Abstract:The analysis in this study is the contents of the characteristics of mortgage rights revealed in the Chinese Civil Code. The mortgage system plays an important role in the process of economic development by enabling individuals or companies in need of funds to obtain credit by providing certain collateral for financing. This study has great significance in that it analyzed the core contents of the mortgage rights stipulated in the Civil Code for the first time in Korea. It is also characteristic that China, unlike Korea, widely recognizes the object of mortgage by using the term 'mortgage property', which includes movables. In addition, although it is not yet regulated in our civil law, the fact that China has accepted and implemented the floating charge system, which is being implemented in advanced countries, has many implications for us. In China, buildings can be the object of mortgage, but land is unique in that only land use rights, not land ownership, are the object of mortgage. In particular, the Civil Code supplemented provisions related to land contract management rights, a property right unique to China, in order to protect the stability of life and the minimum basic right to live for farmers, who account for half of China's population. In this respect, the Civil Code seems to reflect the intention to protect the rights of farmers, and to revitalize the rural economy. Such differences in mortgage systems between Korea and China are fundamentally derived from differences in the political and economic systems of the two countries. Lastly, the Civil Code is evaluated as an 'encyclopedia of social life' because it establishes rules for basic conduct in the process of individual participation in social and economic life and deals with many contents related to social life. Therefore, individuals and foreign corporations doing business in China have to understand the mortgage system which have a very important meaning in the course of economic activities.

Abstract:Ancient mortars played a crucial role in the construction of historical architectures due to their physical and chemical compatibility with traditional building materials such as stones and bricks. Therefore, the analysis and optimization of the ancient mortar formula are significant in the restoration and preservation of historical sites. In this work, 20 mortar samples selected from five ancient stone pagodas in Zhejiang Province, China, were analyzed. The results showed that mud, lime-soil mortar, lime-sand mortar, and lime-gypsum mortar were used as binders in these pagodas. The Ca(OH)(2) / aggregate ratio ranging from 0.3 to 2.7 was usually used to prepare lime mortar. Protein and polysaccharide were also found in some samples.

Abstract:The Chinese people started to add organic matter to lime or tabia' no later than 1500 years ago, and thus created the traditional Chinese organic-inorganic mortar featured in this paper, which has been demonstrated by a great deal of archaeological evidence. According to the ancient literature records, the traditional Chinese organic-inorganic mortar was widely used for architectural purposes, such as rammed earthen buildings, finishing mortars, city walls, water conservancy projects and tombs. To verify the authenticity of the literature, four types of architecture were chosen from eastern China, and the obtained samples were analysed by chemical methods and FT-IR. The experimental results turned out to be consistent with the literature.

Abstract:The transference of rural land contract and operation rights mostly includes transfer,subcontracting,hiring,exchanging,buy a share and mortgage.At present,the juristic character of main types of transference of rural land contract and operation rights in academe is different from the praxis.Thus,it makes against to let the behavior of the transference of rural land contract and operation rights to be legitimate,presentable and accurate.For letting the transference of rural land contract and operation rights to be "conditional,voluntary,canonical,orderly and legitimate " and sticking up for the two parties in the transference of rural land contract and operation rights,it is especially important to define the juristic character of main types of transference of rural land contract and operation rights.The conclusion of this study is: transfer,exchanging and mortgage belong to the nature of real rights;subcontracting and hiring belong to creditor's claim;buy a share belongs to creditor's claim.

Abstract:On the basis of exploring the attitudes, theories and effects of the system of chattel hypothecation in civil law countries, it is clear that the system of chattel hypothecation and the system of chattel mortgage are totally the same in the aspects of function, the methods of creation, the methods of publication and effects. Accordingly, there is no room, no need as well as no basis for the coexistence of chattel hypothecation and chattel mortgage. However, chattel hypothecation and chattel mortgage are both stipulated by Property Law of the People's Republic of China (the draft edition). The existence of the system of chattel mortgage do not confuse the theories relating to the right of hypothecation and destroy the system of right of things as a whole. As Law of the People's Republic of China Security adopted in 1995 has stipulated chattel mortgage, chattel hypothecation shouldn't be transplanted.
DISCOVERING THE CHINESE COMMON LAW: THE FORMATION OF THE LOAN CONTRACT IN THE QING DYNASTY

