Abstract:This paper explores the current state of intellectual property protection in China and its future development trends, aiming to analyze the legal framework, policy implementation, and judicial practices in this field to reveal the challenges and opportunities faced. Through literature review and case analysis, the study systematically examines the impact of technological innovation on intellectual property protection, comparative international experiences, and future development trends. Key findings include: the continuous improvement of legal regulations, but the growing influence of technological changes on intellectual property protection, such as the new challenges and demands brought by emerging technologies like artificial intelligence and blockchain; at the same time, international cooperation plays a crucial role in enhancing the level of intellectual property protection. The study suggests future policy recommendations including further optimization of the legal framework, strengthening the coordination between technological innovation and intellectual property protection, and promoting international intellectual property cooperation to address complex challenges in the global context. This paper provides valuable insights and strategic measures for advancing the development of China's intellectual property protection system and implementing the country's innovation-driven development strategy.
Study on the Injunction System of China's Standard Essential Patent Litigation

Abstract:In the context of the digital age, disputes arising from standard-essential patent (SEP) licensing are becoming more frequent. At the same time, parallel litigations due to the SEP litigations are also increasing, and courts in various countries are now more inclined to adopt the injunction system to deal with this problem. In this paper, this article will review the origin, development, classification and role of injunction, analyse the implementation of the injunction of standard-essential patents in China, and point out the deficiencies of the current injunction system of standard-essential patents in China. At the same time, this article will put forward suggestions including improving the issuance requirements and procedural propriety of the injunction, as well as countermeasures in the face of foreign restrictions on China's jurisdiction, hoping that the injunction system will play a more effective and fair role in China's standard-essential patent litigation dispute resolution.

Abstract:Chinese jurisdictional system is stipulated in the Civil Procedure Law of the People’s Republic of China, which distinguishes between domestic civil procedures and foreign-related civil procedures, however it does not yet provide any prescribed specific jurisdictional for litigations related to foreign IPRs. Therefore, the Special Provisions on Foreign-Related Civil Procedures and General Provisions of Article 4 of the Civil Procedure Law of the People’s Republic of China, as well as the relevant judicial interpretations issued by the Supreme People's Court are applied to the litigations. Since the Special Provisions on Foreign-Related Civil Procedures in the 2024 Civil Procedure Law of the People’s Republic of China is significantly being revised for the first time in about 30 years, it is worthwhile to examine the international jurisdiction system for disputes involving foreign-related IPRs. The following jurisdictional system can be considered for litigations regarding foreign IPRs, focusing on the Special Provisions on Foreign-Related Civil Procedures in the 2024 Civil Procedure Law. (1) New establishment of exclusive jurisdiction over disputes concerning the validity of IPRs granted by domestic administrative institutions based on the principle of territoriality, one of the characteristics of IPR related litigations; (2) Provision of the basis from the Civil Procedure Law and relevant precedents for jurisdictional judgment whether the IPR infringement occurred at the place of infringement, the place of the result and on the internet is toward China with respect to IPR infringement litigations; (3) Re-accreditation of the consensual jurisdiction in foreign-related civil procedures and deletion of the existing consensual jurisdiction of the court with actual connection to the dispute; (4) Establishment of the legal basis with the First Seized Court Principle in the continental law system and the Anti-suit Injunction and Forum Non-Conveniences in the common law system in order to solve the issues of abusive lis alibi pendens arising from the issue of negotiating the license fee on the implementation of FRAND (fair, reasonable and non-discriminatory) term for standard patented technologies for wireless communication technologies; (5) Implementation of Grade jurisdiction, Territorial jurisdiction, and exclusive jurisdiction by Chinese intellectual property court based on the implementation of a four-level, two-tiered court system.

Abstract:Many studies agree that a weak intellectual property right (IPR) legal system likely reduces innovation or creation; they also predict that increasing intellectual properties (IPs) in developing countries will automatically lead to local needs for stronger formal protection. However, the situation is found to be more complex in China. With a focus on the use of IPs and relevant protection mechanisms in China, this study points out that many companies acquire IPs for purposes that do not depend on their enforcement; many companies have informal ways of protecting their IPs without resorting to court enforcement. Both the alternative functions and the alternative enforcement mechanisms are shaped by industrial characteristics, especially in four aspects: technological features, administrative regulation, market characteristics, and network structure. Based on studies of different industrial sectors in China, this article develops a general framework for analyzing the role of IPRs in industrial practice.

Abstract:As the number of patent disputes increases, so do also the requirements of biopharmaceutical companies for fairness and efficiency in dispute resolution, the patent system established in China based on the principle of separation of functions and powers exhibits increasingly prominent drawbacks in the processes of patent infringement litigation and patent invalidation trials, posing a challenge to the efficient, fair, and convenient resolution of patent disputes. In the future, as China further strengthens patent protection, we suggest enhancement through optimizing patent invalidation trials, establishing appellate courts for intellectual property, and adjusting litigation structures for patent validation, thereby stimulating biopharmaceutical companies motivation for innovation.

