Abstract:The axiological rules refer to the four rules which are metaphorically expressed as the golden rule, the silver rule, the brazen rule, and the iron rule. The rules states respectively the following, do onto others what you want them do onto you, don't do onto others what you don't want them do onto you, do onto others what they have done onto you, and do onto others first what you don't want them do onto you. The author applies the axiological rules to an analysis of the political philosophy in ancient China, and comes up with three patterns for examination. They are the virtue politics of Confucianism; the utilitarian politics of Mohists, and the totalitarian politics of Legalism.

Abstract:<Abstrcat> Social free order consists of mental free order and legal free order; the former is constructed by aesthetic morality theory, while the latter, by political justice. Yet both cannot separate from each other. In Chinese culture, the establishment of mental free order has been paid too much attention to, and the function of aesthetic morality theory has been overstated. Therefore, we must attach greater importance to the establishment of legal free order, that is, legal free order must has priority over menal free order in the course of modernization drive. In this way, we can build a really harmonious society.

Abstract:There are two principles in the tradition of Chinese political thought:the principle of politics and the principle of governing,the former is the ground of the latter. From these two principles Jia Yi answers the political problematic caused by the transition from the system of enfeoffment to the system of prefectures and counties. Through reflecting on the lesson of the Qin Dynasty's destruction,he finds that only the discarded Wang Dao (the kingly way) is resumed can the real politics have a long peace. People are the end of politics,and the fundamental function of politics is civilization whose basis is Dao.Wang Dao is to civilize people with Li for a better ethos.

Abstract:The core of Chinese political culture and value culture lies in Taoism,Confucianism and law, more specifically in the thoughts of Lao Zi, Confucius and Shang Zi. Lao Zi stresses the importance of Tao, Confucius values the importance of humanism, while Shang Zi pays more attention to the role of Law. The three schools have their own strengths and weaknesses, and their essence is complementary. The author calls the core and essence of the thoughts of Lao Zi, Confucius and Shang Zi as constituting Huaxia Doctrine, which focuses on people, attaches importance to Tao and emphasizes law. While mainly discussing national governance, it also applies to the study and application of international relations, providing an observation perspective different from the western mainstream theories of international relations.

Abstract:Starting with the analysis of Qin bamboo text Wei Li zhi Dao,which makes three requirements for the officials,namely conduct,competence and political attitudes,combining with Qin's Officials as Teachers system,this article points out Qin's requirements for the and reflects that through one unified and regarding Officials as Teachers,the Qin Dynasty tried to achieve their political thinking of the of law.Furthermore,this article theoretically analyzes the state of Qin's rule of law and its ideological approach,and illustrates that through the integration of different levels of standards such as ceremony,custom and law,the Qin Dynasty tried to make a set of unified social evaluation mechanism and social order model,and by shaping the who were its political terminals,the Qin Dynasty tried to realize the implementation of its political vision in the folk areas.Finally,based on a case-study analysis of Yu Shu,this article tries to clarify the intrinsic link between the rule of law ideas and dense laws and the intrinsic links of these unfavorable situations,such as the severe and cruel officials and local strong boycotts.

Abstract:Even though the thoughts of both Mo Tzu and Bentham belong to utilitarianism,they are different in many ways.When Mo Tzu talked about interests,he was paying attention to the situation of survival.Therefore,anything that has nothing to do with survival would be considered as wasting.However,Bentham talked about interests from the aspect of pleasure,which justified the reason for people to be luxury and have a way of living based on consumerism.The political philosophies represented by Han Fei Tzu and Hobbes respectively.Although they were not used in the diplomatic speeches of politicians very often,they were actually used in their political practices.They are the basic principles applied in making rules for public administration respectively by Chinese or Western politicians.

Abstract:Why has China not embraced democracy? This essay provides a three-part explanation. (1) By discussing the conceptual and functional differences between democracy and rule of law, it shows a theoretical alternative for China's political option, which is legalist instead of democratic. (2) By reviewing China' particular social setting and the related political culture, it argues that China's tendency towards the assumed alternative is strong, historical, and logical. (3) Inspired by the experiments of Hong Kong and Singaore polities, it specifies six pillars of the assumed political alternative--a'consultative rule of law regime', which is a rule of law regime supplemented by democracy rather than a democracy supplemented by rule of law. This essay ends with a brief discussion of the feasibility of the suggested regime, with regard to the conditions of current Chinese politics. Therefore, this essay is not only an explanation of China's failure to become democratic, but also a normative justification for a 'mixed' regime out of the Chinese tradition of civil service via examination and the Western tradition of legalism and liberalism via the separation of power to form checks and balances. It represents a Chinese ideal of a political civilization that is radically different from the one usually favored in the present Western world.

Abstract:The most positive evaluation of the classical(pre-Qin) Chinese philosophy so far is to compare it with classical(Greek) philosophy,taking both as thoughts of the axial age.However,not only is the Chinese thought a form of political philosophy,but the times when the classical Chinese philosophers lived in were more comparable with those of Western modernization,meaning that the problems they were dealing with were problems of modernity.Among these modern political philosophers,Han Fei Zi most ably demonstrated his explicit awareness of the nature of political and social changes of his times through his writings.His discussion of the distinctions between the ancients and the moderns can still shed light on the debates between moral conservatism and moral nihilism as well other issues of modernity.Furthermore,to evaluate his thoughts critically can also help us to deepen our understanding of modernity and to criticize some ideas of liberalism and pluralism.

