Abstract:On the basis of our research findings over the last 20 years, this chapter comprehensively examines the land tenure system and its evolution and function in the context of traditional Chinese socio-economic perspectives, and seeks to construct an interpretation framework with an internal system of logic. In China’s history, land rights existed independently and were traded in the market at different levels and over different periods, thus forming multi-layered land property rights such as ownership, possession and usage rights. Correspondingly, the land rights transactions have taken various forms, each with its characteristics and connectedness, thereby structuring a hierarchical and inherently logical system of land rights trading. By examining a large sample of primary documents, especially highly accurate land transaction deeds and Xingke tiben (memorials on criminal matters), this article attempts to reconstruct traditional Chinese land property rights and the property transaction system centring on dian (conditional sale), as well as to dig deeper into the heritage of China’s land system and its evolution over the last millennium. On this basis, the author explores the connection and interaction between the land rights market and the household farms, and reflects on the old theories of “share tenancy” and “the equalization of land rights” based on historical evidence and theoretical logic to reveal the fundamental characteristics of the traditional Chinese economy, which sharply contrast with those of the economic path of Western Europe and its modern transformation dilemma.
