Abstract:Using 29 recent high level anti-corruption cases in China as a natural experiment, we examine the patterns in merger and acquisition (M&A) decisions and performance in Chinese non-state owned enterprises (non-SOEs) before and after the exogenous severing of political connections. We identify a set of listed related non-SOEs whose managers bribed or had connections, through past working and educational experience, with corrupt bureaucrats from 2005 to 2011. We document that, after the arrest of corrupt bureaucrats, corruption related non-SOEs lose their competitive advantages in the M&A market. We observe a significant reduction in the likelihood of conducting M&As and the ability to access local and state-owned targets for these firms. They pay a higher takeover premium and consequently have worse post-M&A performance. Our results are robust when we exclude bribing firms, and firms whose related corrupt bureaucrats are arrested within a year before the announcement of the M&A. Furthermore, the influence of anti-corruption events varies across regions that have different levels of corruption index and industries with different levels of government support and competition. Overall, our study provides direct evidence to the question of why firms seek to establish connections with government officials through bribery or personal connections, and we reveal the benefits and costs of such connections.

Abstract:Abstract A significant portion of the misunderstanding surrounding China’s human rights protection stems from a failure to consider its legal progress in light of China’s unique cultural, ideological, and political contexts. The Criminal Procedure Law of China is closely linked to constitutional principles and the fundamental first generation of human rights, providing a clear framework for understanding China’s efforts in human rights protection. As widely accepted standards for human rights codification, Articles 9, 17, and 14 of the International Covenant on Civil and Political Rights (ICCPR) outline the right to personal liberty, privacy, and the defense of the accused. Initially, China’s Criminal Procedure Law of 1979 fell short of meeting these global standards. However, with substantial revisions in 1996, 2012, and 2018, this specific code has progressively aligned with the covenant’s requirements, marking significant strides in human rights protection in China. Despite these advances, there remains room for improving the Criminal Procedure Law, especially under the challenges of the digital age. China, alongside other nations, will focus on building a more comprehensive, robust, and globally integrated legal framework to address the forthcoming issues.

Abstract:The international society fostered a series of anti-bribery treaty,which characteristic as the idea of fairly competition,the strategy of combating offer bribe and strengthen the government of commerce organization after three stages from 1970s.The development of international treaty sufficiently reflects the basic rules of governing bribery crime in market economy.In contrast,the legislation of combating bribery crime in China has some defects,such as lagging ideas,simple strategy and sole object.In order to meet the market economy competition from inland and the world,we should take in the experience from anti-bribery treaty and adjust the idea and strategy of combating bribery timely in future legislation reform.

Abstract:Corruption is one of the thorny issues in any modern society, especially in China. The new leadership of the Communist Party of China (CPC) led by President Xi Jinping has robustly initiated an anti-corruption campaign as soon as he took over as the party chief in the end of 2012. Several legal reforms aiming at fighting harder against corruption crimes drew attention from home and abroad, including foreign investors. These reforms include the enactment of the National Supervision Law in 2018, the introduction of “trial in absentia” in the 2018 Criminal Procedure Law (CPL) amendment, and the establishment of a special proceeding of confiscation of illegal gains in the 2012 CPL amendment. Another undergoing reform is on the corporate compliance non-prosecution. China used to adopt a dual punishment approach upon unit crimes, which means imposing punishments on individual offenders, usually the directly responsible persons, and on the enterprises separately. However, the traditional sanction against enterprises tends to cause secondary harms to the society. For example, when a corporate is bankrupted, thousands of innocent people will be unemployed. Therefore, non-prosecution might be a more effective way of ensuring corporate compliance as well as minimalizing the harm mentioned above. This paper explores the anti-corruption mechanisms Chinese government has created or improved over the past decade and attempts to provide a whole picture of China’s anti-corruption law.

Abstract:The prevailing of commercial bribery crimes, which made magnitude threaten to our economic and socialdevelopment, is one of the important economic and social phenomena in our social transforming period in China. Thebribery crimes are divided into two criterion systems by current China criminal law, such as public official bribery crimesand operation bribery crimes. Two systems are configured with different constitution elements. However, this method oflegislating cannot adapt to the impersonality demand of controlling the commercial bribery crimes. In order to establishingself-contained bribery crimes punishing system in China, it is indispensable to perfect our criminal law by designing thecommercial bribery as an independence crime system which stand above two bribery crimes.