Abstract:To avoid the one-sidedness and abuse of the rule of xieju (principle of applying a measuring square), ZHANG Taiyan redefines zhong-shu, the Confucian golden rule, as two separate yet complementary principles, the idea of which is most manifestly drawn from Zhuangzi's "Qiwulun" ("Discourse on Making All Things Equal"). Zhang's association of zhong-shu and qiwu is based upon his vision of equality premised on recognition of and respect for differences. In Zhang's reading of the Zhuangzi in light of Yogacara, the crucial "concept matching" (geyi) is the explanation of cheng xin as seeds in the alaya consciousness. Cheng xin in this sense not only refers to the natural pattern of things and so is the basis for inference and deduction, but also serves as the means to deal with the diversity of opinions. In moral practice, Zhang proposes the liang xing approach of his qiwu philosophy: to recognize the equal worth of all beings on one hand, and to take the particular characteristics and desires of individuals into account on the other. Thus, it requires the dual practice of zhong and shu: to acquire firsthand observation through personal experience, and to imagine oneself in the position of the other.

Abstract:Chinese absolutism should be judged in a lineage by a comprehensive comparison between political regimes of the same type.The Chinese term zhuanzhi(专制) refers to the unlimited power of a monarch and can be understood by the degree of his centralization of power.Furthermore,it contains the identity relationship between a monarch and his ministers,for example,the relationship between personal control and bondage,and the relationship between unconditional rule and loyalty.From the perspective of "whom a monarch rules for",the degree to which a monarch personally monopolies wealth,resources and reputation can be used as a criterion for identification.The Chinese term zhuanzhi came from a number of corresponding Western terms,such as absolutism,despotism,autocracy,and dictatorship.It has become a localized concept and can be looked at from a historical point of view and used as a neutral concept.As it sometimes may cause political disputes,so it might be replaced by "centralized monarchy" as an alternative.

Abstract:China′s traditional political culture emphasized collectivism,ethical relations and the primacy of morality. Its greatest virtue was giving importance to human ideals and spiritual concerns;its greatest flaw was stressing personal rule and neglecting rule of law. The Cultural Revolution fully expressed the features of China′s political culture,especially the shortcomings of traditional political culture. This shows that traditional political culture exercises a profound influence over us;we must find stable,enduring,and positive elements from our own historical political culture,constituting the ‘subjective consciousness of modern political culture’ from tradition. That is,when developing a contemporary Chinese political culture we must,while stressing the spiritual ideals of Chinese political culture,inject into it the culture of rule of law.

Abstract:The notions,harmony of man and nature(tian ren he yi) and to value justice above material gains(zhong yi qing li),have been widely practiced and studied.From the perspective of political science and political psychology,these two notions actually reflect the cognition of and the attitude toward man and material world among traditional Chinese people,and in turn have regulative influence on Chinese people feelings and attitude orientations about authority,state and political system.As the social environment has greatly changed,these two notions and their implications need to be redefined and understood in the new context so as to provide ethical and political value support for the reshaping of the political psychology of the Chinees people and the building of modern social harmony that is different from classical harmony.

Abstract:Abstract This article identifies and conceptualizes the structural features of the Party-state and proposes a “dual normative system” as a framework to interpret the constitutional reality of China. This framework has four components: (1) structural integration of the Chinese Communist Party (CCP or the Party) and the state; (2) reserved delegation of authority to the state; (3) bifurcation of state decision-making processes; and (4) cohabitation of the two normative systems: one of the Party and one of the state. This article demonstrates that the political reforms in China since the 1980s have not separated the power of the Party and the state, but have created an increasingly institutionalized dual normative system that is more complex compared with the previous fused system, yet more pliable to adjustments and more open to different interpretations, including to that of the “Party-state constitutionalism”, which interprets the “rule of law” as compatible with the rule of the Party.

Abstract:Cases with rule paradox are common in Chinese legal practice. The result of the reasoning process in cases with rule paradox is usually exclusion of the application of the seemingly applicable rules and creation of exceptions to the original rules. Therefore, interpreters have a higher standard to meet in their reasoning. The traditional method of "teleological restriction" is susceptible to the criticism of insufficient reasoning, but the method of principle weighing and balancing can enhance the persuasiveness of the reasoning process. According to the law of competing principles proposed of Alexy, rules are produced after principle weighing and balancing. If we reverse Alexy's law, any rule can be reduced to principle weighing and balancing. This reversal provides theoretical basis for our method of handling cases with rule paradox, which allows interpreters using sociosemiotic approach to rediscover the missing principles and factual elements in individual cases and to reopen the process of principle weighing and balancing before they make decision.

Abstract:The"monistic object"doctrine concerning the relations regulated by civil legislation advocates that in the civil code only the monistic relation regulated by civil legislation should be assumed,which,however,cannot be justified either in logic or in practice.The"interest-centered monistic object"doctrine ignore the difference between the object of civil rights and the purpose of protection of civil rights while the abstract object that centers on behaviors also fails to distinctively demark the existence and mature of the object in the civil law relations of absolute rights. Therefore, an open and plural objects system of civil right may be the proper choice for China’s Civil Code.

Abstract:The article, combining with Max Weber's three kinds of ideal types of political legitimacy, explains legitimacy of traditional politics of China from two sides: One, from the point of construction of political philosophy, traditional politics of China is a political form of rule by moral establishing its legitimacy basis on ethics and moral which becomes the representative of rule of tradition. The other, from the point of political operation state, it represents a rule of charisma which integrates ethical model with political authority. At last, to discuss history legitimacy and disadvantages legitimacy of traditional politics of China and its three differences with modern political legitimacy, the article points that ethics and moral construction of legitimacy of traditional politics turning to modern jurisprudence construction is necessary and dealing with both sides' relations also cannot be ignored.