International Civil Litigation in China: A Practical Analysis of the Chinese Judicial System

Abstract:International civil litigation in China is on the rise in recent years. This trend inevitably continues with China's entry into the World Trade Organization. Given increasing foreign engagement in doing businesses with China, a better understanding of the Chinese judicial system becomes essential in terms of protection of foreign business interests. Jurisdiction, choice of law and enforcement of judgment are three primary concerns of foreign parties seeking judicial relief and remedies in China. Questions commonly asked include: what are the bases for a Chinese people's court to assert jurisdiction over foreign parties; what are the standards to determine judicial competence; how a Chinese people's court decides which law is going to be applied in each particular case involving "foreign elements"; and whether a judgment could be effectively enforced and by what means. Fear that China lacks the rule of law and an independent judicial system produces hesitancy to conduct business in China and pursue legal rights. Creating the public confidence in the judiciary is one of China's most important tasks as it seeks to attract international business. Judicial independence and justice are major challenges facing the ongoing Chinese judicial reform.

Abstract:This paper surveys the legal and regulatory environment surrounding copyright protection technologies, focusing on China in particular. The paper begins with a discussion of some of the interactions between law and technology in copyright protection, which has led to the creation of international treaties to protect the technologies that protect copyrights. A comparison of the various national responses to these conventions is presented, followed by a discussion of the structure and development of the relatively advanced Chinese system for copyright protection technology. The last section outlines some of the unique challenges that have arisen in China for copyright protection technologies and the businesses that depend upon them.

The legal system of China's intellectual property mainly lack the legal measures of encouraging people to create achievement with their intelligence and the legal measures of setting up the bridge between "intelligence achievement" and "industrialization". Facing the complicated development trend of international intellectual property protection, we should look for the countermeasures actively, and cannot only stay on the criticism to the drawback of the intellectual property system.

Abstract:This study examines the impact of infringement and counterfeiting on the performance of corporate innovation. We use a quasi-natural experiment to examine the effects of the Chinese government's crackdown on intellectual property rights infringement and counterfeiting. We find that after the implementation, patent counts and citations significantly increased for companies in industries with a high risk of intellectual property violations or imitation by competitors, especially for financially strong and risk-taking firms. The event leads to more R&D investment and firms also prioritize invention patents over utility patents.

Abstract:Abstract This paper critically examines the trade relations between China and the United States, with a particular focus on the sensitive issue of intellectual property rights (IPR) trade frictions and disputes. It delves into the root causes of IPR conflicts between the two nations by analyzing IPR cases that have arisen since China acceded to the World Trade Organization. Notably, during the period from 2001 to 2016, the United States initiated a total of 243 “337 investigations” cases against China, which represents 77.66% of all such investigations targeting China. This study also considers the strategic implications of these cases and assesses the impact of the evolving IPR system in China. In 2008, China’s IPR policies were notably centered on enhancing protection, which is reflected in text mining results where the keyword “protection” emerged as one of the top eight high-frequency words, with occurrences ranging from 25 to 73. Furthermore, this analysis forecasts the future trends in China’s legal globalization, informed by the evolution of its intellectual property law.

Abstract:In a high‐quality economic era, China needs innovative development. Intellectual property (IP) innovation and development are the first driving forces in China. At the same time, China has signed the Regional Comprehensive Economic Partnership agreement (RCEP), which has had a significant impact on the development of China's IP law. Under the combination of these two factors, China's IP innovation and development environment are worth studying. This paper uses the "factor analysis method" from five dimensions, including initiatives for civic awareness, regional IP development foundation, legislative support, law enforcement measures, and judicial protection, to study the development environment of IP innovation in 31 provincial regions in China, in the past 3 years. It is found that IP development in various regions of China is insufficient in some way, and the scores of different provinces vary greatly, so it will inevitably affect the development of China's IP integrally and then affect the construction process of strong provinces and cities with intellectual property rights (IPR). The novelty of this research is its in‐depth investigation into how the RCEP and global partnerships are influencing the transformation of China's intellectual property landscape. This transformation requires legal adjustments and underscores the importance of specialized IP judge training, alignment with international norms, and regional IP progress to realize China's ambition of becoming a dominant force in intellectual property. Combined with the fact that RCEP has come into effect in China and has had a significant impact, it is necessary to develop China's IP undertaking from legislative, judicial, law enforcement, and international cooperation aspects.

