Abstract:While a much investigated concept because of its importance in shaping human discourse, modality has still not been given an agreed understanding. Using authentic Chinese court judgments in Hong Kong, this paper aims to unravel the complexity of modality as exemplified in its usage in the legal domain. It examines formal, semantic, and functional approaches to modality, showing their weaknesses in identifying and explaining modality in legal discourse. It proposes a socio-semiotic approach as an alternative for giving us a better understanding of modality in respect of its meaning and function in our language as a sign system.

Abstract:This study investigates some cases related to the interpretation of law in Right of Abode cases heard by the Court of Final Appeal of Hong Kong, and discusses the sharp contrast between the different versions of interpretation of the same legislative expressions as the same signs in similar cases heard by the same court. This study does not aim to find out the legislative intent of legislation, but to investigate the process of meaning-making in general and the intent seeking in these cases in particular from a socio-semiotic perspective. The study concludes that meaning-making in legal settings is neither purely a jurisprudential operation nor the choice among different canons of legal interpretation. It is rather the dialogue demonstrated in various forms, such as power negotiation and interest weighing. The study, therefore, argues that legal interpretation is a social practice and meaning-making in legal settings is an enterprise of social dialogue and power negotiation; in other words, legal interpretation is in a sense an inter-semiotic operation between law and its interfaces with society and politics.

Abstract:Abstract Although legal terms are conventionally considered to have self-referential, self-closed meaning independent of context, a legal term only acquires its meaning within a given context. As long as the context varies, the meaning of the same legal term as a signifier may change correspondingly. Based on case studies by applying semiotics, we argue that a legal term is just a sign within its sign system; a legal term as an individual sign does not have any inherent meaning, and its meaning can only exist in the relationship with other signs or sign systems. In other words, a legal term only denotes in a particular temporal and spatial context. Through this study, we conclude four propositions about a legal term as a sign: first, the connection of a legal term with a legal concept is relatively arbitrary; second, the meaning of a legal term exists in a sign system; third, a legal term can be subject to multiple interpretations; fourth, the defining of a legal term may be affected by other sign systems.

Abstract:Quite different from translation for general purposes, transplanted legal discourse is often unmatchable to the target discourse community. In reality, exact equivalence could not be found in terms of translation in legal transplant, which means the major task of translation in legal transplant is to solve lacunae, discursive gaps between the source text and the target text. In legal translation, a lacuna seems to constitute a factor of untranslatability. This paper, based on a study of four cases, argues that equivalence can be achieved within the proposed Translational Triangle. The sociosemiotic approach is adopted in this study to explore the complexity in legal translation, and provide insights into legal translation, both theoretically and practically.

Abstract:In this study, parallel corpora of the Civil and Commercial Laws and the English translation of the People's Republic of China (hereinafter P. R. C.) are built. Modal verbs in the legal texts are examined from the perspective of genre analysis and semantics. Moreover, a comparative study on different variations of legal genre is adopted. This study further explores the findings from a sociosemiotic perspective in terms of the distinctions on modal verbs and modality between different variations of legal genre. The authors have noticed the disparity of modal verbs in different situations depends on distinct functions of situations. Although linguistic and textual analyses are significant in exploring issues of legal texts, it is not enough to linger within these domains.

Abstract:Cyberspace, with the rapidly growing network of users and communication technologies, provides venues for myriad social and political interactions. The very technology that enables the development of cyberspace itself also makes detailed and cumulative observation possible. This study aims to investigate cyber discourse in the context of China from the perspective of political and legal integration. Theoretical insight is transformed from viewing cyberspace as a research object to regarding it as a research ontology. To fill in this uncharted domain, this study aims to examine (a) the hidden connotations of the political discourse in cyberspace, (b) the new features of legal regulation in cyberspace, and (c) the relation between political discourse and legal practice. Centering on both political and legal discourse on cyberspace, the findings of this study indicate that there is a dialectical relationship between political discourse and legal practice in cyberspace. With the findings, this study contributes to the discursive construction by extending the discourse studies into cyberspace and integrating the discourse studies with politics and law.

