Abstract:Construction projects, due to their unique nature, are full of risks, each of which may exert impacts, to some extent, upon the quality, time and cost. In terms of managing risk, the purpose of signing construction contract is to allocate the risks between employer and contractor in such a way as to enable risks to be managed efficiently and effectively in the process of construction. Due to the laws, which are applicable to contracts, the principles of risk allocation are different between standard form contracts at home and abroad.The risks usually are classified into natural, political, economic, behavioral, legal risks, which exist under construction. The latest edition of China's Standard Form of Construction Contract (published in 2007) and FIDIC Conditions of Contract for Construction (The New Red Book) are compared in this paper, from a risk-allocation angle. Though both the FIDIC Form and China's Standard Contract advocate the doctrine of sharing risk, the specific division principle is different to some extent. The difference, which is because of development of construction industry in china and developed countries, brings out these differences in terms of specific sharing-risk. Under FIDIC Form, the contract condition is more stringent to contractors than to employers for the sake of putting contractors bearing more risks. While under China's Standard Contract, contractors bear lower risks. Yet clear contract language and proper risk allocation principles can help reduce such impacts and achieve management efficiency, which is the consensus in the domestic and international academic circles.The comparison between two standard forms of construction contracts can help Chinese contractors, who are eager to engaging in the international project contracting market, be familiar with the contract condition and bodies of law which are used in the international projects at large. This study is also helpful for foreign contractors understanding the environment and conditions of contract in China, as well as promoting the further research about the application of FIDIC Forms of Contract in China.