Abstract:Many principles controlling the modern western civil law, such as consideration, prescription and capacity, have taken shape in history. This paper, from a historical perspective, explores the logic and rationale behind Chinese common law by focusing on the formation of contract in the Qing Dynasty. The first section shows that in the Qing Dynasty, the delivering of the subject matter was a basic requirement to form a loan contract between two parties. However, an agreement for transferring the item in advance worked as a consensual and bilateral contract, and the aggrieved party could ask for compensation or contractual fine or retain the deposit when the other party broke the contract. The second section argues that in the Qing Dynasty, the writing of a loan contract (Shuqi) is not a contract in and of itself, but is only one of the forms of contracts. The writing worked as the primary evidence of the existence of a contract. In the third section, the requirements of consideration and prescription are used to understand the practice of civil trials in the Qing Dynasty. Back then, when the loan contracts provided by two parties entailed some defects, the judges would adjudicate a loan dispute on the basis of consideration, with an assumption that people acted in their own interest and only in this sense were their acts rational. The judges could also identify the right(s) of parties due to the lapse of time. The fourth section argues against the view that equality was not used as a principle to form civil contracts in Chinese history. In Ancient China, there was indeed inequality between officials and laymen and within family or clan. However, in the Qing Dynasty, the different social status of the parties had little to do with the formation of contract. The restrictions for junior individuals (e.g. beiyou) to dispose his family property were actually restrictions on their capability instead of limitations on his capacity to enjoy private right or to have private obligation.
Defining the Mortgage Practice of Movables in the Property Right Law

Abstract:The rules relating to mortgages over movables under the current version of the Property Right Law(Draft) are not reasonable because the scope of movables which may be mortgaged are too narrow. The restrictions on transferring movable collaterals are against the inherent needs of a market-orientated economy and are obviously unfair to the assignees. The Property Right Law(Draft) should expressly permit creating mortgage interests over all legilimate movables and delete the requirement for mortgagee's consent to transfer any collaterals. In order to balance the interests of mortgagees and assignees and protect the safety of transactions, the Property Right Law (Draft) will have to provide different treatments to transactions relating to collateral transfers depending on the existence and reasonableness of the consideration.

Abstract:According to the principle of idea autonomy,and under the premise that the mortgage and other real rights for security shall not be affected to realize its legal purpose,and the interests of a third person shall not be damaged,the special agreement the parties make as to the related items,which was not clearly prohibited by law,shall be deemed to be valid,generally including the agreement to transfer the mortgaged property,and the agreement of the duration of mortgage after the debt was due;when the mortgagor is a third person,the chattel mortgage without registration mainly has the effect of creditor's rights,and shall not apply the acquisition in good faith;claims such as "the validity of the mortgaged property and the new accessories from it" shall be completely unable to establish;in the case of "mortgage before rent",if without justifiable reasons,the mortgagee shall not deny the validity of the lease;when the common mortgagees are all the third parties,if without contract or the agreement is not clear,the creditor shall have the right to choose the priority or exercise all mortgages at the same time,and the mortgagor who bears the guarantee responsibility has the right to recourse against the debtor,but shall not be entitled to recourse against any other mortgagor.
The System Design for the Realization of the Inner Balance of the Mortgage Relation

Abstract:Any construction of sound legal system calls for an internal balance between rights and duties. Traditional civil law focuses on the functional analysis of hypothec,that is,the protection of the benefits of the mortgagees or the creditors,but the interests of the mortgagers do ont receive enough attention. The unequal attention given respectively to the mortgagees and the mortgagers shows that the system of hypothec is not perfect on this respect. When there is a disregard of the protection of the mortgagers,the development of the system of mortgage is consequently hindered. The system of hypothec should pay due attention to the protection of the mortgagers in order to perfect its inner legal relations and the best way to achieve this is to give the mortgagers the right of demur at the time of the alteration of the main contract and to impose some legal duties on creditors with mortgage.

