Abstract:The insider trading has been ceased and monitored by Securities Laws all over the world since it is the action that will damage the share market.However,Securities Law of the People's Republic of China has not established a feasible civil compensation system for victims of the insider trading.Especially,when the damage has been done,it is difficult to make compensation for the victims due to the lack of a uniform methodology to identify compensatory damages.From the standpoint of Chinese judicial practice and drawing on the experiences on fundamental ideas on such systems,the author proposes our country should combine the advantages of kinds of methods together and construct a formula to calculate the insider trading damages which are based on the Expedient Out of Pocket Measure.

Abstract:Disclosure or non-disclosure is one of the key issues in insurance contract. This paper compares laws on remedy for no-disclosures in European and other major jurisdictions. It concludes there are generally two different approaches on remedy for non-disclosure—(1) the strict disproportionate approach; and (2) the proportionate approach. The paper introduces an asymmetric information model to elaborate on the ongoing debates over the various normative issues of fairness with respect to the two different approaches. It confirms that the proportionate approach serves better the goal of fairness, in particular for the insured who acts honestly but carelessly provides bad information to the insurer. The model provides a statistical tool for a correct range of remedy on non-disclosure.

Abstract:Punitive damages have their roots in the common law system. Recently, punitive damages have been increasingly discussed also in non-common law jurisdictions. This Article scrutinizes whether it is viable for a jurisdiction with a civilian legal system to adopt punitive damages in the realm of tort law. It is argued that societal development has brought unprecedented challenges to tort law where merely compensatory damages can no longer provide sufficient remedies to victims. We conduct research mainly from the perspective of China, which has been very progressive in introducing punitive damages into various areas of private law in the past decades and recently codified it in its new Chinese Civil Code. The discussion of Chinese law is proceeded with a comparison with the German law, which is also a civilian legal system that used to have a great influence on the making of Chinese law. We find that the German private law put much emphasis on disgorgement damages, while the Chinese legislator put his trust in punitive damages. German disgorgement damages and Chinese punitive damages focus both on the avoidance of efficient breaches of ubiquitous individual legal rights, such as personality rights or intellectual property rights, but the Chinese legislator makes punitive damages also available in several other legal situations. We provide recommendations for the future implementation of the Chinese punitive damages law in order to maintain a balance between efficient protection for claimants and sanctions on wrongdoers.

Abstract:The application of the principle of indemnity in medical expense insurance is theoretically safe but controversial due to the restriction of current legislation.The discrepancy in precedents undermines judicial impartiality and brings about disorder in the insurance market.The rules provided in the Insurance Law and regulations enacted by the insurance supervisory authority shall be reviewed,because those rules and regulations are in conflict with the tenets of insurance.The insurance law was amended on Feb.28th,2009;however,the classification of insurance and issues concerning subrogation were unchanged and problems arising in insurance practice were not addressed in legislation.Whether the principle of indemnity is applicable in medical expense insurance requires clarification in legislation and judicial practice.Thus,the congruence and authority of judicial department can be safeguarded and proper guidance can be provided for the operation and development of the insurance sector.

Abstract:In today's society, when the perpetrator's malicious and intentional rights are violated, effective discipline is difficult with only compensatory damages. With the development of China's economy and high-tech technologies (artificial intelligence, 5G, etc.), the importance of protecting intellectual property rights is increasing day by day. Accordingly, China introduced punitive damages in which intellectual property rights are mixed with civil tort liability and a fine of a punitive nature. Punitive Damages are damages imposed for the purpose of punishing the infringer in a civil trial when the act of an intellectual property infringer intentionally or maliciously commits an illegal act such as implementation or use. It is a system that imposes a large amount of compensation. China implemented punitive damages for patent infringement from June 2021 through the revision of the “Patent Law” in October 2020. This amendment significantly strengthened sanctions against patent infringement in order to prevent patent infringement and protect patent holders. The contents of the amendment stand out, including punitive damages up to five times in case of intentional infringement, an order to submit documents, and an increase of 500 yuan in legal damages. In this paper, we mainly look at the legal application of the punitive damages system in case of infringement of patent rights.

