Abstract:'No punishment without responsibility' (the theory of negative responsibility) is one of the fundamental principles of the modern criminal law. Our Constitution has specific articles stipulates that 'The state should respect and protect human rights' and 'The personal dignity of citizens of the People's Republic of China is inviolable', those are the constitutional basis for the principle of responsibility. The principle of responsibility is a constitutional principle, therefore, criminal legislations which violate the principle of responsibility should not exist and theoretical interpretation regarding the criminal law should not breach the principle of responsibility. Free will is the basis of responsibility. Even though it is hard to prove free will in science, free will is still worth expecting and protecting in law.Free will can only be taken as an assumption, but it is a rational and positive assumption and it is not against the principle of 'The benefit of the doubt goes to the defendant'. The theory of normative responsibility is not contradicted to the theory of psychological responsibility. Our criminal law adopts the theory of normative responsibility on the premise of psychological responsibility. As to the theory of functional responsibility which equates responsibility and prevention, it not only loosens the restrictive function of punishment, but also uses individual as means to stabilize the society, which makes it violate the human dignity; therefore, it is contradicted to the articles of the Constitution. Judicial practice should adopt the theory of normative responsibility.
