Abstract:The data and experience from some hospitals and courts in Beijing indicated that only a fewmedical disputes between doctors and suffers were resolved by litigations. Usually,the two parties in medicaltort litigations were extremely antagonistic to each other. The medical record was the only proof that recognizedby two parties,which meant that the proving of fault was actually the initiating and completing of medical appraisement. Presumption of fault should be the principle of liability in medical tort. Damage is the basic fact,and fault is the presumed fact. How the Supreme Court will standardize medical appraisement after the effec-tiveness of Tort Law is worth of expecting.

Abstract:Negligence in medical practice comes from violation of applicable standard of care. Such standards in common law of U.S.A have evolved from customary practice to acceptable practice, which accommodate the need of new development in clinic medicine, along with several doctrines governing establishment of negligence in malpractice. As in civil procedure, plaintiff-patient's expert witness plays the role of establishment of the applicable standards of care and the violation thereof on defendant-physician's part. In china, the substantive standards are the customary ones which have several flaws, and in proceeding, there is no such an expert, but the burden of proof of no-fault is otherwise uniformly laid on defendant-physician's part. However, as a matte of both law and fact, the establishment of negligence is dependent upon verification by medical association, which is of paramount importance. The customary standard is in many aspects in conflict with burden of proof and verification system. As to the legal relationship between such verification and the proceeding, the accountability thereof on designated professional group who carry the verification, is open to debate. But ancillary professional witness and the possible professional assessor may shed auspicious light on professional requirement of this type of lawsuit.

Abstract:In China,the subject to take the liability for medical damages is medical institutions while medical staff takes the liability only when they don't belong to any medical institutions.Doctors' duty of explanation serves for the demand of patients to know and make decisions and to a specific patient,doctors should not just give a simple explanation.If medical staff breaks the law,it means negligence and should not make a presumption of negligence.If damages are huge,medical staff should adduce no negligence,otherwise,the presumption of negligence should be adduced.Patients' right of control and decision-making of medical information should be ensured.And if medical institutions encroach this right,they should take civil liability.The second edition of Law of Tort Liability has made revisions about this.

Abstract:Objective To understand the patient's logical behavior when faced with medical malpractice and explore the proper approaches for hospitals.Method From five different hospitals,500 patients were surveyed using self-designed case tools(Vignette questionnaire).Result When dealing with medical malpractice,patients tended to continuously complaint to hospitals to seek a solution,and hoped to get early response.When faced with medical malpractice,they were most satisfied with the response that the hospital had made detailed explanations,comforted,apologized,and promised to share a small part of medical expenses;When hospitals beard the main responsibility,Patients tended to appeal to the court to seek a solution,while the ratio of patients who choose to make trouble with the hospital was less than 5% and there was no statistically significant between the two situations.The expected monetary compensation in Case one was significantly higher than the other.Conclusions Whether patients are satisfied with the attitude and solutions of hospitals is a significant factor in the development of medical malpractice.Hospitals should give reasonable explanations,account for their action,comfort patients and share some medical expenses;Patients' severity of suffering and the ratio of the responsibility are predictive of the monetary compensation.

Abstract:At present, medical disputes are still widely-concerned social problems and occasionally evolve into severe social events. In the dispute settlement mechanism, forensic identification opinion is the important technical support. Due to the high professionalism and complexity of medicine, the identification of medical malpractice has become major and difficult problem in the identification. This paper systematically analyze the concept of medical malpractice and five legal theories of malpractice determination, pointing out that China's forensic identification of medical damage should be led by the theory of "medical standards", supplemented by "prudent patient" standard and strengthen "peer review" in form. At the same time, seven main identification principles should be followed in practice: (1) take "obligation of diagnosis and treatment" as the basic principle of medical malpractice identification; (2) take whether to fulfill the obligation of diagnosis and treatment corresponding to current medical level as the specific principle; (3) take diagnosis and treatment routine, norms and guidelines as the main basis; (4) the principle of "peer review"; (5) the principle of "the generality of medical emergency action"; (6) the principle of "notification-informed-consent"; (7) the principle of "review of complications". This paper also puts forward the corresponding identification ideas in view of the above principles, hoping this helps standardize medical damage forensic identification activities.

Abstract:Presumption of fault liability is the imputation principle of medical tort in positive law.There are four different opinions among the academic community in China.Whether the 2nd draft of Tort Law adopts the presumption of fault liability principle is still in dispute.In the author's opinion,the 2nd draft of Tort Law has a problem,i.e.,it doesn't deal with basic fact and presumed fact correctly.In legislation,medical tort should be brought into the criterion system of tort law.The fault liability principle gets a morally depreciating property and leaves a safe district for people's act.Medical tort should take the fault liability principle and presumption of fault as its imputation principle.Damage is the basic fact,and fault is the presumed fact.