Abstract:According to the principle of break-even of profit and loss, it is generally held that the insurance could not be deducted from the insurance indemnities when the victim of the tort action possesses both the claim to compensation for damages to the injuring party and claim for insurance to the insurer no matter what insurance contract this client has made. Yet special contract exists in sum injury insurance, under which the injuring party is the insured. There is no final conclusion on this issue, but under Japanese case law, the reception of the insurance of the victim could be deemed as an element in determining the amount of consolation money of mental satisfaction. It deserves recommendation that justice is upheld through evaluation on money expenditure of the injuring party by means of deliberating amount of consolation money. Moreover, the sum insurance shall be deducted from the compensation for damages as regulated in law (in the case of compulsory sum injury insurance) or provisions in contract, so that resolution could be offered before the event in legislature.

For this reason, China has introduced the system of "punitive compensation" into the field of environmental tort in Article 1232 of the Civil Code to achieve the effect of ecological environmental protection. Abstract:According to the Article 22 of the Tort Liability Law,non-pecuniary damages can be applied to various type of cases in which personal rights or interests have been infringed.The right is not dependent on the imputative basis of the case, but there is an exclusionary rule with minor damage.Where a tort causes the death or serious harm of a victim,the close relatives of the victim can request material damages for emotional loss.To decide the amount of the non-pecuniary damages,the judge shall consider the satisfactory degree of all elements comprehensively.

Abstract:Liability Insurance and Tort Law are the most important rules in today's compensation for damage system.They are interactive in development and collaborative in functions.The three basic functions of the modern compensation for damage system are relief,punishment,and prevention.Relief is aimed at the victim,punishment is directed against the perpetrator,and the prevention function is in the light of the whole society.As far as relief is concerned,Liability Insurance is more superior to Tort Law.But there are still some areas that Liability Insurance could not cover.As for punishment,Tort Law functions only when the perpetrator commits intentional torts or has gross negligence,but for general negligence,strict liability,and fair liability,we could see its punishment functions.As to prevention function,these two rules play equal roles.Both can guide people to prevent the accidents.

Abstract:Damages has multiple functions such as compensation, prevention, punishment and protection of freedom of behavior. The basic principle of law of damages must be able to reflect and realize the above functions of damages, in order to achieve the balance of interests between different subjects. The principle of total compensation is contribute to compensate the victims, so it presents an all-or-nothing judging mode in application. Therefore, there are many deficiencies in logic and value. Based on the consideration of the multiple functions of damages and the balance of interest, we should abandon principle of total compensation in the civil code, and make the flexibility of the damages based on the connection of constitutive requirements and legal effects.

Abstract:The Supreme Court of the United States held in Browning-Ferris Industries v.Kelco Disposal,492 U.S.257(1989) that the Excessive Fines Clause of the Eighth Amendment does not apply to punitive damages in cases between private parties;it applies exclusively to criminal prosecutions and punishments,which closed the theoretical and practical debate on this issue,and ruled on the constitutionality of punitive damages under the Due Process Clause of the Fourteenth Amendment.Due to the differences in Chinese and American legal traditions and systems,the establishment and improvement of multiple damages and punitive damages in China should not be simply duplicated.Yet there are several lessons that could be learned from the American legal practice: the application and reflection of constitutional law ought to be valued;more attention should be paid to the constitution while studying other branches of law;the scope and intensity of damages system in China need to be taken into consideration.

Abstract:Article 1232 of the Civil Code formally establishes the punitive damages system for environmental tort with a view to promoting the construction of ecological civilization and deterring ecological violations. In 2022, the Supreme People’s Court issued the Interpretation on the Application of Punitive Damages in the Trial of Ecological and Environmental Infringement Disputes to a certain extent, which solved the problems such as the subject of punitive damages claims and the amount of damages, but the system still has unclear attribution of punitive damages and unfair distribution of burden of proof in judicial practice. The litigation cost of punitive damages is too high, and the alternative payment measures of punitive damages are absent. In order to improve the judicial application of the punitive damages system for ecological and environmental torts, we should consider establishing a vertical compensation management system, reasonably allocate the burden of proof, establishing a unified system for reducing, postponing and exempting the costs of punitive damages lawsuits for environmental torts, and flexibly implementing alternative payment measures such as compensation for labor services.

Abstract:In the early 1990s, China introduced into its civil legal system the punitive damages system derived from the Anglo-American legal tradition, marking a significant legislative breakthrough among civil law countries. Currently, China is one of the countries with the greatest pressure to reduce emissions in the world, and more effective legal tools are needed for environmental governance. Therefore, in China's Civil Code, which came into effect in January 2021, punitive damages for environmental torts were established, enabling the imposition of additional compensation for severe environmental pollution and ecological damage incidents and thus enhancing the deterrent effect of environmental laws. The construction of punitive damages for environmental torts in China has significant positive implications, but the provisions of the system are not perfect, leading to some confusion in its judicial practice. The United States has a very systematic and mature experience in the construction of punitive damages for environmental torts, which is worthy of reference for China. From a comparative research perspective, China's punitive damages for environmental torts should particularly focus on issues such as expanding its scope of application, clarifying rules for determining compensation amounts, addressing issues of concurrent liability and optimizing related legislation.