Abstract:Law as one sign system can be recorded and interpreted by another sign system—media. If each transaction in court is taken as a sign, it can be interpreted or transferred by different signs of media for the same purpose, though with different effects. This study focuses on the transformative effects of the semiotic revolution in media on law. The present research revealed that the evolution of media has driven the administration of justice to pay more attention to the process of court proceedings. This research also discusses the semiotic conflict and compatibility between the sign subsystems within media upon interpreting the administration of justice. In addition, disequilibrium between different sign systems highlights the consequent need for intersemiotic translation, consciousness and evaluation as part of decision making on court domains.

Abstract:AbstractThe aim of the paper is to discuss legal language systems as culturally constituted sign-systems that are continuously evolving in time and space. To understand messages formulated in legal languages, one needs to realize that law is culture-bound, which in turn means that law reflects society’s mentality, tolerance, knowledge, social perceptions, etc. At the same time, law is a living reality impacted by various global phenomena and other legal systems. Therefore, this legal reality has “divergent potentialities” (Hasegawa, Ko. 2016. “A glance at the dynamics of ‘confluence’ in a legal system – notes on H. Patrick Glenn’s insights concerningLegal Traditions of the World”. InTransnational Legal Theory. Vol. 7/1: 1–8, 3), which enable it to develop in various directions depending on wider social, political and technological contexts. Additionally, when communicating law interlingually and intralingually, one needs to take into account the knowledge of senders and recipients since the degree of commensurability of law depends on the uniformity of interpretation on meanings. When discussing the issues of sign meaning interpretation, the authors will focus on non-decomposable units and fuzzy units. The meaning of such terms is subject to interpretation through the prism of tacit knowledge. Therefore, the interpretation of any culturally constituted sign-system is burdened with some loss of information and meaning deficiency.

Abstract:The paper aims to explore documentary evidence in legal discourse from a socio-semiotic perspective and argues there is reconstructive and deconstructive nature in legal narratives and the hegemony in legal narratives can be regarded as conventional. Based on case studies relevant to Control of Obscene and Indecent Articles Ordinance in Hong Kong, the paper finds that spatial manipulation and voice manipulation were employed as strategies by court to create legal hegemony in narratives. Unraveling such strategies helps to deconstruct legal hegemony. The paper concludes that documentary evidence is characterized by the essential features of a sign, which can be subject to the influence of spatial and temporal manipulations, because such kind of evidence is subject to multiple interpretations.

Tempo-spatial Construction in Human-Law-society Triangle from the Perspective of Cognitive Semiotics

Abstract:Time and space, habitually seen as the human psychological background, are increasingly being studied as the cognitive foreground for the development and evolution of matters. Via applying the corpus-based method based on the self-complied corpora of the US, the UK, the EU and Chinese data protection laws, this study examines the basic logic framework of time and space, including human psychological representation, semiotic essence, and function, seeking to present a holistic landscape of tempo-spatial construction in humanity, law and society from the perspective of cognitive semiotics. It finds that the human psychological representations in the tempo-spatial construction process contain cyclical time, linear time, place space and field space; the tempo-spatial essence is to express semiotic meanings through social dialogue and power negotiation among legal subjects in social contexts; and the tempo-spatial functions are manifested in mapping cognitive thinking mode of humanity and constructing law and society. It can be argued that legal discourse is the result of the tempo-spatial dialogue between legal subjects that depends on the interaction between society and its members and the overall evolution of its meaning interpretation; the tempo-spatial construction in human-law-society triangle is thus a typical intersemiotic operation. This study demonstrates the utility of sign of time and sign of space as a cognitive perspective in discourse construction and maps the strong interdependence between humanity, law and society.