Abstract:Since 2014, the Chinese Communist Party and the Chinese government have begun to pay significant attention to the field of international prosecution of corrupt officials and the international search for stolen money and property. Sources of law in the area of international legal assistance in anti-corruption cases in China include: international multilateral treaties, bilateral agreements, domestic law, memoranda of the Communist Party of China. China has achieved much success since 2014, and such results can be divided into 3 types: success in the international prosecution of corrupt officials, success in the international search for stolen money and property, and, diplomatic achievements. Unfortunately, although the legal regulation of international assistance in anti-corruption criminal cases is constantly being improved and the results are impressive, a number of issues remain unresolved, including: giving more attention on the international prosecution of criminals than the international search for stolen money and property; the frequency of the use of treaties in international criminal judicial assistance and the number of signed international treaties leave much to be desired; focusing on individual cases instead of improving the entire system for catching corrupt officials as a whole; the lack of a mechanism for applying international multilateral or bilateral treaties; the existence of a conflict between different sources of legal regulation in the fight against corruption.

Abstract:The commercial bribery crime is one of the most important forms of economic corruption phenomenon in the social transforming period of China.Our country has taken special measures against commercial bribery crimes comprehensively,and has achieved positive effect.However,the present mechanism of controlling commercial bribery crime bases on the traditional theory of dualistic enterprise's role,which focuses on public servants as being bribees.Therefore,the mechanism does not hit the "upstream crimes" of commercial bribery crime completely,and has some limitation as well.So,we put forward a new mechanism which bases on the view of monistic enterprise's role along with corporate social responsibility and focuses on the enterprises and their staff as being bribers.Furthermore,we establish a continently effective mechanism of controlling commercial bribery crime.We believe that it will remedy the limitation of the traditional mechanism.

Abstract:China has achieved fruitful results in anti-corruption efforts domestically, but it is also important to note that the issue of corruption and bribery related to foreign affairs is gradually emerging. With the increasing degree of opening up to the outside world, many enterprises are going abroad, and many overseas enterprises are also seeking development domestically, resulting in an increase in criminal acts of corruption and bribery. When enforcing the law on foreign-related corruption issues, conflicts of criminal jurisdiction over foreign-related crimes are an unavoidable issue. Currently, China has many shortcomings in governing foreign-related corruption cases, such as incomplete criminal legislation, insufficient law enforcement capabilities, and insufficient international cooperation. At the same time, the United States has gradually begun to use the FCPA to exercise long-term jurisdiction over Chinese overseas enterprises, which has to be taken seriously. In response to this situation, it is necessary to improve China's foreign-related criminal jurisdiction in areas such as legislation, law enforcement, and cooperation, strengthen international and regional cooperation, and write a new chapter in the history of human anti-corruption struggle.

Abstract:Professional sports corruption in China includes not only reflections of social corruption in the profes-sional sports area, but also problems intrinsically existing in the birth and development of professional sports. Its main signs are ill-willed wrong and missed calls and game manipulation made by referees, stimulant usage, athlete qualification forgery, sports gambling etc. Whereas in terms of related legislations currently effective in China, no matter sports law, administrative regulations, or civil law, criminal law, their functions in professional sports anti-corruption are very limited. Abstract:Public-involving economic crime refers to economic crimes that use false propaganda to obtain money or other valuable items from multiple, unspecific victims in the Chinese context. Based on the Beijing public-involving economic crime cases from 2012 to 2018, this study analyses the operation features and effects of public-involving economic crimes. We find that the intersection in criminal and civil procedures, inefficient property preservation, repeat prosecution, and inappropriate information disclosure remain the major judicial dilemmas of public-involving economic crimes. We examine the causes of public-involving economic crimes from the opportunity perspective. Lack of effective regulation and inadequate financial literacy among investors creates opportunities that offenders can easily exploit. This study suggests that practical administrative efforts such as continuous supervision of market entities? economic activities and financial literacy education can block crime opportunities and prevent public-involving economic crimes.

Abstract:In order to ensure the sustainability of the national examination system, which is the basis of social mobility, China has added new criminal sanctions for Exam Cheating in the criminal law amendment in 2015, and issued the latest judicial interpretation in 2019. However, through the analysis of the relevant judicial application data from 2015 to 2019 by SPSS, it is found that there is still a certain gap between the latest judicial interpretation and the actual problems. To a large extent, the judicial interpretation in 2019 solved the problems of the scope of the crimes of exam cheating and clarified its boundary with other related crimes. However, it does not contain detailed provisions on “serious circumstances”, which will certainly affect the original purpose of legal regulation laid down by the legislator to prevent illegal acts and formulate lawful behavior. Through the empirical research on such crimes, this article argues that the functions of criminal law in shaping the moral and behavior standard could give full play only by revising the penalty standards through later judicial interpretation. Such measures are extremely necessary and will achieve the goal that the legislator pursued when introducing liability for cheating.