Abstract:Land mortgage is a common economic activity. Among the villagers of Shicang Village, Songyang County, Zhejiang, there were various ways to discharge a mortgage. These varying ways, as well as the shift of villagers' status between mortgagor and creditor, and the inter-related fluctuation of land prices, grain prices and the mortgage rate, reveal that, in traditional mountain villages in southern Zhejiang or an even larger area, the process of land purchase by the better-off was a process of decentralization of wealth. In buying and selling land and dividing up family assets, traditional villages underwent two processes, different in kind, that decentralized wealth. These two processes produced an equal yet poor society.

Abstract:The JiuShu of Wang's pawn industryis a new sort of data and literature for the study of the Huizhou merchants,in which the ways of capital operation between the periods of the traditional society and the modern one were reflected.We can learn from the general ledger(explicitly recorded)that the Huizhou merchants' pawn industry consisted of two parts:inheritance from the family and bear interest capital,among which the social deposition took about 28 percent.The sentence of no Huizhou is outsideindicated that Huizhou merchants' pawn industry run Hui Piao commonly and possessed good commercial credit.Also,the fact of Wang's pawn property was divided into several parts and the operation of running Hui Piao couldn't make a profit demonstrated Huizhou merchants' commercial capital was difficult in expanding at the market condition of that time.

Abstract:This paper compares the current Chinese mortgage market with the markets in several advanced economies that suffered most in the 2008 Global Financial Crisis, exploring the potential and rigidities of development of the secondary mortgage market in China. It finds that, first of all, while the over-securitisation of mortgages in the United States accounted for most for its housing decline and subsequent economic stress, the housing downturn in China is largely the result of the underdeveloped housing finance sector. Second, in the absence of a well-functioning legal system and mature primary mortgage market, China needs to make more effort to improve the diversity of the primary market before establishing a secondary market. Third, in China’s market transition, the nature of housing should be seen as neither an economic engine, as now in China, nor as a financial derivative, as in the United States.

Abstract:In the society where the abstract concept of ownership and the concept of separation between attribution and domination are absent,domination of things would be the method for real guarantee during the course of transaction.In the traditional society of China,this method of guarantee was such a consuetude as "living sale",which was the same with pawn of estate in nature.The reconstruction that severing the relationship between sale and pawn,defining the right of pawn as a kind of usufructuary of the Civil Code in the Republic of China era,contains the limitation of legislative idea and internal contradiction of legislative technology.When the Code of Things be enacted,the traditional pawn would play a role as the form of ownership guarantee in Chinese society and economy.

But whatever measure was adopted, the leaks produced the conflict in the liege relationship could not be walled up because of the autocratic centralism. Abstract:Assignment of credit is an important system in the law of obligation, and closely related to jus rerem and the system of unjust enrichment. Under the contract law of China, where parties agree that the credit is unassignable, the agreement shall be observed. Making such affirmativeness concerning the validity of agreement is open to question. It is inconsistent with the trend in foreign countries, and not fit for the need of the economic development. Deepened probe should be made with respect to the issues concerning the concept, constituent requirements, and legal force of the system of assignment of credit.

Abstract:Mortars sampled from Dutifulness Monument, where typical ancient China mortar formulas and manufacturing processes were used, were analyzed by starch–iodine test, FTIR, DSC–TG, SEM and XRD methods. Several modeling samples were then made according to historical records of Chinese ancient mortar formulas and analyzed with the same techniques. The modeling formulas also were used to consolidate loose specimens. The results show that sticky rice plays a crucial role in the microstructure and the consolidation properties of lime mortars. A possible mechanism was suggested that biomineralization may occur during the carbonation of calcium hydroxide, where the sticky rice functions as a template and controls the growth of calcium carbonate crystal. The organic–inorganic materials formed based on this mechanism will be more favorable for consolidating the loose samples both in strength improvement and durability.
