its title, inter alia, to Inventing the Abbots, an artifact of popular US cinema that was at once both a reinscription of the family romance and an exploration of the mutually reinforcing and corrosive effects of class, sexism and secrets/silence. Finally, the essay seeks to explore questions raised by Meaghan Morris and Gayatri Spivak about the possibility or radical transformation through such critical cultural practice and the risks of iteration that is complicity, of submission to and collaboration with disciplinary violence, and of the complex politics of negotiation.

Abstract:This study investigates some cases related to the interpretation of law in Right of Abode cases heard by the Court of Final Appeal of Hong Kong, and discusses the sharp contrast between the different versions of interpretation of the same legislative expressions as the same signs in similar cases heard by the same court. This study does not aim to find out the legislative intent of legislation, but to investigate the process of meaning-making in general and the intent seeking in these cases in particular from a socio-semiotic perspective. The study concludes that meaning-making in legal settings is neither purely a jurisprudential operation nor the choice among different canons of legal interpretation. It is rather the dialogue demonstrated in various forms, such as power negotiation and interest weighing. The study, therefore, argues that legal interpretation is a social practice and meaning-making in legal settings is an enterprise of social dialogue and power negotiation; in other words, legal interpretation is in a sense an inter-semiotic operation between law and its interfaces with society and politics.

Abstract:The paper aims to explore documentary evidence in legal discourse from a socio-semiotic perspective and argues there is reconstructive and deconstructive nature in legal narratives and the hegemony in legal narratives can be regarded as conventional. Based on case studies relevant to Control of Obscene and Indecent Articles Ordinance in Hong Kong, the paper finds that spatial manipulation and voice manipulation were employed as strategies by court to create legal hegemony in narratives. Unraveling such strategies helps to deconstruct legal hegemony. The paper concludes that documentary evidence is characterized by the essential features of a sign, which can be subject to the influence of spatial and temporal manipulations, because such kind of evidence is subject to multiple interpretations.

Abstract:Based on Fairclough’s three-dimensional model, this paper sets out to give a critical discourse analysis of the civil Chinese judgment of“The Besieged City”Copyright Infringement Case by adopting a descriptive and explanatory approach. This study analyzes the main linguistic manifestations of power asymmetries in the language of a civil judgment and investigates how the power relations among different participants are shown in the social court context. It is found that address forms, formal words, nominalization, modality, imperatives and ellipsis are the main linguistic manifestations of power asymmetries among court participants. The interpretation and explanation of the situational court context manifests to a certain extent the encoding power relations, and such social structure of power relations help shape the discourse of judgment, and the discourse itself reinforces the enactment of the power relations. It is hoped that the findings of the present research may provide legal professions with new insights into drafting and reading judgments and provide reference for legal laypersons to have a critical understanding of civil judgments whenever they become a reader of this kind of judicial genre.

Abstract:In this introduction to the themed Special Feature 'Law at the margins of the city', we present a roadmap of concepts and practices across the various fields that are explored in this collection of articles. We invite readers to visit a disciplinary and creative encounter by untangling different routes and layers connecting law, finance, raciality, urban poverty and radical insurgencies. The aim is to delineate and reinaugurate an existing but still not entirely explored area of knowledge, in which the contributing articles provoke insightful critiques about legal articulations on and from the margins of the city. Through a multi-sited perspective, reflected in the contexts from which the invited authors are writing, we suggest that the 'problem of poverty' is not only globalised, but also embedded in and facilitated by globally effective legal processes. By bringing together variegated urban experiences in the United Kingdom, Brazil, Italy, Mozambique, Colombia, Turkey and India, that could be read as isolated and localised, a clear global pattern reveals itself in the transformation of cities and their margins. Likewise, a global web of insurgent practices emerges through the local ways in which law is appropriated by resistance groups from the margins. As will be seen in the contributions to this Special Feature, by disputing law and by disputing space, these ongoing practices can work to destabilise an entire world-making system of property, raciality and urban organisation.

Abstract:Under certain circumstances, law may come into conflict with commonsense, which by definition refers to “popular conceptions of right and wrong”, a conflict to which rescue comes a mechanism I conceptualise as “adaptive justice”, as it aims to adapt the law, in balance with other non-positive, but equally universal rules, to the circumstances at hand. It follows two propositions: (1) When law encounters or engenders difficulty during its legislation, application or interpretation, certain non-positive, universal rules will have to be introduced in order to make flexible the rigidity of written law; (2) the solution is an adaptive application of legal rules, rather than adherence to a literal reading of legal texts. In the context of the libertarian-communitarian debate on justice, this notion of adaptive justice may offer us a new angle, as it has an in-built focus on “methodological relationalism”, which by definition uses interpersonal relationship as the basic unit of analysis to decode human behaviour and values.

Abstract:Looking back 25 years after the publication of Pierre Bourdieu's seminal article “The Force of Law,” we inquire into the background for the weak reception of his work in law and society studies. We argue that the differences in the conceptions of law, state, and society between US law and society scholarship and French historical sociology have made it hard to transfer the theory across the Atlantic. We further contend that the impact of Bourdieu's work has generally been reduced by how it has been perceived as yet another French theory. It has thus been decoupled from perhaps its greatest strength, namely, the underlying notion of sociology as a reflexive practice. Against this background, this article sets out to reconnect the practice of Bourdieusian sociology with its conceptual framework and, in so doing, demonstrate its potentially central role in the sociology of law.