Abstract:From the perspective of tort law, the transgression criterion of liability of China's state compensatory system pertains to ″subjective transgression″. This cognition of taking transgression as administrative agency's violation of various legal norms by which the attention duty is set up may serve to overcome the limitation of transgression criterion as well as to broaden the scope on which the transgression criterion of liability is applied, although the criterion is still faulted with insuperable limitations. In present legal system, the transgression by this criterion is only considered as violating the laws, statutes and regulation enacted by various legislatures, which seriously restricts the applying scope of the criterion and weakens the function of protecting human rights in China's state compensatory system. In view of the current development in the research on criterion of liability of China's state compensatory system, it is necessary to analyze the internal logic of the criterion of liability of state compensatory law from an academic perspective, so as to reiterate a kind of normative criterion of liability of state compensatory system which is linked to the relatively mature criterion of liability of civil tort law. In the analytical framework of the theory of subjective and objective legal order of analytical positive jurisprudence, the fault criterion liability involves the violation of both the subjective legal order and the objective legal order, and the non-fault criterion only relates violation of the objective order. The ultimate approach to improve the criterion of liability of China's state compensatory system rests with that, the present transgression criterion of liability should be replaced by the fault criterion of liability and the non-fault criterion of liability should be established only as a supplementary criterion.
Reconstructing Dual Liability Imputation System of Tort Law:Risk Domain Theory

Abstract:The traditional liability imputation system of tort law is based on fault liability and danger liability, in which danger liability is considered as an exception to fault liability. The traditional fault liability principle consists of two facets, that is "Where there is fault, there is liability" and "No fault, no liability". However, as the rising of intercourse safety responsibility (Verkehrspflichten), the evolution of fault liability and the expansion of liability without fault, the tort law seems to fall into a state of chaos. Behind the chaotic state, the evolution of liability imputation system of tort law demonstrates that the principle of "No fault, no liability" has been gradually replaced by the rising of risk liability. This fundamental change means that the modern tort law no longer adopts the principle of "casum sentit dominus", but distributes the liability of damage without fault between the parties by deciding who should carry on the risk. The elements of deciding the risk domains includes acquisition of interest, initializing and maintaining risk, reliance, possibility of damage distribution, possibility of self—protection, and so on. In addition, the theory of risk domain has the ability to establish an open and dynamic liability distribution system. In individual cases, it can reach the balance among different elements of considerations. The new dual liability imputation system of modern tort law should consist of fault liability and risk liability, and the risk liability can replace all the liability without fault including the danger liability (Gef(a|¨)hrdungshaftung), liability without fault in intercourse safety responsibility (Verkehrspflichten) and equitable liability. The legislation of risk liability can adopt the mode of combining general provisions with specific types of risk liability.

Abstract:The most important measure is curing victims in dealing with sudden incidents,and securing adequate treatment charge is crucial.Infringers,other persons of compensation responsibilities,or obligation ability probably do not exist to give immediate compensation,victims may not be able to afford treatment,and it′s unreasonable for public hospitals to pay it,which are all objective reasons that treatment charge is paid on account by finance.Payment on account duty has been established as a kind of tort liability by Tort Law of Chin,and is different from traditional financial expenditure behavior.Therefore,the liabilities are combined with financial expenditure behavior and tort liabilities.Financial payment on account will effectively promote compensation of social damage caused by sudden incidents,which belongs to special relief system in the series of social relief system in theory.

Abstract:In the article, the author analyzes the necessity of the mental compensations for the victim of the act of raping using the legal theories. Abstract:China's Insurance Law and various insurance terms stipulate that the insurance company is out off the responsibility of the insurance payment when the insurance accident was caused intentionally by the applicant or the insured.But neither is clearly whether the object of intention refers to the result or the causing action of damages.In accordance with the interpretation principles of doubt the interests,the doctrine of damage result oriented intention should be adopted in favor of the insured which represents the world tendency of case laws.However,when the action was obviously illegal,the intention exemption clause should be applied,otherwise,the doctrine may encourage illegal behavior which runs counter to the purpose of insurance system.