Abstract:Objective: Introduction: Legal liability for medical negligence should contribute to the protection of patients' rights to life and health. At the same time, unreasonably strict sanctions against physicians should be analyzed much closely. More balanced model of such liability requires serious in-depth research. The aim of the article is to stimulate discussion about the necessity to improve the criminal legislation and judicial practice of criminal liability execution. Patients and methods: Materials and methods: This study is based on the analysis of international law, WHO documents, jurdicial practice and statistics, criminal and medical law legal doctrine (29 laws and papers, 97 court judgments were analyzed). Dialectical, comparative, analytic, synthetic and system analysis research methods were used, also for interpretation purposes. Conclusion: Conclusions: An effective legal mechanism should ensure the timeliness and thoroughness of the investigation and prosecution of each case of medical negligence to prevent the recurrence of such consequences in the future. Legal liability (civil, disciplinary or criminal) for medical negligence is a necessary part of this mechanism. The inevitability of criminal punishment rather than its severity should be recognized as a core for the medical negligence prevention concept. That's why the long-term imprisonment for medical negligence as a form of punishment should be recognized as socially unreasonable, it cannot improve the protection of patients' life and health but leads to significant negative social complications instead.

Abstract:By reviewing five medical tangle cases after traumatic injury, the characters of these cases and the cause of medical malpractice had been discussed. After the analysis of the responsibility to the death caused by traumatic injury and medical malpractice, the assessment principle of cooperative competition of causes and degree of participation had been introduced. Meanwhile, it is believed that if comprehensive postmortem examination and pathologic examination were carried out to verify the death cause at first, they would play more important role in the appraisal of medical tangle cases after traumatic injury.

Abstract:This paper discusses different needs and approaches to establishing ``causation'' that are relevant in legal cases involving statistical input based on epidemiological (or more generally observational or population-based) information. We distinguish between three versions of ``cause'': the first involves negligence in providing or allowing exposure, the second involves ``cause'' as it is shown through a scientifically proved increased risk of an outcome from the exposure in a population, and the third considers ``cause'' as it might apply to an individual plaintiff based on the first two. The population-oriented ``cause'' is that commonly addressed by statisticians, and we propose a variation on the Bradford Hill approach to testing such causality in an observational framework, and discuss how such a systematic series of tests might be considered in a legal context. We review some current legal approaches to using probabilistic statements, and link these with the scientific methodology as developed here. In particular, we provide an approach both to the idea of individual outcomes being caused on a balance of probabilities, and to the idea of material contribution to such outcomes. Statistical terminology and legal usage of terms such as ``proof on the balance of probabilities'' or ``causation'' can easily become confused, largely due to similar language describing dissimilar concepts; we conclude, however, that a careful analysis can identify and separate those areas in which a legal decision alone is required and those areas in which scientific approaches are useful.

Inequality in the Last Resort: How Medical Appraisal Affects Malpractice Litigations in China

Abstract:BACKGROUND:Medical malpractice litigations affect the practices of patient safety. However, medical malpractice litigations involve highly specialized knowledge. Thus, medical appraisal is usually essential in the ascertainment of responsibility and judicial decision-making. China's judicial system is characterized by a dual-mode of medical appraisal resulting from two parallel appraisal agencies: judicial appraisal institutions and medical associations. This paper examines whether or not and how choices of different medical appraisal agencies affect malpractice lawsuit results in China.METHODS:We collected and sampled a total of 2557 verdicts pertaining to medical disputes from "China Judgements Online" in 2014. We used an ordinary least square regression model and a mediating effect regression model to analyze to what extent and how different choices between two medical appraisal agencies affect malpractice litigations.RESULTS:(1) Almost 81.55% (2082) of litigants resorted to medical malpractice appraisals in China in 2014. Among 2070 cases with appraisal results accepted by the court, 60.10% of the litigants chose judicial appraisal institutions (1244), as opposed to medical associations (826). (2) Among 2557 cases, 2306 (90.18%) claimed compensation and 1919 (83.22%) were awarded compensation by the courts. The proportion of compensation paid in a case is 48% on average. (3) Appraisal agencies matter in the investigation of medical errors, which in turn affects the proportion of compensation paid in a case. (4) Choosing judicial appraisal institutions will raise the proportion of compensation paid by about 10% on average.CONCLUSIONS:Different choices between appraisal institutions affect malpractice litigations in China. As the last resort for remedying medical malpractice, medical appraisals in the judicial system could be a source of inequality in China's medical litigation outcomes.

Abstract:Objective To find out the problems in the medical lawsuits and to reduce the medical disputes.Methods 10 medical litigation of hospital assume liability to pay compensation in a primary hospital in 2011 were analyzed.Results There were 4 cases happened in surgical department,6 cases in non-surgical department,5 cases in the outpatient emergency department,5 cases in inpatient department.The distribution is average.The average amount of compensation is 58,000 Yuan.The lack of medical records management,medical told insufficiency and medical negligence is the main reason for the compensation in the hospital.Conclusion The medical institutions should pay attention to medical record writing and custody,as well as the informed consent management.Besides,it is important to strengthen the "three basic level" training,improve medical staff legal consciousness.