Abstract:This study starts with the multi-dimensional analysis of describing linguistic variation in legislative discourse through three corpora (Chinese legislative corpus, the corresponding English translation corpus and American legislative corpus). Based on the findings from the multi-dimensional data derived from the factor analysis, contrastive interpretations are provided for related legal representations. This study then goes further to apply the corpus-based multi-dimensional analytical approach, deducing total 53 features into 5 interpretable underlying dimensions, represented as: Dimension 1 Involved Production vs. Specialized Information Density; Dimension 2 Narrative vs. Non-Narrative Discourse; Dimension 3 Author-centered Explicitness vs. Situational-dependent Reference; Dimension 4 Overly vs. Not Overly Expression of Persuasion; and Dimension 5 Abstract Description vs. Non-impersonal Style. After the analysis of certain typical patterns among these five dimensions, this study identifies and discusses four legal representations (non-narrative and explicitness, high informational density, the decontextualized style, and less overly persuasion) as key features represented in legislative discourse. Finally, general characteristics, tendencies and preferences identified in the three types of legislative texts are further deduced and interpreted from jurisprudential perspectives.
Conceptualizing Cultural Discrepancies in Legal Translation: A Case-Based Study

Abstract:By exploring the cultural discrepancies in Chinese legal texts and their English versions and to what extent legal and cultural discrepancies influence and constrain legal translation, the study argues that it is useful to consider cultural discrepancies within a semiotic framework. Language is a phenomenon and factor that links different cultures; the use of language is crucial to any legal system. Law, as a cultural product, is attended by cultural discrepancies when switched into other languages for the purpose of achieving equivalence. After a brief overview of cultural differences in translation, legal translation in particular, the study is set to examine the role of translation in crossing through different legal cultures and backgrounds and investigate barriers in the process of translation. Investigating cultural discrepancies in legal translation within a semiotic framework allows us to focus on certain interpretations by acknowledging that legal texts are composed with systems of systems and interacting with other cultural aspects in a wider context.

A Corpus-Based Interpretation of the Discourse–cognitive–society Triangle on Chinese Court Judgments

Abstract:A court judgment is a common legal discourse and the final carrier of court trial activities. From the perspective of socio-cognitive discourse analysis, this study aims to describe and explore the Chinese court judgments in a corpus-based method, concentrating on the interactions among discourse, cognitive, and social dimensions. We have three key findings through an empirical qualitative analysis of the court judgments in China. First, the discourse dimension of Chinese court judgments is both society-oriented and cognition-oriented. The discourse components could mark the cognition sources in court judgments. Second, the cognitive source of faith is a part of social cognition on law and regulation, and induction and paraphrase provide the personal cognition to testimony, documentary, or hearsay evidence. Besides, the cognitive source of inference could change personal cognition into a social consensus through a reasoning process. Third, the social function of court judgments corresponds to the cognitive source and builds the surface structure with various discourse components. Moreover, a probe into the multi-dimensional relationship in court judgments can offer practical insights into the interpretation of legal texts in Chinese judicial decision-making.

A social semiotic approach could be used to investigate the victim identity of the online romance scam from the aspects of the (re)construction and interpretation of discursive practices. Abstract:Abstract In the latter half of the 20th century, with the development of philosophy studies, Western jurisprudence also witnessed a linguistic turn in its field. A series of academic schools appeared consecutively, such as the school of semantic analysis, the school of new rhetoric, the school of legal interpretation, and the school of structural semiotics. Their analytical paradigms, which were skeptical of the views of legal languages in traditional theories of jurisprudence, are interdisciplinary and multidimensional in nature and characteristics. Normally, there are three methods used in the linguistic turn of Western jurisprudence, that is, the method of symbolic restoration, the method of structural and functional analysis, and the method of legal hermeneutics. Promoted by the linguistic turn, two traditions of legal semiotics also developed. One is the legal theory based on Greimasian semiotics, and the other is based on Peircean semiotics. The linguistic turn in jurisprudence still represents a breakthrough and innovation in the paradigm of legal theoretical studies, as it leads to a re-examination of language, which is no longer treated as a tool but as a philosophical afterthought in relation to the human being.