Abstract:With the high development of Internet technology and the global impacts of Covid-19, a trend of multiple growth is being shown in the business of cross-border e-commerce. The issue of intellectual property rights becomes more obvious in this new mode of trade than in others. China’s "14th Five-Year Plan" marked the beginning to implement the strategy of the intellectual property rights for a powerful country. Through the law-and-economics analysis, this paper analyzes the research reports of China’s Intellectual Property Court and American Chamber of Commerce, and finds it essential for the cross-border e-commerce to attach great importance to the risk control and protection of property rights. After the analysis and research, on the possible risk of intellectual property rights faced by cross-border e-commerce, it is proposed that enterprises must not only pay attention to but also actively identify and conduct risk warning of the legal risks of their own intellectual property rights as well as the causes of them, so as to put forward corresponding risk control measures and construct prevention and protection mechanisms.

Denial of Permanent Injunction for Copyright Infringement under Chinese Laws

Abstract:The conventional view that permanent injunction is automatic for IPR infringement is losing ground in China. In fact, there is no statute that requires Chinese courts to grant an injunction upon finding infringement on merit. While IPRs are absolute exclusive rights, IPR infringement incurs liabilities, which by definition are relative. Courts on this account should formulate remedies in the frame of reference for liabilities, with the ultimate objective being to adequately remedy the right infringed. Among the possible reliefs, an injunction is the single powerful non monetary liability. When considering this relief Chinese courts may look at the general rules applicable to the performance of obligations in the Chinese civil laws. Case studies show that this is what they intuitively do when denying an injunction in copyright infringement cases. Specifically, they disallow an injunction where the injunction is impossible de jure or de facto, or liable to impose a prohibitive cost on the defendant; or the right is enforced in bad faith or in an unreasonably delayed manner.

Abstract:At the advent of a new millennium, nations around the world have been challenged by a surge of financial, geopolitical, and environmental crises that informs global societies of an incoming revolution that will reform the socioeconomic order of the modern world. As this new age descends upon us, it is profoundly evident that the future will be defined by our grasp on digital information technologies, the multilateral legal systems that govern them, and the numerous advantages that these systems will afford our societies. The controversial discourse of the Fourth Industrial Revolution, otherwise known as Industry 4.0, imparts an objective truth that the Information Age will present us with substantial systems of technological growth, which accordingly translates to systems of economic expansion. The last several decades of technological development have afforded us with transformative tools in the form of supercomputers, artificial intelligence, information technologies, and a variety of smart devices. Regulating the legal mechanisms that govern the utility and development of these technologies is instrumental to benefitting from the economic prosperity, political strength, and developmental capacities that will follow. This article aims to conduct a comparative legal study of the mechanisms of intellectual property rights protections in their intersection with tort liability structures in the PRC and the USA – two global superpowers at the forefront of both technology and jurisprudence. Analyzing the mechanisms of both countries – particularly with the focus of indirect contributory infringements, intellectual property rights abuse, and structural legal reforms – will provide us with a better understanding of the current state of legal standards in domestic and international governance systems. The study will begin with a bilateral deconstruction of each nation’s intellectual property classifications and protections before engaging in the significant processes of historical legal reform. Subsequently, the article will analyze modern legal interactions between tort liability structures and intellectual property protections while subjecting their current forms against the impeding challenges of technological development as afforded through Industry 4.0. Finally, the article will conclude with an objective view of the future of both nations in the reform of intellectual property law.

Abstract:Trademark Infringement of Original Equipment Manufacturer (OEM) is an important issue in the China (Shanghai) Pilot Free Trade Zone. Such trademark infringement disputes arising from conflicts between the foreign client with foreign trademark rights and the domestic trademark owner with a similar trademark on the same or similar goods are arguable since the so-called “infringement” barely results in confusing or misleading the relevant people. However, court verdicts on this issue have been inconsistent. Furthermore, the customs department’s approach in determining infringement of OEM has been restricted by the narrow scope of interpretation of the relevant provision in the trademark law. Stemming from the differing approaches taken by the courts and the administrative authority, this article attempts to trace the root of the problems and suggest viable solutions.
Critical Analysis of Liability of Internet Service Providers for Indirect Patent Infringement

Abstract:With the rapid evolution of e-commerce, existing Chinese laws have struggled to keep pace with complex issues arising from digital transactions involving intellectual property, especially when addressing indirect patent infringement on e-commerce platforms. By conducting a comparative analysis with international laws from Germany, Japan, and the United States, the paper identifies robust legal frameworks that explicitly address indirect infringements in the digital marketplace. The paper proposes several legislative improvements for China, including the clarification of what constitutes indirect infringement, the outlining of explicit duties for e-commerce platforms, and the creation of specialized mechanisms for dispute resolution. On the judicial front, recommendations include enhancing the specialization of courts and judges in intellectual property, developing detailed procedural guidelines, and promoting alternative dispute resolution methods to mitigate the burdens of litigation. By adopting and adapting these recommandations, China can enhance its protection of intellectual property rights and support the dynamic environment of innovation that e-commerce fosters. Strengthening the legal framework in this way is crucial for ensuring fair competition and encouraging technological advancements within China's digital economy.
