Abstract:Intellectual property strategy of one country should vary with the importance of intellectual property domain and the creativity of intellectual property. According to the current creativity capacity of intellectual property in China, the whole intellectual property domain can be divided four parts: strong-important domain, weak-important domain, weak-common domain and strong-common domain. Accordingly, there are four strategy: offensive strategy, break-through strategy, defensive strategy and development strategy.

Abstract:OBJECTIVE:To discuss how to solve patents problems in the registration and approval of drugs.METHODS:Regulations and problems in the registration and approval of drugs in China were analyzed and which were compared with that of the American and Europe.RESULTSCONCLUSIONS:The registration and approval of drugs and their patents right protection were legally independent of each other,to which the drug administration law and patent law respectively are appli-cable.There is no necessary association between the registration and approval of drugs and the infringement of patents right.Patent dispute should be solved in accordance with the patent related regulations,the registration and approval of drugs should not involve the solving of patent disputes of drugs.

Abstract:Intellectual Property (IP) is a pharmaceutical or Biotech Company’s most valuable resource, and its protection is a key to that company’s future success. Recent challenges over patents for HIV drugs has reminded the industry that progress is still needed in balancing the opposing forces of innovation through protection of IP rights, versus the provision of affordable drugs for the developing world. Pharmaceuticals companies must face the daily challenge of creating value through the exploitation of IP rights, but avoiding considerable reputational harm. This situation was well illustrated in South Africa during the late 1990s when the balance between IP protection and the urgent needs of patients were not aligned. Since then, companies have become more aware of the potential damage that can be caused by too strict an interpretation of IP rights. Working in collaboration with national governments, trans-national organizations such as the WHO, and non-governmental organizations such as the Bill and Melinda Gates Foundation, pharmaceuticals companies have begun to find ways through the minefield of IP protection in less developed countries, and most now have donation schemes for drugs to treat diseases such as leprosy and HIV.

Abstract:The common patent management software with simple function, few internet resources and high cost cannot satisfy the domestic enterprise requirement. To fulfill Haier Group's demand, anew method using a platform by integrating patents and knowledge resource on network was proposed to perfect the patent management based on three different models of enterprise patent management: centralized, distributed, matrix. For making the decisions of technology protection strategies, experts should evaluate patents growth economic income of the technological achievement based on the content of the integrated web resources, so enterprise can choose strategies from patent application, technology publicity and technology protection according to different evaluations. Web crawling technology, algorithm of owning patent management and patent applying strategies recommending were analyzed as the key techniques, and a software platform was developed. This platform is being put into practice, which improves the strategy of technology ownership and promotes; the patent management in domestic enterprises.

Abstract:Compared with other types of intellectual property,traditional Chinese medicine and medical art only play a marginal role in China's Outline of the National Intellectual Property Strategy,which simply states that"The mechanism of managing,protecting and utilizing traditional Chinese medicine and medical art should be perfected."But the fact that traditional Chinese medicine and medical art are included in the strategy itself displays their strategic significance.One major problem of"the Outline of the National Intellectual Property Strategy"is the lack of an active attitude towards the innovation of traditional Chinese medicine and medical art and the innovation of system,which should be compensated for in the advancement of the strategy.

Abstract:Inquisitive scientists are untiring and relentless in the hard work they perform day in and day out. In this pursuit, a researcher has to exercise their intellectual expertise in its entirety. Eventually, all credit of the invention is vested with the inventor who has the right of control over their intellectual creation. Likewise, pharmaceutical companies spend extravagantly in successfully introducing a novel drug from hundreds and thousands of lead compounds. Hence, it is a prerogative for every company to protect its innovative products from unauthorized duplication. Certainly, "patents" are the sole custodians of these products of medical intelligence - the drugs! This review focuses on the various intricacies of the drug patent system all over the world with special emphasis on India, Europe, and the United States. A note on other intellectual properties such as copyrights, trademarks, and designs is also added.

Abstract:In China, recent years have witnessed significant growth in the pharmaceutical industry and an acceleration in pharmaceutical innovation. As a knowledge-intensive sector, the growth of the pharmaceutical industry in China marks an increasing need for protecting the enormous amounts of money invested in research and development. Arguably, the most efficient way for industry actors to recover their investments is through granting a limited duration of exclusive IP rights for the use and production of their products. Against this backdrop, over the past decades, China has adopted a series of IP-related laws and regulatory policies in China. On this basis, corporate demands and legislative efforts in China have led us to believe that a sound IP system that is compatible with China's development needs would necessarily help stimulate investment, facilitate technology transfer, and more importantly, allocate the rights and benefits over knowledge and resources among various stakeholders. This is because, at first sight, the IP rights approach contains an obvious solution to the problem of misappropriation or free riding by addressing the problem of non-excludability of traditional medical knowledge (TMK) and associated genetic resources. However, the real picture couldn't be more complex and different. The analysis of this article finds that China's existing IP systems supply a conducive context for pharmaceutical corporations to exploit the system's full strategic potential in plundering TMK and associated genetic resources. This situation has placed local communities and other TMK holders in China at a disadvantage.

Abstract:Many studies agree that a weak intellectual property right (IPR) legal system likely reduces innovation or creation; they also predict that increasing intellectual properties (IPs) in developing countries will automatically lead to local needs for stronger formal protection. However, the situation is found to be more complex in China. With a focus on the use of IPs and relevant protection mechanisms in China, this study points out that many companies acquire IPs for purposes that do not depend on their enforcement; many companies have informal ways of protecting their IPs without resorting to court enforcement. Both the alternative functions and the alternative enforcement mechanisms are shaped by industrial characteristics, especially in four aspects: technological features, administrative regulation, market characteristics, and network structure. Based on studies of different industrial sectors in China, this article develops a general framework for analyzing the role of IPRs in industrial practice.

Abstract:OBJECTIVE:To improve response capacity of China to deal with intellectual property rights protection standard terms (Trips-plus terms) beyond the regulations of Agreement on Trade-related Aspects of Intellectual Property Rights (TRIPS), and to provide reference for improving national intellectual property rights protection policy. METHODS:Trips-plus terms and their common types were introduced to analyze their characteristics and consider about their adverse effects. RESULTS & CONCLU-SIONS:Common TRIPS-plus terms involve data protection,patent interlinkage,patent period extension,limitation of compulsory licensing and parallel importation,etc. These terms pose a significant challenge to developing countries,resulting in delaying entry of generics,increasing drug price,influencing drug accessibility and posing a great threat to public health. China,as the largest de-veloping country mostly relying on generic drugs,should scientifically assess the effects of TRIPS-plus on public health,drug ac-cessibility and pharmaceutical industry in the process of domestic legislation and negotiating a free trade agreement,and make effec-tive use of the TRIPS flexibility to protect the public health.
